Hi Apologies if this was already answered. Does anyone have any knowledge or insight in regards to a scenario like below: US petitioner working and living in third country with their spouse. The job is for a U.S company contracted with the US govt. Spouse hasn’t done the interview yet but believe it will be close. If the interview comes up and he gets his visa but we decide to still remain in that third country due to work, will it be an issue? Still keeping the US bank accounts, using mothers residence for mail, keeping life insurance policy, US company health insurance, paying taxes, keeping storage unit of the previous US apartment furniture. Visiting every 6 months-9 months. Saving up for a house to purchase in the US.

General Tax Filing Questions

My husband and I are currently waiting for his spousal visa interview (CR1). For the past two years, since we have been married, I have filed MFS. I have filed through TurboTax and mailed my filings with non resident alien written in the spousal SSN. If he is able to get an interview and get his visa this year and able to enter the US, I would like to file MFJ. My questions are related to his income earned in Mexico. (1) Since he doesn’t have a W2 or a similar document, does anyone know how I would enter that income into a tax prep software? (2) How would I convert pesos to USD? Would it just be on the conversion rate at the end of the year? (3) Is there a way to deduct what Mexico taxes my husband has paid from my tax liability? (4) If he enters the US this later year, do I have to claim all of his Mexico earnings even though he was not in the US all year? If anyone has any suggestions on this topic, I would greatly appreciate it.- 5 replies

So, I just paid the affidavit of support fee at the NVC and waiting to show as paid. When that is done then I have to fill out the affidavit of support, so do I download the form and fill it out then sign it and scan and save as a file to upload on to the page or do I fill out the form online when they say I can! Thanks

Today we received an email from the National Visa Center, which proceeds to list all the possible pit falls that can be encountered in the process of filling out the affidavit of support and the visa application and it is very informative, however, the email starts by saying that they ' you were recently notified that we are now ready for you to begin filling your application with the NVC' but this is really the first email we received from them. It does have the case number, we just go ahead and start filling out the application? Thanks

I received a message along with my dq email saying petitioner didn’t meet the income needed, and would need a joint sponsors. My income from last year was not enough to qualify as I only worked half a year aand I don’t have a joint sponsor. This year I’ve doubled in income, can I send my spouse with my 2022 w2 and tax documents that show an updated income to take care of that issue? Or are they still expecting me to have a joint sponsor?

My fiancé went for his interview on the 11th of October. He received a white 221g slip and on the bottom the CO wrote “sent to USCIS for revocation.” Ceac date was updated on the 13th after his interview and showing Ready still. On US travel docs it’s showing this message “passport is still with embassy” (it’s not with them it’s with my fiancé and I’m not even sure if the website always said that or not). interview: fiancé arrived- woman asked for some documents- she took my 2020 w2 and tax transcripts but not my 2021. She didn’t take my affidavit of support. She didn’t look at our messages or call logs. She didn’t look at our western union or rent receipts. She didn’t look at our itinerary. (This woman was a third party Pakistani National not American citizen) fiancé went to CO window and he only said these things- how did you meet? what does she do for work? how old are you both? (He’s in his 20s I’m in my 30s with a 10 yr age gap) all he said to him was “that’s unusual” about our age gap and then wrote on the white 221g slip “revocation” and said the interview is done with no answer about any evidence we need just that it’s over and slammed the window in our face. Wanted to share this experience in case for others to see or if they had something similar happen and what was the outcome.

Hello We live in United States. My husband used to live in Greece and we need penal record from Greece to be sent to embassy of us in Albania, that is we’re the interviw will take place. However we are having a difficult time getting the penal record mailed. Please help with any advice.

Just like the title says, i am thinking of submitting an application for the diversity lottery program but i am worried Abt it interfering with a potential CR1 visa me and my partner might apply for. My partner is a US citizen and we're planning to apply for the visa next mai . Can I still apply for the dvprogram ? Or would that prevent me from applying for the CR1 spousal visa? I'd really appreciate your help with this.

Hi there, I was hoping someone could give me some advice on spousal visa options/requirements. My fiancé is Russian and I’m currently staying with him in Russia. My lease in the US is up at the end of June and I won’t be resigning, I also quit my job to stay in Russia for a few months with my S/O. Now we’re facing a few options on what to do next. We could go the online marriage route through Utah, we’re already together in person so it should be okay with filing for a spousal visa. We could go get married somewhere like Georgia since I need to leave the country for a day due to my visa. We could also apply for the fiancé visa and go get married in the US. I’m not sure if anyone has tried completing the spousal visa with an online marriage through Utah and if it was pretty smooth? I really don’t want to have to leave my S/O and go back to the US. It makes me nervous to leave Russia without at least being legitimately married, is there a way to file everything for the spousal visa online or was there a step that needed to be physically done through mailing? Also I was hoping for any advice on staying with an S/O outside of the country while waiting for either type of visa to be processed. Thanks so much for taking the time to read, we’re super lost and appreciate any advice :)
