I called USCIS with my expedite request (IF you recall from another thread my father has terminal lung cancer and is at stage 4 out of 5) They took my information and told me someone would get back to me within 45 days!! :blink:

bgreed, have you received a reply yet ? Could they have said 4 to 5 days, which is what they told me. 45 days for an expedite is not quite right for them to respond.

I got a reply yesterday. Expedite denied petition will be processed in standard time period.

However I'm not going to let that stop me as I have already contacted my father physician and he is sending me a letter on my fathers condition. I fully intend to do as Sarah suggested up thread and see what happens. I really think they need to realize that I won't just go away in this situation. As my wife and I have a six month old who may never see his grandfather unless I can find a wayt o keep up the preassure for an approval.

Denying you when you applied on the grounds of having a parent with terminal cancer is quite disgusting!

Now it's time to go in 'all guns ablazing' with this ..... put together a tight package, showing the importance of time to this case ..... always go with the worst outcome.

Get as much medical documentation you can ..... get some horrible stuff off Google too and print it .....

And do it via a Senator/Congressman ....

I am going to cry. I called my Senators office to find out why my petition was sent to Cincinnati and she told me that she contacted that office and they told her that since my husband is not in the US, that there is no need to conduct the interview, so once my file is received in Cincinnati, they will send it right back to California. So I requested an expedite and now it is taking at least another month before my case is right back where it was. I called USCIS and told them that is was their error and she told me there was nothing she could do. So I am royally screwed and there is nothing I can do about it.

I-130 Timeline:

12-11-2007- Married my Love

02-08-2008- CSC receives I-130

02-11-2008- Received Hardcopy NOA1

08-14-2008- Approved!!! 216 days...

08-21-2008- NOA2 Hardcopy received

08-27-2008- NVC Receives file, NVC Case Number issued

09-05-2008- AOS Fee Bill and DS-3032 Generated

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

09-15-2008- Mailed Hardcopy of DS-3032

09-16-2008- Paid $70 AOS fee online

09-17-2008- Received E-mail confirming the DS-3032 Agent

I am so sorry that this happened to you but keep up in prayer and faith and God will makes sure your petition lands right back where it needs to. Who knows you may end up ahead!

No way I'm giving up just getting fired up for the next salvo. My dad is going to get to meet my wife and see those big blue eyes and hold him in his arms.

Send them a nice wad of documents .... pictures .... newspaper clippings ..... stuff on how your Husband is living (Google is your friend) .... court papers ..... and that letter from your lawyer stating you need an expedite.

Totally upset here that they can belittle your situation ..... I hope they like the wonderful set of documents they'll be getting :bonk: ..... don't forget some horrid pictures if you can find some on Google .... then whoever turned your expedite down before ..... can look at those ..... and think again before playing God!

Do get the doctor to stress just how important the expedite is!!!! .... in the strongest of ways.

I'm thinking of all of you guys!!!! ..... I pray for all your happy faces to return (F)

I have already requested an expedite with all required documentation. The response to that was to send it to the local office. I have NO idea ####### is going on and I cannot get anyone to tell me. The woman from the Senators office told me there was nothing that we can do until at least 3 weeks from now. And that is to make sure it got back to CSC. I appreciate your good thoughts, I am just feeling very bitter right now. I should have left it alone and I would be getting approved soon, but now I have pushed myself out another month.

Nicole, they really screwed up, but it really shouldn't take another 3 weeks.

We had a Congressman like your Senator .... they're still sitting on our paperwork even now .... they told us they couldn't do anything and we had to send it to VSC .... load of BS .... we'd sent it to a Senator too at the same time (I planned to blanket all of them) ..... and it was gotten onto immediately.

Your Senator will be able to find out exactly where your file is as it's barcoded.

As not all Senators are alike ... I would try the other Senator .... and also your Congressmen .... what's confusing, is what on earth gave them the impression your Husband was in the US to begin with ?????

And, they did actually get onto 'something' quite quickly .... a pretty good sign .... it'll probably be adjudicated when it gets back to CSC quickly.

Thank you Sarah for the support! It means a lot! :dancing: I am going to try and call the other Senator on Monday. I work at a bank, so yesterday was really busy and did not leave me much time to call all the people I wanted to. (Yes I know, I am misusing work time) hehehe My coworkers know my situation so they understand if I need to take 30 minutes to call someone. I really hope something gets done quickly. It seems to undermine the whole reason for an expedite.

June 10, 2008 - Filed I-130 at the Perth Consulate

June 23, 2008 - Made a follow up email enquiry, was told "petition will not be approved until a background check is performed on you and you have cleared that process under the Adam Walsh Act."

July 3, 2008 - Received communication that husband's Adam Walsh clearance request was sent on June 23, 2008.

July 3, 2008 - Received PACKET 3 on email!!! soon after previous email.

July 9, 2008 - Saw GP for a varicella shot. Will need to get the 2nd dose after 4 weeks.

July 14, 2008 - Medical appointment.

July 20, 2008 - Fingerprints taken (finally!)

July 21, 2008 - Sent application for Australian name and fingerprint check.

July 22, 2008 - Sent DS-230 Parts I & II .

Aug 5, 2008 - Sent DS-2001 and supporting documents (minus Aus Police clearance)

Aug 11, 2008 - Received Australian Police Clearance

Aug 14, 2008 - Received PACKET 4!

Aug 26, 2008 - Visa Interview... VISA APPROVED!!!

Here's what we did in contacting the Senator's office in a little more detail:

USC Husband called the Senator's office .... spoke to the immigration team at the state Senator's office .... explained we needed help with our expedite thru USCIS ..... they emailed a release form (immediately) for The Privacy Act 1974, and we faxed that and our package to them ..... my USC Husband drew up a cover letter (for the package) basically stating that he was a resident of that state and requiring help ..... explaining when we sent our file to USCIS ..... the case number etc ..... then stated which expedite criteria we were applying under ... and an outline of each of the situations under the criteria ..... they were listed very clearly ..... the letter was catchy, to the point, not emotional, very factual, and wiggle room free ..... then thanked the Senator at the end for his help on this matter and said that it would be an unforgetable act for our family.

The Senator's office then called my Husband and said he'd hear from them soon ..... we sent our stuff on a Friday.

Monday afternoon, there was an email from the Senator's office with a very brief one line email from Vermont attached .... expedite approved.

Dear Kipa&Sarah, I am happy for you guys!! My husband sent expedite letter to the USCIS a week ago but until now he has not yet receive any response from them, he also sent email to their senator 5 days ago and phoned them after but the lady in that office said they are receiving about 100 mails everyday and that they cannot attend all those mails overnight, and told him to just wait until they reach his. Wondering... how long do we have to wait again for the senator to respond. Oh, he forgot to give our case no. but gave his email add and our visa application number telephone, and other personal info, is that ok?

I believe we fall under the finanical hardship criteria. Will read more on the link provided....

However, I'm not clear -- I see people saying they called USCIS first -- just to tell them? Then put together a package with letter explaining circumstances? How does one nicely ask a senator/congressperson?
