Passed U.S. Citizenship Test, but request more evidence..weird??

hi all,

good to see you'all again.

ok, here is the situation: my wife and I have moved from chicago to San Antonio (TExas) for 5 years now.

It's so weird

My wife went to take U.S citizenship test in San Antonio, TEXAS, and she passed the test, but they need more evidence to prove that we're living together. ...strange right?

4 weeks later, they sent us a letter and asked us to come together for interview.

today, we went in and brought all proofs that we're living together including: utilities bills, apartment lease contract with both our names, car insurance, driver license, income tax returns, etc.

all utilities bills, insurance...all of them show the current and previous address we live together.

She took my wife into her office alone while I waited outside in the waiting room. after 20 minutes, she called me in and let my wife out.

she started asking so many questions if that match everything she has asked my wife... where did you live, why did you file your income tax returns as "Separately", how many brothers you have and what their names?what's your dad's name, mom's name.....and many more stupid questions..finally, the interview lady told us, she is confused, she is not convinced that we are a real married couple and living together.

she told me to wait for the letter for final decision.

that's it...I feel like being interrogated by police officer

I asked her how long we wait for the letter. "I don't know", she replied in cold blood. that's it, we went home

any advice? your help is greatly appreciate!

This is weird!!!!!!! Sorry to hear that.This is the first time i read about somebody been called for a interview for Citizenship, that was almost like the one in AOS. Just keep thinking positive and wait for an approve soon. Keep us post it!!!!!

06/30/11 Received AOS check list. Missing DS-230. (It was sent 06/23/11)

07/07/11 Case Complete per AVR and operator. Waiting for interview date.

08/01/11 Per NVC Operator Interview date 09/28/11

09/26/11 Medical test. Passed!!!!

09/28/11 Interview date @ BGT embassy. Approved!!!!!!!

10/06/11 Visa arrived.

10/19/11 Arrived to USA. POE ORLANDO

I know...

she asked me why did you file your income tax separately, but not together? It means she is totally doesn't understand tax law at all. I told her when you and your spouse filing income return as "Separately", it means you're responsible for your own tax and your spouse responsible for his/her own tax, but it doesn't mean you two live apart. I told her whichever way "together, or separately" give you more benefit, and the tax laws allow you to do it

hey guys., if my wife get denial letter for U.S citizenship, then I will file a law suit against the interview lady for telling false information or "Misconduct while on duty"

because she told me that "why did I open an ultility account in Chicago this year?". I answered her that I been living in Texas for 5 years and didn't come back to Chicago. where did you get that information? can I have a copy of that?...she said "NO, I don't have it".

she lied to me. which is telling false information!

can I sue her for that? :oops:

because when you take test for U.S. citizenship, either you pass or fail or retake the test....how come they asked for more evidence. ..even though we brought all evidene into her office, but she still not satisfy?

wait or report ? which one is better for me? if she is going to send a denial letter 4 weeks later, it would be too late to file a report, right? I never see any case like this before...I'm very mad now.

Sucks but you still have to kiss #### to USCIS . I'd wait and see whay happens. If it's negative I'd call my senator and get him involved. I doubt if it would do any good to report the person.

Because you and your spouse were asked some tough questions you want to sue someone? On what grounds? Passing the citizenship test does not prove anything about your marital relationship.

Comingling of assets and finances is one of the more common things that are assessed. But it certainly isn't a requirement.

As the IO had doubts about your relationship then they were comparing the answers given by the both of you.

Being defensive is not the best way to respond to the IO questions. That indicates a person may have something to hide.

The IO asking questions that are typical knowledge that a married couple would share allows you to prove the bona fides of your relationship. Take advantage of the opportunity to present a preponderance of evidence demonstrating your bona fide relationship.

IF you have concerns, begin with your congressperson and US Senators. They can have a more positive influence on the case (and cost you less $$) than a lawsuit.

This isn't weird at all and pretty normal actually. The IO probably wasn't 100% convinced that there was a bonafide marriage. They just wanted to really check that out. Too common now days are marriages of convinience, and they're really cracking down on trying to put an end to that. So there is nothing unusual about this.

In my interview, I submitted a ton of joint bills, car leases, etc and a ton of photos etc. At the interview I brought even more of those things (the most recent to that date). We filed our taxes married but filing seperatly as well. Not an issue. The IO just said to me that he didn't need to see all the new evidence I brought because he said I gave so much in the N-400. He said this is a good thing and that so many other people do not send much in their N-400 or their interview. He told me it's people like that, that he has to worry about.

For my case all that supporting documents I could find, he had no doubt that the marriage was legit (even though unfortunatly 3 years later we divorced, but that's a whole other issue not related to INS).

So it's all about the supporting documents, and nothing is weird or strange about the OP's situation at all. It's quite normal...

Yes, the USCIS has its own standards for a bona fide marriage. Living together is not sufficient to show a serious marital bond; joint ownership of property and assets, joint responsibility for taxes and other obligations, designation of beneficiaries for insurances, etc. -- they are legally binding.

Hi Tim,

Sorry to hear about your wife's situation in dealing with her citizenship case. It's good that she passed the civics test, but it's unfortunately that she and you have to deal with extra scrutiny and questioning about your marriage/relationship, especially more so that you already sent in the joint evidence before proving such, and you both answered their questions truthfully. Personally, I think the IO in your case was just having a bad day, and shouldn't have taken it out on you and your wife. Hopefully your wife gets the decision for her oath soon, despite what happened before during the interviews.

If you haven't heard from them in awhile (maybe a few weeks?), I say give the USCIS a call and/or schedule an infopass appt. to inquire about your case for an oath date and approval. Worse case scenario, your wife applies again 2 years later...but hopefully it doesn't come to such for her!

Odd though, that you would have two interviews, with still no decision being made....

That goes to show that an RFE, interview, etc. can be called at any stage of the immigration game. So be prepared for anything with the USCIS!

This doesn't make any sense. Assuming she came on a K-1, the burden of proof was overcome at both the AOS and the ROC stages. All she has to do now is meet the N-400 conditions, n'est-ce pas?

And what are the N-400 conditions if i may ask? doesnt it require proof of continous marriage and co-habitation with your USC spouse if its based on marriage?
