  1. Hello! My spouse is Ukrainian and our case is currently with the NVC. I just received the following email: "The National Visa Center (NVC) changed the eventual immigrant visa interview location for [my spouse] from FRANKFURT, GER to KYIV, UKR. Please refer to your new case number below." Has anyone else received a similar email? I can't find anything else online stating that the Kyiv embassy is back doing visa interviews.
  2. Greetings everyone! I would appreciate your advice/thoughts on the following issue. TL;TR: should a Ukrainian with J1 status extension attempt to stamp it abroad? I'm a Ukrainian who is on J1 as a research scholar at a large US academic clinic since mid-March 2022. I got my J1 a month before the war started last year in Kyiv, Ukraine. I recently got my program extended for another year to finish my project. I received my DS-2019 last week, which I know allows me to stay in the US for my next year at the clinic. I have a couple of important international conferences coming up next year, attending which would really advance my career prospects (I really want to attend them). In addition, part of my family relocated to Canada. Therefore, I would very much like to be able to travel and re-enter the US and was initially intending to stamp the visa. Here are relieving factors: My sponsor is one of the largest clinics in the US; I've been in good standing and did not violate any J1 regulations; I have my parents left in Ukraine, along with some property (car, apartment in a joint ownership, quite a solid sum on Ukrainian bank accounts), which could be use for connection to homeland statement. However, here are the problems: I cannot apply in Ukraine because the US Embassy doesn't process any visas at the moment - I'll need to apply abroad, most likely either Mexico or Canada; Since I apply abroad, 99.9% I will get interviewed; If so, it will be still challenging for me to prove nonimmigration intents since I am (1) from a country affected by war, (2) single and only have my parents left in Ukraine. ... and I also read that if I'm refused the stamp, I will not be able to go back to the US even if I will be traveling from Mexico or Canada and my DS-2019 will be to-date. Another factor, importance of which I struggle to assess, is that I've recently got Canada-Ukraine Authorization for Emergency Travel (CUAET). I applied this summer, when I didn't expect the program extension yet but part of my family had already relocated to Canada. I got a notification that my application has been processed a day after I got my new DS-2019 form. CUAET grants an extended temporary status for Ukrainians (a visitor status first, which one can extend to temporary resident and then to permanent resident under certain conditions). I wonder if it would be considered as a red flag for immigration intents. I know that nobody can predict whether or not I get rejected at the interview. I would like to get your opinion on the situation overall: being in such situation, would you attempt stamping the visa? Are my worries well-grounded or I put way too much weight on some of them? Thank you a lot for getting to the end and even more thank you for your opinion!
  3. I'm a US citizen and my elderly mom is Ukrainian. She finally came to the states to stay with me. She has a 10 year tourist visa from 2016 so she didn't have any need to apply for parole or go a more typical refugee/asylum status. Due to condition in Ukraine and her age she is unlikely to go back. I was wondering what option does she have going forward with living here and adjusting her status. She can't go parole route since she is already here. She can't apply for TPS since she came after 4/11/2022. Is there anything beside just letting her overstay her stay and applying for AOS? While possibly hoping that TPS would be extended?
  4. Hello, I was able to get my wife a tourist visa shortly after the war started in Ukraine ( she's Ukrainian) and when we entered the Port of Entry the officer said we had 6 months to figure out her paperwork to adjust her status. Well I spoke with a lawyer who will proofread all our documents but I haven't been able to pay yet and start the process so she can have work permission and travel authorization. My question is, we have been taking trips flying within usa during this time and she uses passport as I.D. , can she still travel within USA on an expired Visa? Does Tsa look into that and call immigrations or can we still fly before we submit paperwork to adjust status??
  5. My Ukrainian fiancee has been trapped in Russian-occupied territory since the invasion began in February. She has the possibility to escape the "Lugansk Peoples Republic", travel across southern Russia to Georgia. She was nearly ready for her interview at the Kyiv embassy in December. She was only missing her birth certificate and police report. She was waiting at her mother's house in Russian-occupied Lugansk while waiting for her new birth certificate, which would be produced in nearby Severodonetsk. She was ready to pick it up, when the borders closed and the invasion began. If she can go to Tbilisi, we will have the option of transferring her case to the Tbilisi embassy or to the Frankfurt Germany embassy. Apparently, the Kyiv visa responsibilities were transferred to Frankfurt because the Kyiv embassy is not processing any visas. Now she does not have any of her documents except her passport. I am sure that, wherever we transfer case, we will have to pay a new fee for the DS-160 and she will need a new doctor's report. The Frankfurt embassy responded to an inquiry from my senator saying that we can choose to transfer the case to the embassy of our choice. I called the Tbilisi interview scheduler and they did not seem very friendly or helpful. Does anyone know if one of these embassies is a better choice than the other? Is one more accepting of the special circumstances of the war? (Not having a birth certificate or police report)
  6. Hello everyone. I see a lot topics about delays at Warsaw Embassy. I would like to ask if there are any people who decided to transfer their case from Frankfurt to Warsaw and what are current waiting times for processing K1 visa application at Warsaw Embassy so as waiting times for interview. They received our documents from NVC on May 12th and we are still waiting on instructions letter/email
  7. Can anyone clarify whether a Ukrainian domestic ID/passport is acceptable, or is USCIS only approving forms that list an international passport? Like many others in Ukraine, my intended beneficiary has limited physical access to Ukrainian government resources right now and has only traveled to other countries which didn't require an international passport before the war started. Many European countries have since relaxed this requirement, but I can't find anything about US policy on this in general, or specifically relating to U4U. Secondarily, if the domestic ID/passport is sufficient, how did you handle the expiration date? If not, can anyone offer advice on how she should go about obtaining an international passport under the current circumstances?
  8. Does anyone know how long it takes for the passport to be available for pick up after the interview in Frankfurt? Does anyone have an experience of the interview (Ukrainians seeking an immigrant visa) to share?
  9. I just consulted with a lawyer via justanswer.com on this question and he said the United for Ukraine entry would not have any effect on the I-130 CR-1 and CR-2 that are due to be evaluated by the NVC on June 15th. I did not expect it to cause a problem but I am nearing the end of the I-130 and I'd prefer to be certain. The lawyer did wonder about the effect the I-130 might have on the approval under the United for Ukraine (UFU) program. My goal is to bring my wife and daughter to the USA and to flu them to Frankfurt for the medical and the interview once they are scheduled. We have medicals scheduled for July 5 but I would probably delay both the medical and interview so the entry (on the I-130s) will occur after Nov 20 2022 so they will be IR-1 & IR-2 rather than CR-1 & CR-2. Does anyone here have any thoughts about this plan? 1. Will an application under United for Ukraine have an impact on the I-130? 2. Will a pending I-130 have any impact on the CBP entry with the UFU travel authorization? I don't think there would be a presumption of remaining in the USA since this is a two year stay entry. 3. Will a pending I-130 prevent me from getting the UFU approved? This is the one I worry least about since there is no cost in applying for it. Thanks in advance.
  10. Due to the war in Ukraine, I was able to help my fiancé escape to Mexico while we were waiting for her embassy appointment. We have been in Mexico for almost two monthsk and have to leave after six months. i got notice from USCIS that her petition was approved, but the original embassy was in Kyiv. We want to switch to Mexico because it is not possible to return to Ukraine. I have tried contacting NVC, but the phone number is just a recording that doesn’t accept calls. There is a web form to contact them, but they say it takes at least two months for them to respond. How can I talk yo someone to change the embassy? Also, she left in a hurry and was not able to obtain a police report (the offices were closed due to war). Her birth certificate was at her parents house in a city that is currently under Russian control, so she can’t get that either. Will she be able to get approved without these documents? I read somewhere that she needs an official government document stating why these documents are not available, but it is not possible to get any official documents from Ukraine at this time. Can anyone help?
  11. Hi everyone. I recently left Ukraine through Romania and I'm back in my home country (Nigeria). Unfortunately, due to Russian invasion, our Cr1 case was moved from Kyiv to Frankfurt, Germany. Our case is currently complete and waiting to receive a response concerning interview from the US Embassy in Frankfurt. • Getting a Visa to Germany from Nigeria is currently difficult as there are no available dates for interview. • Transferring the case to Nigeria is not a good choice as there aren't available dates until 2024 • I'm enquiring if it is possible I transfer the case to Ghana where I can travel to Visa-free. My only doubt is if I can attend an interview there or any other Visa-free country in Africa without being a resident. • I'm confused as to what to do and I need your advice here. Thank you!
  12. Some background: I live in USA, and I have one year of college left. My girlfriend lives in Ukraine and is done with university. She speaks English too if that matters. We had planned on getting engaged this summer in Germany and then I would start the normal process for her to come here by filling i-129F for her to get a K-1 fiancé visa. Now given the situation that seems impossible. I'd like to get her out of there as soon as possible, and she wants to also. Is there an easier and faster way to get her here? I am pretty new to this and it's a bit overwhelming so I was hoping someone on here could give a bit of guidance. Thanks
  13. Sharing for those who may not be aware. Getting police certificates for Ukrainian citizens has been a challenge, but the service is now working again! My fam were able to get theirs. Here is the link: https://vytiah.mvs.gov.ua/app/landing
