Hi!

I am currently waiting for my interview at the Italian Consulate for a K1 visa. We are planning on getting married as soon as I arrive in the US.

I have been reading posts about Work Authorization and AOS, and I saw most people were applying for a SSN and an ID. I was on a J1 visa in 2008 and I have a SSN already-- it obviously says "Valid for Work only with DHS authorization". My driver's license expires in 2012, I think the DMV made a mistake because I think it should have expired with my J1 visa.

My question now is: after we get married can I just file for AOS or do i have to go to the SSN office first? And should I just get a California ID instead of using my driver's license? I am just afraid since they made a mistake with the expiration date at the time it may cause problems.

Finally, when can you have the "Valid for Work only with DHS authorization" removed?

Thanks in advance for all your help!

Get married - file for the AOS.

You do not need to go to the SSA before you file the AOS.

I would not worry about the drivers license.

Once you get the GC - you can get that DHS stuff removed off your card (and change your name if applicable).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

I doubt DL has to match with your visa. I cam with F1 in 2000 and mine was valid looong time. I have been renewing it online for address change wtc... never asked for any documentation ever. I agree with this post I wouldn't worry about my DL. file for AOS and renew your SS card with approval, or you m ay even be able to use it with work autorization documents w/o renewing it...

Thank you both!

Yeah, I was under the impression your DL would expire with your J1 because two people told me so but you right, it doesn't make much sense:)

Well, it's good that I can skip the 2-week wait to get a SSN since I already have one, YAY!

Thanks again
