double registration of NSO birth ceritificate

Hi guys, i just want to ask if there is anybody here who have same situation as me.. i have double registration on my NSO birth certificate. I did not know this unitil i went back to NSO yesterday May 30, 2008. They told me i have 2 registrations, first was under my fathers name and second was under my mother's name. i did not know that i was registered first under my father's family name (my father filed this registartion last 1988). my second registration was under my mother's family name last 1996, which is the name i use since i was a kid until now. my parents were separated and i was brought up by my grandparents (mother side). i had not seen my father ever since and had no communication with him. I was asking the NSO office for a copy of my birth certificate and a cenomar yet they gave me my first registration under my father's family name, last year i was able to get a copy of my second registartion (birth certificate under my mother's name). Now, They blocked my second registration because they are strict already on their policy that "first registration would be the one honored", unless my first registration would be cancelled. The NSO office told me to file a petition to cancel my first registration of birth certificate. My problem is,the petition was on process but my US Embassy interview would be on JUNE 18, 2008 already, and the petition for cancellation may take 2 months. As of now i cant get my CENOMAR. what i have now to present is just an affidavit that tells that my petition for cancellation of my first regitsrtion of birth certificate is already on process. I need your advise guys.. would it be okay to continue my interview this JUNE 18? who had experienced such situation like this.

So, you mean to say the name in the petition was the name in your mother's name and lately when you requested for BC, NSO gave you the first registration which is under your father's name and already blocked the second registration which you are using ever since?

What i understand, is that the Embassy will send request for verification to NSO, based on the name that you have submitted to them which is your name under your "mother's name."

For me in my opinion, I think it is better to re-sched the interview and first step to do is you to fix first your record at NSO before Embassy can do their background check to your birth record name.( i am not suggesting you to do this, but if i am in your situation this is what i will do.)

Good luck, i hope there is a better way. Let's hear others opinion and advise.

yes.. all my documents including k1 petition was under my mother's family name.. im using that name since i was a kid. regarding US embassy interview, my fiance wanted to continue the interview, he'll be with me during the interview. he's thinking that this kind of case is very common in the US embassy and might not affect visa approval. (what do you guys think about this?) we filed a petition already to cancel the first registration of my birth certificate, its still on process and may take 2 months. do you think they would just approve my visa and just give me a white slip? im so worried, dont know what to do.

We had the same problem but at that time delbros wasn't doing document checks with the NSO. My wifes father apparently registered a new birth certificate with the wrong date of birth and birth town. We didn't know this until she went to get copies of her birth certificate and after we filed the papers. NSO deleted the original certificate and refused to give it to her. My wife had to fly to her province, hire a lawyer and petition the court to correct the birth certificate. This was not completed by the time she had her interview, it kept getting postponed, luckily she had the original birth certificate and wasn't placed in AR and was given her visa. The delay was because the judge wanted her mother there. If you have to go this route make sure you bring your mother andn other family members to court,,, good luck.

Anyhow, it is what it is and if I were in your shoes I will go on with the interview because it is already there.I have not heard or read of somebody who rescheduled her interview so I am not sure how long will it take for the second interview schedule if you decide to postpone it. Plus , your fiance will be with you, I am very sure that will matter in your case.

When I was interviewed they didn't ask me for a CENOMAR but I gave it voluntarily. I understand the USEM has a direct link with the NSO system and they can check your status anytime. The same thing may or may not happen to you. If the pre-screener will ask for your CENOMAR just explain your situation and give all the documents to support your case. If I were you, aside from the affidavit ,also get a cetification from the NSO that your first registration is being cancelled and pending in their office. If the petition for cancellation is different from the affidavit get a copy too so you can present it during the interview. The good thing is that all your papers ( except for that first registration) is in your mother's name and you have been using the same since childhood.

The worst thing that can happen is a long time in the document verification stage but at least the interview is done .Once your petition in the NSO will be finalized and your first registration cancelled, you should be good to go. It will just be a matter of time.

Maybe you can talk to the head of the NSO and ask what more can be done to expedite the cancellation so it can be resolved before your interview date.

I hope there is somebody here in the same situation ( double registration) who already passed the interview so she can tell you what is the best thing to do.

Goodluck and everything will work out just fine. If you decide to postpone your interview, goodluck on that too.
