Learner's Permit Expiration Date (NYS Resident)

Friends --

My learner's permit exprires May 22 (the date on my I-94.) I still may but not sure if I'll be ready to take a road test before this date. Does anybody know how it works really? Can I renew the permit by showing the NOA for my AOS, or I'll have to wait before I get my EAD or greencard? Or, even if I've taken and passed the road test before May 22, what would be an expiration date on the driver's license???

Tomorrorw, I am planning to go to my local DMV to ask this question (they were very friendly and knowledable there when I was aplyingg for my learner's permit) but, not willing to make things worse which happens here or there if we ask wrong questions or wrong people, I'd like to hear your experiences about this process. I'm sure it differes from state to state but any advice will be appreciated. Thank you :) .

If NYS is like MN, no you cannot.... Also, if you do pass the test.. in all likelyhood your DL will exire with your I-94 as well

Not much you can do until you have EAD or Green-card, NYS wont issue a driver's license unless you provide evidence of lawful presence in the state, that is a Valid I-94, Valid EAD, or green-card.

If you were to test and pass the road test the driver's license issued will expire when your I-94 expires, unless you have EAD or Green-Card by that time.

We did not bother with my wife's learners permit until she had green-card.

I got my permit 3 weeks ago, but couldn't schedule road test as there were no places. So, I am having my road test this Friday and my I-94 is already expired.

Look at your permit, it should indicate when it expires.

Look at your permit, it should indicate when it expires.

Every state is different with regards to driving permissions, some are more strict about residency than others.

Thanks. Yeah, right, it says it is good for 1 year since the issue date. I will see how long my license will be valid if I pass the road test. :unsure:

What I don't understand is why it has both, first --

That sucks though. I was looking forward to getting some independence from my husband :D . Why they won't at least let us use a learner's permit til we are eligible to take a road test after EAD/GC recieved??

Expires means the permit expires June 2012, but the notation about temp visitor indicates that permit is only valid as proof of residence until May 22. So yes you can continue to use permit until road test, but it is doubtful that the state will issue a driver's license unless you have additional proof of legal presence like EAD or Green-card.

OMG!!! Everytime I was complaining about immigration process- too long, to expensive etc... but now I realized how lucky I am living in Florida, as I got my learner's permit valid for 1 year + I took my driving test with my AOS NOA!!! and again DMV issued my driving license valid for 1 year + with my married name + only with AOS NOA... I need to stop complaining... :)

Oh well, I think it's just what it is. I've never really complained about anything because our process has been very smooth, so far. It's really the first time where I'm kinda dissapointed. I'll go to my DMV tomorrow and check with them. I do hope that I'll be able to at least drive with my permit for a while before I get my license. It sucks though!

And yes, I went to my local DMV to clarify all this and was told that I, indeed, cannot use my permit beyond the I-94 expiration date because I, technically, am not supposed to be in a country past that date. She also confirmed that, as soon as my EAD arrives, I can resume my driving; I'd have let the DMV know about my updated status. I just regret I didn't think about all these beforehand (my mistake, of course); then, we'd have filed our AOS sooner and, if lucky, I'd have a shorter gap between I-94 expiration date and EAD arrival. Now, hopefully, I'll get my EAD some time in mid/late June (AOS filed April 16.) Damn rules :rolleyes: !!!

No, it doesn't have to be an instructor, you can learn driving with your hubby next to you. Just you always have to carry your learner's permit while driving a car.
