Registration of US Marriage W/ Brazilian Consulate

Hi -

Trying to register our marriage with my the Brazilan Consulate in Atlanta.

(I'm the USC, Wife is Brazilian)

We have 180 days to register, however they are asking for a Declaração de não casado

The form states -

TO WHOM IT MAY CONCERN

I, (Name) holder of U.S. Passport No. ###########

hereby declare that I have not been married to a Brazilian citizen before

my present marriage to (Name of Brazilian Citizen)

City and Date

Signature

THIS DOCUMENT MUST BE NOTARIZED BY A NOTARY PUBLIC AND CERTIFIED BY THE COUNTY CLERK.

No problem getting a Notary Stamp, however my County Clerk (we only have one)

is refusing to Certify it. Understandably so, how would she know how many Brazilians I've married! :rofl:

Has anyone run up against this, any as the Atlanta Consulate is suggesting I find

another County Clerk. Who in their right mind would Certify this?? :bonk:

Yes -

That's the form I have.

I've emailed the Atlanta Consulate explaining the County Clerk is refusing to certify it.

They are responding that they will not accept it without Certification, suggesting

that I find another Notary and someone else to Certify it.

I have several notaries in down, however there is only one County Clerk in my small County. :(

Timeline

You do not have to get it certified only by the County Clerk. Any Notary can notarize your signature. The Notary's job is to swear that the signature made befroe them is yours. They are not swearing that all the info in the document or statement is true! They won't be trying to determine if you married a Brazilian before.

We did this here in Houston and it was no problem. We took our marriage certificate to the Brazilian Consulate. They translated and notarized the document for us. Next, we took it with us to Brazil to a Cartario. They entered the information into the official records. Eventually, they gave us a Brazilian marrriage certificate to match the US marriage certificate. You are now officially married in both countries. We did not have this issue of proving that we were never married to another Brazilian. Think you just landed in front of a trainee!

Try this:

1. Get the affidavit notarized.

2. Have the county clerk certify the notary stamp.

Here in Washington state, I got affidavits notarized for Peru and had the Secretary of State's office "certify" the notary stamp (secretary of state will also know whether Brazil was the certification (like Peru does) or an apostille (like Colombia does). It will also depend on who the notaries are licensed by in Georgia. In WA they are licensed by the state, so I wouldn't even involve the county. Try that and see if the consulate will accept.

Keep in mind that I know nothing about Brazil and am basing my answer on my experience with Colombia and Peru.

So you didn't get any certification other than the notary stamp?

I'm asking before I fire off another email to the Atlanta Consulate, trying to keep this from escalating

into a Pi$$ing contest which I'm sure to lose ^_^

If anyone has gotten a County Clerk Certification did they just "Certify" the notary?

I didn't specifically have to get a "certificate of singleness," even though Peru also requires this document. The reasoning in the municipality where we got married was that I was divorced, so I was not considered single. This turned out to be lucky as we in the US have a "divorce certificate" issued by the county :) My experience was with other affidavits. Advice that I read of others who needed to certify their singleness was to sign an affidavit and notarize it. I know that the Peruvian consulate requires further certification for the notary stamp, which as I pointed out is done by the secretary of state here in WA. The other affs I did were done this way and the consulate legalized/certified them without issue. But I would call the consulate and check to see if this is what they really want from you. So in direct answer to your question to me: I needed the notary stamp, followed by the secretary of state of the state of Washington certifying the notary. That made them happy. (Of course the municipality in Peru wanted the consular legalization of the secretary of state, followed by the Ministry of Foreign Relations certification of the consular legalization, but I am not sure if you have to go that far). The process was similar in Colombia.

If they are being this resistant, have you ever considered that they are simply trying to get you to be a little nicer to them ;)

Hi there.

My husband (USC) and I (Brazilian) got married in 2007 in New York. I remember I looked at the Brazilian Consulate in NY requirements to register the marriage. They required the "long marriage certificate". I don't know if in Georgia you have same thing, a short and a long certificate. It is not "long', but in fact it has more information but it looks about the same. Once we got the certificate, I had to go to 2 different places in the city to get it stamped (notary public) and then certified by County Clerk.

As someone already said, I think the county clerk will certify the signature of the public notary.

My husband also had to write a "letter" stating he was not married before, but it was only notarized, didn't go through county clerk (meaning, he signed the letter in front of a public notary. The public notary doesn't care what is written, but it confirms you are the person who you say in the letter).

The Brazilian Consulate will issue you a Brazilian marriage certificate in Portuguese. I took that to Brazil and registered our marriage at a "Cartório".

sorry, one more thing. They required (at least in NY) my birth certificate issued in the last 6 months. So I had my mom go to the "cartorio" where I have my birth certificate registered, got a new copy and mailed it to me. Just keep it in mind, your wife may need to get one as well.

Thanks for the clarification about the County Clerk certifying the Notary stamp, not the number of

Brazilians I married!

I'll go back to my County Clerk and ask for she certify the stamp.

Wish the form was more explicit and it would have been helpful if the Consulate had

explained that after I explained my difficulty with them!

At least that's what happened in my case in NY. I know the Brazilian consulate have some variations. But in my case, the clerk certified the stamp of the notary on my marriage certificate. Maybe the Consulate in Atlanta is asking different. But try to ask the clerk to only certify the stamp of the public notary.

And have your affidavit saying you were not married signed in front of the public notary.

Good luck, and let us know if they accepted it. In the worst case, you go to NY for a getaway weekend and do everything at the Consulate there :-)

No such Luck - If I could I would visit the Miami Consulate as I lived in South Florida for 20 years

and go back there from time to time.

Mississippi has been transferred to the jurisdiction of Atlanta, so I must go there.

Just returned from another trip to my Country Courthouse -

The Country Clerk is still refusing to Certify my Notary stamp, stating there is

no procedure in Mississippi for that.

Hopefully someone from the New Orleans or Atlanta area is reading this and had successfully done it there.

New Orleans is 50 miles away or I would stop by somewhere in Atlanta before going to

the Brazilian Consulate.

Sorry to hear that. It's unbelievable. And I thought Brazil was bureaucratic.

I am not sure if that helps, but maybe you can send an email to other Brazilian Consulates explaining your situation (the ones that don't require your affidavit of not-married before certified by a county clerk). Maybe they can help with your case at your local Brazilian Consulate (like waiving this county clerk deal).

Timeline
Just returned from another trip to my Country Courthouse -

The Country Clerk is still refusing to Certify my Notary stamp, stating there is

no procedure in Mississippi for that.

Hopefully someone from the New Orleans or Atlanta area is reading this and had successfully done it there.

New Orleans is 50 miles away or I would stop by somewhere in Atlanta before going to

the Brazilian Consulate.

Instead of the county clerk, contact your secretary of state. This would appear to be exactly what you need:
