i-130 help.....IV Application Processing Fees????

aloha,

so i have 2 cases underway, i-129f and i-130. i have received the package requesting me to pay the AOS fee of $70us, and have also received the ds-3032 form. we have completed the ds-3032 form, and i have went on the gov site and have paid online the $70us AOS fee.

the "invoice page" indicates that the $70us AOS fee has been paid, and has a box for me to check and then continue the process. this fee list my name as the "petitioner"

however, on the same "invoice page", below the "Affidavit of Support (AOS) Fees" information, it then indicates;

IV Application Processing Fees

Applicant Name Birth Year Relation Fee Amount Payment Status Select

XXXXXXX, (my wifes name- beneficiary) 1987 PRINCIPAL $400.00 NOT PAID

Total Amount Selected: $ 0.00

and then besides that part it states;

Help Topic: IV Application Processing Fees

Please note that it is NOT necessary to pay the IV Application fee for all applicants; however, if the IV Application fee is not paid for the principal applicant, the NVC cannot complete processing this case.

do i need to pay this part? do i proceed without paying?

i am at a complete roadblock here - can anyone help me?

SORRY FOR THE CONFUSION - after my wife made it to the USA, family emergency neccesatated her immediate return to her home in cambodia. unfortunately before she was able to adjust her status, thus the case was abandanded. we now are filing both k-3 (married in usa) and have petioned both i-129f and 1-130 .....so, our "journey" has once again began. thank you for all your help and understanding - appleegg and sreyon.

After you send DS-3032 form, NVC will process it and generate IV bill and send it to you via mail/email. That is when you pay IV bill ($400). For now, you can complete the Affidavit of Support (AOS) package and send it with AOS bill document cover sheet when you're ready. You should have option to print "Document Cover Sheet" on the page where you paid the AOS bill.

I am confused your profile shows K-1, this has no IV fee at NVC. http://www.visajourney.com/forums/index.ph...rCP&CODE=01

If you paid the $70 you may as well pay the $400 for a CR-1 visa. If you prepare your documents for the DS-230 packet, more than likely you can get the CR-1 visa petition to the consulate at the time of a K-3 interview, this will save you at least $800 in adjustment of status fees. Compare timelines CR-1 is lately taking the same time to process as K-3.

THE CR-1 has the big benefit of cost savings, and GREEN-CARD on entry to the USA.

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

Adjustment Of Status: $1010 I-485

NVC Visa fee: $400 ($355+$45)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

Keep this in mind in this economy, the CR-1 with it's instant green-card looks very attractive considering the cost savings, and the ability of the immigrant being able to take a job shortly after entry to the USA. K-3 has the down-side of added cost, and NOT being able to legitimately take a job until they have EAD or green-card, EAD can take 90 days or longer to get.
