I-407 Abandonment of Status - too late to file?

Timeline

Hi all if you have read my previous posts here is the problem that I am dealing with at the moment.

- I have an expired GreenCard

- I want to go to the USA for 4 weeks in November using the Visa Waiver

- I do not wish to have a GreenCard anymore and dont mind if I dont have the chance to renew it

- Is it worth me filing a I-407 Abandoment of Status form? Or is this purely for someone who's GreenCard hasnt expired?

I just want everything to run smoothly for my trip

Even though you already lost your status as permanent resident, you must use the Form I-407 to abandon your status formally as lawful permanent residents. There is no such form on USCIS so you can download the form at US embassy or consulate web site.

Form I-407 must be sign in person before an Immigration Officer. In addition, you need to bring all U.S. immigration documents that previously issued to you, i.e. Green Card, re-entry permit (if any) and passports containing U.S. immigration stamps.

You should keep a copy of the completed I-407 in your passport whenever you travel to the United States.

Once the process of I-407 completed, you will back to your previous status as a non-immigrant and may apply for visa into the US like other people. In addition, abandoning your permanent resident status will not affect your ability to apply for immigrate in the future to the US but it will be very new process.

<not pursuing I-129F petition further but NVC forwarded case to Consulate on 02/24/2009>

NVC Journey:

02/19/2009: NVC Received/Case number assigned for I-130

02/20/2009: DS-3032 sent by e-mail and 03/04/2009: DS-3032 sent by regular mail

02/26/2009: NVC received DS-3032 Choice of Agent selection

02/26/2009: DS-3032 accepted and AOS Bill Generated but not IV Bill

02/28/2009: AOS Bill Package received in mail

02/28/2009: Paid AOS Bill and IV Bill (as it was available) online

03/03/2009: Both AOS and IV Bill Show as Paid and Coversheet Printed

03/04/2009: Mailed I-864 and IV (DS-230) Packages

03/06/2009: I-864 and IV Packages Received by NVC and Scanned on 03/10/2009

03/13/2009: Case completed at NVC (in 17 working days from date NVC Received)

03/25/2009: Interview date assigned by NVC

US Consulate @ Mumbai, India

04/02/2009: Medical Exam (based on NVC e-mail for interview)

04/13/2009: Interview Packet Received from US Consulate

04/16/2009: Documents submitted at VFS office

[Classified]: Date of Interview

USA Journey

02/21/2009: Permanent Resident # Received (Ref: NOA2 of USCIS)

05/2009: POE

##/##/2009: Permanent Resident Card

##/##/2009: SSN

So ... I should download the form of the Australian Consulate website. Do I need an appointment to go to the consulate to get it signed like I did with my divorce papers?

Thing is I only have my GreenCard and my Social Security (if I can find it). I also may have a copy of my divorce papers. I dont have a USA passport or anything like that. So do I have to make an InfoPass apointment to get all of this confirmed?

are you in the U.S. or Australia???....when you do fill out the I-407 at the same time apply for a tourist visa at the consulate because im pretty sure that you can't use the VWP now.

Oct 29th 2004 -Met online
Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.
