My partner and I were laid off during 2023, and my partner had to make withdrawals from retirement accounts and other sources, leading to a complex tax situation with penalties. To safeguard my part from being affected by these penalties, we are considering filing taxes separately for the first time during our marriage, and possibly partner won't file this year but I want to properly do it each year as usual. Is filing joint taxes a crucial piece of evidence when applying for naturalization? Would it raise a red flag if our taxes for the last year are filed separately? Your feedback is highly valuable, and I appreciate it. Thank you so much!

Hi there. Hoping for a gut check and guidance from this lovely forum. Husband makes significantly more than the minimum needed for the financial support requirements on the 1-864. However, he hasn’t filled his 2022 taxes yet as our accountant told us to wait until I moved to the US and got my SSN to filed jointly (we don’t owe anything so no penalties). We filed for an extension for the 2022 taxes. We uploaded our 1-864 in July 2023 and the following: - his tax returns for 2021, 2020, 2019 - 2022 w2 - several paycheques - extension for taxes - letter of explanation on the tax extension - letter of employment. We were then told his income was insufficient and a joint sponsor or further evident may be needed before my interview. My interview is in the next 12 days. We received an email from the embassy asking for his recent W2 and taxes. IRS efiling doesn’t open until after 5 days after my interview and his job won’t/can’t issue a w2 for 2023 in time for the interview. My question: His father has offered to be our joint sponsor. He has all his tax transcripts from ‘22,’21,’20 and makes enough. We plan to upload a joint sponsorship 1-864 this weekend and also provide new financial documentation like recent pay stubs, a letter of employment for 2023, our investment accounts etc. as well as a letter from our Accountant explaining the reason why they advised us to wait until now and a letter of intent to file as soon as efiling opens. Will the joint sponsor and additional documentation be sufficient for the financial support side? Is there anything else I should bring/expect at the interview?

Hi all! So my husband is looking to submit the I-864 Affidavit of Support as soon as possible however, his 2022 tax return has been put on an extension. Since it's almost May, 2022 is the most recent tax return and he would obviously have to submit 2022, 2021, and 2020 but we don't want to prolong the process by possibly waiting weeks to submit the I-864 because of the extension and then waiting for it to be processed. I've seen that people have submitted 1040, along with W-2's and a letter explaining why they don't have their tax transcript yet and everything went smoothly for them. However, my husband is an independent contractor, a 1099 employee, so we are curious as to if there is a way we could do this even though he does not have a W-2? What would we have to submit? I think he is schedule C or something, I also am not too familiar with this terminology considering I am not American so apologies if the terminology or wording is a little off. Do we have any options other than waiting weeks for his tax transcript? Thanks in advance!!😅

How to write an "Explanation why you not paying taxes" letter

I am not sure if anyone have made this kind of topic/post but my wife needs to write a letter of explanation why she is not paying taxes for NVC can anyone help me out with any guidance/Template so i can send it to her and we can upload it for our DQs please. Hello, I am filing for AOS for my husband which I brought to the US on K1 visa. I am trying to complete the I-864 as the sponsor. I have a question however, I just started working in January, this is my first job since my last one two years ago. My job from two years ago doesn’t meet the requirement, but my current job does. I make enough to sponsor him but I do not have any tax returns for this job since I just started. I have two or three pay stubs and that’s about all. Should I make a joint sponsor or can I be able to sponsor my husband with an employers letter and pay stubs plus whatever tax returns (which do not qualify) I had prior?

Greetings, I am a USC, currently waiting on I-130 approval for my Pakistani bride. We are not at the NVC stage yet. I went to file my taxes and the only option H&R Block would give me is to file as single. Since the wife does not currently have an SSN, is unemployed, and resides overseas. I do not have or plan to get an ITIN for her. My question is that would filing single while married to an overseas spouse cause problems at the NVC? Do I have to file an amendment immediately and have it ready by the time NVC requires it? Can I send this amendment after she finally arrives in USA and get an SSN? Has anybody here ever had a problem with the NVC process due to this filing as single, instead of Married filing separately or Head of household? Anybody ever experienced any negative impacts on the immigration petition or embassy interview stage due to having filed single while married to a foreign spouse? Do I have to go back to H&R block to request an edit/amendment or just leave it be? Please send your reply in detail with credible sources.

Hello everyone, My husband has his interview scheduled at the embassy in mid March. I understand taxes for 2022 are not required until April 18th, but I wanted to double check on if we should submit those to CEAC because I have started a new job in January of 2023. Would I need to upload information about my new job such as paycheck stubs and my offer letter? If I do so, would I need to submit my W2 for 2022 and an updated i-864? Or would this be unnecessary because his interview is before the new tax year officially begins? Is it crucial either way to upload information about my new job? Basically, since I have a new job after submitting our documents to the NVC, should we include proof of that to bring to the embassy? Should we contact our embassy and ask them directly? I know we are overthinking, but we are so close to the end of this process and don't want to make a mistake! I really appreciate any feedback. Thank you all so much and best wishes!

I have my interview in 2+ weeks and wondering if it speeds up process for the IO if I proactively upload the 4 years of IRS transcripts and 5th year of tax returns as additional evidence? I will carry with them but if the IO is gonna ask for, why not upload ahead? Also, did anyone got asked for when applying with EB5+? TIA

Hello! We applied for AOS and immediately got RFIE for our form I-864. I am very confused why, since my husband’s current income is well above the 125% guideline (his last year income shown on his most recent tax return was not sufficient tho). We provided his employment authorization letter with his current salary and his bank statement showing his salary transfers for the past 6 months. We also provided his full tax return, tax return transcripts and all w2s he had for the most recent tax year. Now we got a joint sponsor but reading the rfe I realize that maybe there was some mistake that triggered it and the inly thing I can think of after going over the copy of the form we have, is question 24a-24c: “My total income (adjusted gross income on Internal Revenue Service (IRS) Form 1040EZ)“. My husband is self employed, and we put his adjusted gross income from his 1040 there (line 11 on his form 1040). Maybe this was our mistake and we had to put the total income from the line 9? Please enlighten me, should we put his total or adjusted gross income there, we are worried that that putting his gross income was the reason of him “not qualifying” and genuinely not sure what line we should use there for our joint sponsor as well and if we have to refill my husband’s I-864 together with our joint sponsor’s affidavit

Hi I filed a petition for my wife in the Philippines last 04/21/22. I am starting a new job soon and was wondering how to fill out the W4 and later the income twx return. Do I file as married filing seperately and what do I have to do different than before when I filed as single? TIA
