I-485 , Part 2- Application Type

Timeline

Situation:

Pretty straight forward actually except we're having a hard time finding the right selection due to the wording of the I-485 part 2.

My Fiance is a F-1 Student living in the US and about to adjust status.

On form I-485 I cannot see to find the best fit from their application types however the only one that seems close is selection B? Any suggestions?

wait, your FIANCE? or your spouse?

If fiance, is a student eligible to adjust status????

If spouse, I'm assuming you're filing an i-130 concurrently - you may check "others", then type: filed concurrently w/ 130 petition by U.S Citizen spouse. Some people checked the first box too..."...visa number available immediately". I think that's okay too...Either should be okay.

***I had originally checked the first box, until a lawyer we had consulted with said we should check "others" - filed concurrently w/ i-130 petition by u.s.c spouse.

26 January 2010: Received by receptionist CHIBA at 8:30 AM/Received date on NOA

02 February 2010: Checked cashed/Notice date

05 February 2010: Received NOA's for I-130,I-485,I-131,I-130

13 February 2010: Received ASC Appointment Notice for Biometrics.

17 February 2010: Date of RFE for Federal Tax 1040/Received Text & Email confirmation

19 February 2010: Received RFE in mail

22 February 2010: Mailed Response to RFE via USPS Express mail

24 February 2010: Package delivered and received at Lee's Summit office

26 February 2010: Biometrics DONE/RFE Received-case processing resumed

17 March 2010: Email approval notifications - EAD & AP.

22 March 2010: Received AP by mail. Received interview schedule notice for 22 April.

22 April 2010: Greencard Approved :)

Removal of Conditions

24 January 2012: Sent I-751 petition via USPS Overnight

25 January 2012: Delivered at CSC, Receipt Date NOA1

27 January 2012: Checked cashed

30 January 2012: Received NOA in mail.

06 February 2012: Received Biometrics notice (dated 03 Feb)

02 March 2012: Biometrics appointment.

If you select option a, do you send in a copy of the I-130 form you are filing concurrently, as proof?

1st March 2010 - AOS packet received at Chicago (I-130, I-485, I-131, I-765)
9th March 2010 - Checks cashed
12th March 2010 - All 4 NOA's received
19th March 2010 - Applications touched biggrin.png
19th March 2010 - Received Biometrics letter for 2nd April
2nd April 2010 - Biometrics done
19th April 2010 - Received interview letter for May 21st biggrin.png
6th May 2010 - All applications touched. Status of I-765 changed to document production, status of I-131 changed to post decision activity.
10th May 2010 - Received approved AP in mail
21st May 2010 - AOS Interview, IO said he will approve the case... waiting for Green card smile.png
27th May 2010 - Received EAD card
17th June 2010 - Approval notice for I-130 received. Also received "Welcome to USA" letter biggrin.png
28th June 2010 - Finally received my GC.... Praise be to God smile.png

16th March 2012 - Sent ROC package
21st March 2012 - NOA1 date
20th April 2012 - Received Biometrics letter for 16th May

December 2012 - Received 10 year GC

01 Nov 2013 - Sent naturalization package

18 Feb 2014 - Oath ceremony done, naturalization complete!!

I checked the forms. Part II is application type...

your options would be:

(A) "An immigrant petition..." or (H) Other basis of eligibility.

To make things clear, you are a USC?

Assuming you ARE a USC and you file the I-485 after March 14, you will also have to file for an I-130 - Petition for Alien relative with the I-485 because I'm not sure if students can adjust status. And yes, you will be sending the all applications to the Chicago Lockbox (please verify in the instructions) in one envelop or package.

Each application had its own cover letter stating it was filed concurrently with the other application ( I-130 w/I-485, I-485 w/I-130) and the whole package had a main cover letter.

I hope I was able to help you. I'm sure other people had prepared their packages/applications differently, but when the lawyer checked this, he said it thorough.

Thanks so much! , Yes I am a US citizen, and my Fiance (Wife as of March 14th) is here in the US. We will be filing every form for the whole AOS process together, 130,485, etc etc.. She is a Curently a F-1 Student right now but like I mentioned earlier soon to be wife. the only thing we had diffuculty with was the I-485 question part 2. So I'm guessing option "A" is the best choice as mentioned in your comment earlier which is a immigrant or my spouse adjusting for status to be a resident?

A friend and a couple of other AOS applicants here in VJ ticked (A), I ticked (H) as advised by the lawyer. I had originally ticked (A) but the lawyer said, "we're still not sure if your petition is approved".

I guess it's really up to you :)

So far, I have not encountered any problems regarding the application, except for that RFE for federal tax. :)
