DMV can't verify my status in S.A.V.E.

My EAD was approved April 28, received the card May 5. I went to DMV yesterday to get a permit but they couldn't give me one because they said my new status (EAD) not showing up in S.A.V.E.

Has anyone been in this situation? How long does it take for USCIS update their database? (Assuming that that is the problem).

I'm currently using my foreign driver's license but it will no longer be valid in 3 weeks that's why I really need the permit soon.

Thanks!

hello Sen,

It happened to me too only that I used my GC. What we did was make an infopass to USCIS and they checked my profile in their computer and asked me of my marriage certificate and GC. It took a week for the changes. I went back to DMV and got my permit.

Hope this help.

Was your GC in your maiden or married name?

I hope I don't need to go to a USCIS office, the nearest in ND is in Minnessota and it's a 10hr drive just to go there another 10hr to go back.

My GC is in my married name. In their SAVE it was still my maiden name. And we were advise to call USCIS but as usual costumer service can not help helped so we have infopass.

Thanks Riza, I'll try calling costumer service first. If that didn't work, I guess I have no option but to go for an info pass too.

Having your EAD application approved does not give you a new status. Maybe this is where the confusion is coming from? As your AoS has not yet been approved you're still "Pending Decision of US Attorney General" which is what you became when you sent off your I-485 and I-765. Your status wont change until you are approved or denied AoS.

Now I'm confused.......

If SAVE doesn't change my status as "work authorized" when I received my EAD... then how can my employer be sure that I'm legal to work. I can show him my EAD card but how can they verify its authenticity without verifying with the USCIS database? Also, then why is that DMV guy trying to retrieve my data in S.A.V.E?

Or... maybe "status" is not the right term. All i want is my name to show up in the database as work authorized...

Sorry, I didn't mean to confuse you.

By status I thought you meant your immigration status. When you are approved for an EAD, SAVE will indeed show that you are now work authorized.

Why the DMV is not seeing the updated information, I don't know. The information should be there by now. I am not sure why the DMV is using SAVE to assess your eligibility for a drivers license. DMV rules vary by state.

In terms of an employer checking if you're legal to work, not all companies do a verification check against SAVE. It costs to use it, and many simply don't. There is no requirement to do checks against SAVE, only for the company to be satisfied with the documents presented which prove eligibility. If a company is happy with how your EAD looks and records all the relevant data on the I-9. then that is all that is required.
