complicated situation please advice

Greetings!

Im a filipina maried to an american.Was in the states and return back here in philippines and been separated 3 years now.I never got to adjust my status,to remain in the US.For 3 years i been separated,I want to move on and live life.My husband dont cooperate with the divorce or never send me divorce.I have found new love,my new fiance wants me to go back to USA with him and get maried.Im seeking help on what to do with my situations? I hope anyone here have advice for me....Thank you All!

Not much you can do without a divorce.

Removal of Conditions Journey

3/3/2009 - Removal of conditions - sent off packet to CSC
3/5/2009 - I-751 received in CSC
3/9/2009 - Check cashed
3/20/2009 - Biometrics notice received (no NOA1)
4/2/2009 - Biometrics
4/9/2009 - NOA1 date (first undelivered one is 3/5)
4/3/2009 - Touch?
5/6/2009 - ROC Approval - 65 days
6/22/2009 - CRIS Card production ordered email
7/7/2009 - GC arrived!

Where were you married, in the US or the PI? If its in the US, you should contact a divorce lawyer who is familiar with family law in the state you were married in. He/she wold be able to advise you of the procedures necessary to pursue a divorce even if the other spouse is uncooperative or MIA. If you married in the Phillipines, you would have to pursue an annulment. Some of the ladies in the PI sub-forum may be able to point you in the right direction regarding that course of action.

A divorce initiated by a Philippine citizen will not be recognized by the Philippine government even if the divorce is in the U.S.

Unless her non-filipino spouse initiates the divorce, an anullment is the only option.

as i commented in a similar case, she may already be divorced and not know it. she may have been divorced in abstentia, the husband claiming he was unable to locate her after she "abandoned" him. when she contacts a family law practitioner in the city/county where she got married she should discuss this possibility and have them examine the issue.

any way you slice it, it's gonna be expensive, but, the 3rd time is the charm. guess we'll have to find another US guy to throw into the mix.

Maybe the "new" fiance can look it up in the records where she got married?
