I-130 outside processing times spouse of LPR

Hello All,

Here is our problem. We applied in Aug 2006 for I-130 petition for spouse of LPR (green card holder). The first application was sent to Vermont Service Center. Until the end of 2009 USCIS sent a letter saying that they have transferred our case to Texas Service Center. Since then, we have called them and they always keep on telling us to wait. The last time we called they opened a request to look at it since it is outside processing time. They are already approving I-130 from 2007 and ours seems to be stuck. Do anyone have any idea what can be done in this case, besides wait and wait.... any suggestions would be really helpful. Thanks in advance.

So, about my process, I re-submitted AOS document on March 1.

Then received email conformation of Acceptances from USCIS.

Finaly I've entered AOS process !!!!!!! :dance:

And, Sorry I didn't reply your post on another thread. I was trying to keep away from immigration things,

because I wanted to manage my emotion, I was so eager to re-submit but had to wait the March visa bulletin become current.

I am glad to hear from you. (L) I hope all goes smoothly for your AOS. I knew that maybe you were going to wait until March to re-apply. Do you have any idea how long the AOS is going to take? I hope that soon you'll have your GC in your hands :) Are you going to school now or did you stop attending?

I did email them (today) like you mentioned and they sent me back an email saying that I need to call the customer service (basically a general email). I replied to them saying that we had called 30 days ago and so far there was no action on our case, gave them the ticket number, names of petitioner and beneficiary, case number and receipt dates. So far we are waiting to hear if they say something different.

I am getting quite worried because they seem to either have lost our petition or maybe something is wrong with it. I am seriosly contemplating to drop this I-130 petition and re-apply again. Soon my spouse is going to apply for USC and wait for that.

Your case transferred to Texas Service Center, right?

Texas Service Center Processing Times for F2A is " November 17, 2005". (As of Jan 2010)

I think this is why they keep telling you wait.

But remember that 'The processing times indicate the timing for case review.

This case review cannot translate to a case approval, unless there is an available immigrant visa number.'

I know you feel frustrated with those things.... :( But, please don't give up !!

Did you see the April Visa bulletin !? It's moved to '01JUN06' !!!

Once, the Visa number become available for you, USCIS will approve your case.

I would go to local office with Receipt Notice in hand or call USCIS.

They don't work for us unless there is an available visa number.

My AOS process may take 3 months (hopefully). :star:

Now, application routed to the National Benefit Center (NBC) for review processing.

And I am attending school now because there are still chance to receive RFE.

So, once I obtain the Approval notice for I-485, I won't worry my status.

I thought it was an improvement that they sent our I-130 to Texas so they would act faster on it. It was better in Vermont :unsure: it actually went back one month in processing time (and lucky us got caught in this mess). Thank you for the links and the email addresses. I did email them and no response but a general email.

I am really getting worried because I will approach soon the graduation date and have to apply for OPT. I am really worried now, because I hear they have the stupid rule of 90 of unemployment and you are out of status. How are we, International Students able to find a job at this economy in 3 months when even americans can't. So this is why I am getting worried mostly the timing thing. Plus how about if I get an RFE that will slow things down even more.

Lpr spouse is going soon to apply for US citizneship, let's hope that it will go faster than this headache I-130. fingers crossed :thumbs: So this is why we are considering to drop the aplication and reapply again. I jsut don't know how they will take this. If we don't get an asnwer soon then we'll go to the local USCIS office (last shot).

I think it is a good idea to stay in school until they approve AOS or Lpr becomes a USC. you'r close to the end of the tunnel, i really hope it goes smooth :)(L) Good Luck!

Read I485 instruction carefully and take a medical exam at civil surgeon.

My AOS, I've been waiting for a biometric appointment notice letter.

They touched I485 & I765 case on March 24 (last up date).

But I've heard nothing from them so far after NOA1 hard copy received.

I will update as soon as I get news :star:

Many AOS Applicant make a one check for $1010, But my rejection notice tell me that

' The check amount is incorrect or not has been provided...'when I submitted in January.

I did walk-in biometrics yesterday , yes, I couldn't wait !!!!

When I arrived Application support center around 3pm , there was only one applicant taking fingerprint.

It seemed like I went there best time. All things went nice and smooth (L)

I did walk-in biometrics yesterday , yes, I couldn't wait !!!!

When I arrived Application support center around 3pm , there was only one applicant taking fingerprint.

It seemed like I went there best time. All things went nice and smooth (L)

They touched my case ( I485 & I765 ) today :star:
