Expedite, Pregnant Fiance W/Health Concern, Congressman Help

I've asked a few questions here, and you all are sooooooo helpful!

I'm applying for a K1 visa from VSC and received my NOA1 on September 4th at which point my fiance was 2 months pregnant. I was told that USCIS does not speed up the visa process based on pregnancy (doesn't this seem absurd? - with all respect to everyone's cases out there, I'm sure most would agree that this circumstance should be considered for expedition). I hate to give a sob story here, but my fiance is in a bad living situation - she recently lost her job and health insurance and is living in a room with three other women, a shared bathroom and limited kitchen facilities, and above all there is mold in the apartment and bathroom. I talked with my congressman's office and they tried to help, but they told me VSC rejected the request.

Last week, my fiance got very sick with a fever of 103. She went to a doctor (we're obviously paying for all doctor's visits out of pocket) who confirmed and wrote a letter stating that she was 17 weeks pregnant and her living situation was causing "allergic crisis" and was "impossible in her state of pregnancy." One high-up person at my congressman's office was very nice and when we got turned down for the expedite request he told me that he would keep thinking if there was another way to help. I just wrote him again, and explained about my fiance getting sick and that I now have a doctor's letter confirming the unhealthiness of her living situation for the pregnancy and photos of the mold. The first time around, we sent in no evidence which confuses me (do congressmen just call up and ask for an expedite? They never sent me any paperwork and just asked me to write up a brief outline of the situation). To add insult to injury, the place my fiance lives is supposed to be for single women with no children and I'm concerned with what will happen if she doesn't get here before the birth. In order to get here, she will need to be on a plane by the end of February.

So, my wonderfully helpful VJers, any thoughts on if an expedite is possible, how to best organize the paperwork, how to best stay on top of/help out my congressman in an expedition request, etc., would be great. Also, is there any danger in requesting again? Will the people at VSC see my name again, find me annoying and through my case to the bottom of the pile?!?!?!

To end on a more positive note, my fiance and I couldn't be more thrilled about the pregnancy and many years together as a family!

I'm sorry that you are caught in that situation and that your fiancee is sick, but there are ways so plan and time a pregnancy. sure, there are "accidents" and stuff, but ---------

USCIS knows that if they would allow expedited service for pregnancies, 80% of us would get pregnant. (At least I would have considered ).

Right, take care of your fiance the best you can. Trying to expedite on this basis will just be a waste of time.

Why haven't you provided the means to improve her living situation?

Once you get to the embassy stage, you may be able to convince them to hurry things along. I guess lately congressmen have been useful at this stage in helping to move along. I highly doubt that USCIS will care. You can always try but you most likely won't get anywhere. Best advice? Help your fiance move somewhere safe for her and your baby.

As per the previous posters, no, not for K1. However, I believe that it is possible to request an expedite when applying for a CR1. Happy to stand corrected by VJers experienced in the K3/CR1 domain, and this of course would also mean you marrying her, withdrawing your K1 and reapplying.

my partner is sick but it doesn't mean that this process can be sped up. you have wait like everyone else, sadly.

Pregnacy is an avoidable medical situation. From the living conditions you describe she has better conditions than a lot of regular people in many countries. Many live without hot water or even running water. It looks like you will have to find a way to support you child and fience before she arrives here.

Pregnancy is no reason for an expedite. As far as her living conditions being so bad, the USCIS will not consider that either coz that is something that can be changed/improved without her having to come here.

I wish it was possible for both of you because it sucks to be away from each other and specially when she is not well too but try to get her a better place to stay till she's there and also tell her that next time she needs to go to the doctor as soon as the temprature hits 101 (anything above can be fatal or cause serious damage to the baby) and get in the shower and get her body temprature down.

i read everything about your situation n especially ur fiance..we do have the same problem thats why i really understand everything ur encountering,my fiance applied for our k1 last oct 2 n we are both worried because i am pregnant too like ur fiance n my due date will be on march so we are really worried how will get there in US with him before i give birth cause i believe the processing time is 6months or more,i post a lot of question for the other members so they can help me but they replied the same answer that you receive..so i think the best thing that we can do now is to always pray and i promise once we got an answer about our situation i will send u a msg..God bless.

Why dont you provide for your fiance and get her a better place to live. Surely you send her support? You cant rent her a place there that is safer? With your baby at stake, that seems to be the proper course, and something that can be done within a week or less.

nothing personal, but try paying all the medical expenses for a pregnant wife here in the USA "out of pocket".

i have to agree with a previous poster if pregnancy was a good enough reason for expedite then there would be thousands of pregnant women, i personally have no intentions of getting pregnant just yet we want to wait until life settles back down after this visa ordeal.

However if this meant i could be with my fiance quicker, i would have been pregnant a couple of years ago!!!!

I'm sorry about your situation. You must be very worried about your Fiance. Like others said, expedition for pregnancy would cause a whole lot of problems if they made it a reason to push through applications. And i have seen many on this site have to bring up babies initially without their partners because of unplanned pregnancy.

But accidents do happen, and I hope that you can get your Fiance to you as quickly as possible so that you can be together.

Like others have said, there are courses of action you could take to ensure her health and well being while remaining in her country. But other than that, im not sure there is anything else you can do if your representative cant make a difference.

I think your going to have to ride it out and take steps to assist your fiance. I dont think people here are meaning to come across as confrontational about your situation. But i guess everyone has their own reasons for wanting to "expedite" the process and be with their loved ones.

Here is a sample of what a standard congressional or senate inquiry/release looks like. If you could have provided the doctors statement along with photographic proof with the initial inquiry you would have stood a much better chance for a medical expedite approval. Best of luck and I pray your fiance and baby will be OK.

Everybody give this guy a break. Maybe he is having extreme financial problems that he wasn't experiencing when he filed the petition. You don't know his personal situation so don't judge him. Reading his post he is having enough problems to deal with without all of you making him feel worse! This site is supposed to be for support Jesus Christ!
