Missouri driver's license K1 visa

Hi all,

I was assuming that my fiance would be able to get his driver's license here in Missouri when he arrives based on the dmv's website, which states it is allowed on a K1 visa: http://dor.mo.gov/mvdl/drivers/idrequirements.pdf He currently does not have a license in the Netherlands, but has taken driving courses, so would be applying for a new license.

However, in doing some online searching I found someone on here and also someone on another site who stated that even though it is supposed to be possible, their local DMV would not issue a permit/license in Missouri until they had their green card.

Can anyone comment on their experiences in Missouri???? Was anyone able to get their license on the K1 as you are supposed to?

The DMV link provided says two things (in relationship to your case) - the valid I-94 can be used but if the DL will expire when the I-94 does (so a 90-day driver's license; which they may not issue at all).

Or he will need either the PR/Green Card or the I-551 stamped in his passport. This is common now in most states although probably not all (yet anyway).

No direct experience with Missouri but these are fairly common rules now... it is becoming more common to require residency.

Ah, so even if it is technically possible, it might be a catch-22 situation where they don't issue a 90 day driver's license.... that sucks.

Thanks for your help, though. Hopefully someone with Missouri experience will be on here to say for sure.

I am not sure about your state, but in Alabama I had to wait until I had AP, they required me to prove that I was legally allowed to stay in the country for 160 days. Then I could get my learners permit and take my road test.

The link to the document you provide is four years old... The REAL ID act provisions have started to be implemented by all states and this document may be out of date...

I found that link on the current website, so I would hope it would be current, but this IS the DMV we are talking about, so point taken. Ugggghhhh. I am glad I started asking questions before he gets here at least, so it isn't a major disappointment after he is already here.

Ya - it's one of those irritating things - best to get married and file for AOS as soon as possible - to lessen the wait time. If he already had a DL from NL he'd be able to drive on that (in most states anyway) - but as expensive as it probably is to get there, it wouldn't be worth it.

Luckily we aren't planning on waiting too long to get married after he arrives, so that will speed things up. We had discussed him getting his license in The Netherlands first, but he had mentioned that it was really expensive, and since it seemed pretty easy here at first glance, we decided to wait. We might have to revisit the idea of him getting it there first, too, though.

I had a license in Canada before moving to the U.S. It's true, in Missouri, you have to have a GC before you can apply for your license. So, when he gets here, you'll have to get married, file for AOS, then when he gets his GC, go for his license. Because he doesn't have one from his own country, he'll have to take the written test and road test. The written test will get him his learner's permit.

Yes, it's true, in Missouri you need your GC. Sorry!

Thanks for the info Carla. It's frustrating that they state on their website that it is possible with a k1 visa! We may still *try* and see what happens, taking a copy of the webpage with us, but at least we are now prepared for the idea of having to wait. I'm just glad that I live in an area where he can at least walk to shops and restaurants, so he isn't entirely homebound while we are waiting.

Dear Vjs!

I live in MO hold a K1 visa, got married 1 week ago and today I passed the test for DL.

When I went to get my drivers license I was informed that they could not give me one since my I-94 wl expire in 60 days although the website says with a K1 visa we are allowed to have.

Can you tell me the results of yr search about it? Will I have to wait for my GC?

I would be more curious about it's validity... It's only for 90 days?

 

I know I know, will go to the DMV once I get the NOA1 from the AOS....

He can get a Missouri DL after he has applied for AOS ........see the "Applicants for Adjustment of Status" section on this document:  It appears he needs his NOA for AOS and either his passport or his EAD.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Just want to comment on it. I was there today trying to get a driver's license... They didn't care about the NOA1, only if I would get the NOA2 which is basically being approved for the green card. They told me they can't do anything, the only way according to them is i-94 + Passport which  is basically the K1 status and even if i pass the license would expire when my I-94, so I am back to square one.

Hi, we are living in KC and basically experiencing the same thing. They gave my husband a license but the expiration date is at the beginning of September (when his i-94 expires). I was wondering if you’ve gotten anymore info or anything on this?  The DMV website says that for licenses during AOS they need “immigration documentation indicating status and one of the following : employment authorization document i688B or i-766 or a passport” 

 

this makes me think that the NOA would be the immigration documentation indicating status and then you would only need your passport. Of course all of this is fine and dandy, and the DMV can decide what they want. We have found that the gladstone DMV is a lot friendly than the others, so we will most likely go there when we get the NOA
