I talked to an attorney today. She told me that the case could have gone either way given the reasons for staying. She said sometimes it just depends on the person who adjudicates the case.

Bottom line is that the 10 year visa she has now is dead. She will need to apply again in a year or two. When she does apply, she should be able to get one again as long as she shows the consular officer the I-539 file and can show she left as soon as possible once she received the denial letter.

07/17/2009 Interview Denver USCIS office RECOMMENDED FOR APPROVAL

08/28/2009 Naturalization Ceremony - US District Court - Denver, Colorado[/b][/u]

09/04/2009 Applied for passport

09/22/2009 Passport approved and mailed

09/24/2009 Passport received

08/26/2009 Naturalization Certificate and Name Change Petition arrive back from State Department
