Our Story

  1. I do not know where to post this so I am putting it here. Some of this I have asked before but we have new information, an evolved situation, and new advice from attorneys so I am seeking guidance here because I do not know which path to proceed with and have limited time and resources. Any information or advice is welcome! The summary of our case history is as follows: My wife (Russian citizen, possibly stateless) first came to America in 2011 on a K-1 fiancee visa. We married and she received her conditional green card. We lived in America together until personal issues caused us to separate and her to return to Russia with our daughter in 2014 a few months before we were to file for the removal of conditions on her green card. I remained in America and filed when it was time but was told that they could not process it as my wife left the country. I moved to Russia in 2015 where we reconciled and had a second child together. When the Ukraine war started in March of 2022, we filed for an IR-1 spousal visa and humanitarian parole. We never heard anything about the humanitarian parole but later found out it was approved in March of 2023 but never sent to the Embassy and we were never notified. We continued the IR-1 process and she did the medical and interview at the US consulate in Almaty, Kazakhstan in March 2023. They suspended processing as they demanded original copies of my divorce decree from my previous marriage and we could not get those documents to them due to the sanctions. DHL was the only company willing to attempt delivery and the documents were seized at the Kazakh border by customs who refused to release them. While this was happening, we were forced to flee Russia under emergency conditions due to political persecution and threatened imprisonment/execution in July 2023. We fled to the US embassy in Astana where my wife was given a new emergency humanitarian parole valid for 2 years. We entered the US in August 2023 and she was inspected and paroled for said 2 years. As of July 2023, her IR-1 case on the CEAC website shows refused as the status but we have never received any documentation regarding this. My initial plan of action was to file an I-485 to adjust her status based on being an immediate relative (spouse) of a US citizen and using the I-130 that we filed with her IR-1 visa application. I have been told by an immigration attorney that her green card from 2011-2014 should still exist but in a 'suspended' state. That we could file an I-751 to remove the conditions but upon reading the instructions it states you can only do so within 90 days of returning to the US. We are outside of that window and I was not aware that this was a possibility until today. I was also told by the same attorney that we can file an I-824 to request action on her IR-1 visa and effectively have it transferred from the US consulate in Kazakhstan to the USCIS here in America but upon reading those instructions it states this does not apply to denied or pending applications and only approved ones. It is my understanding that the I-485 is the only real option open to us but I am not sure if that is true and am seeking opinions on this. I was also told that the medical exam she had done in Kazakhstan in March 2023 is still valid for the I-485 as they are now valid for 2 years instead of 6 months. Even if that is the case, we do not have a completed I-693 as everything there was done electronically. All we do have is her vaccination record for all the vaccines she received. I assume she will need a new civil surgeon appointment for the I-693 to submit with the I-485. Please correct me if I am wrong. I have written several letters and made several phone calls to the State Department, USCIS, and multiple US consulates regarding our case but have not been able to determine the correct course of action as most of my inquiries go unanswered. At this point, I plan to just proceed with the I-485 as it seems to me it is the only valid option.
  2. Hello all! I was wondering if anyone is in AP or Administrative processing at the moment? Me and my fiance applied for a K1 visa a while ago. After her interview in Poland in 12/2022, they have put her case into AP. It has been around 5 months now and still waiting. Has anyone gone through AP recently? How long has it taken you? Any help or advice you can give please? Thanks!

UPDATE FROM WARSAW POLAND US EMBASSY INTERVIEW COMPLETED, VISA ISSUANCE DELAYED So we are now in Warsaw Poland, we completed the US Embassy interview last Tuesday, that was 1 week ago as I type this update. The total interview time took about 2.25 hours. Most of the time was just waiting for her number to be called once inside. The interview was scheduled for 8am, we arrived at the embassy at 7:45am there were already about 30-40 people standing in line. There was a line coordinator working the line and we were separated into two lines one for the non-immigrant visa folks, and one for immigrant visa folks. I was not needed/allowed to go inside with my wife during the interview. She was inside by 8:15. I had to wait 2+ hours on the street outside. Nowhere to sit, no coffee shop, no cafe near by. While inside she was given a number. When called she presented her documents to an immigration officer, a woman that spoke good Russian, she reviewed the documents and said 'its all in order' gave her documents back and asked her to sit down again and wait for her number. About an hour or more later she was called to the 2nd official, a man with not so good Russian. He spent less than a minute reviewing her documents and asked her two questions: 1. How did you meet your husband 2. How long have you known your husband Though she had every document requested in the instructions to be sure to bring with you, he asked her to return to the hotel and upload her updated birth certificate and police report and he indicated they would then process her visa quickly and she could pick it up at the mailboxes ETC. We went back to the hotel, scanned and uploaded the two documents within 1.5 hours. The need to do this was understandable since her original police certificate expired because of the long delay between moving her case from Moscow to Poland and the delay in obtaining an interview. The need for the birth certificate update was because my wife decided she wanted a brand new birth certificate that was in perfect condition, her original was partially not perfectly readable in the area for her birth city....so she got a new one and the officer noticed they were different so its understandable to upload the new one. LESSON LEARNED: If any of your documents expire or change, its a SUPER GOOD IDEA to upload them before your interview so that they are already in the system before your interview. Why the official couldn't just copy and upload them or put them in a folder I don't know but its not part of their process apparently. The official assured her that if she did this quickly (the upload) they would quickly process her visa and it would be available for pickup in a few days at the mailboxes etc. THIS DID NOT HAPPEN.... We have extended our stay an additional week in Warsaw, and this has been expensive to change flights, get a hotel for an additional week, food, etc. It's near impossible to get anyone on the phone that can tell you anything more than to just wait. We check the CEAC web site profile several times a day for an update, nothing after a week now. No email communications from the embassy, no communications at all. The Warsaw embassy has several ways to communicate with them. This includes live online chat, Skype and web phone call. The live online chat turned out to just be a robot and I was unable to actually get my chat routed to a human. I wasted about 30 minutes repeating my wife's name, passport number, birthdate and email address to the robot only to at the end be told it was a holiday. It's Tuesday morning and not a holiday in US or Poland I got no response to the Skype message I sent even after adding the correct Skype account to my contacts, no response at all The web talk phone call just took me to the same voice response system that calling the number on the website provided Called the number on the site +48 22 307 1361 (see below) Finally got a human on the phone this morning, talked for 20-30 minutes, he answered questions and was quite patient but could not indicate how long we might have to wait...that is how much longer we will have to wait. No indication whatsoever how much longer. The problem is that obviously we need to get back to work, we do not have unlimited funds to stay in Warsaw for an indeterminate time. To compound the issue, the embassy has my wife's passport and she obviously can not leave Warsaw/board a plane without it. We can get her passport back by doing a request for it to be returned, this can take 2-3 days, and if we do that we (apparently) do not have to return for an interview, BUT she will have to submit her passport again using the correct form and the support agent told me several times that the passport can ONLY be mailed from the mailboxes ETC location in Warsaw! It can not be mailed from any other location! Are you sure I asked him several times! MY level of frustration is just off the scale, apparently you can't just walk down to the embassy and explain your situation to anyone, there is no way to expedite your request or processing, you can only get your passport back and start all over or sit and wait an unknown amount of time. If this is what happens when you have a simple immigration case where the parties have known each other for 7+ years, been married for 5+ years and appear with all original documents as requested, I can't imagine what a hard case must be like. At this point we are wondering if we can stay an additional week....and the only advice we have to offer is to be sure if any of your documents changed to upload the updated version to the CEAC site well before the interview. If they do not need to be updated, DON'T...they were already approved. There is no need to update documents that are not expired (like a police report) and that have already been accepted and approved. Any sage advice would surely be appreciated.
  4. Hey all! I have petitioned for my Russian parents to obtain IR-5 visas as I am a US citizen. Now we are required to submit police reports for them from everywhere they lived starting at 16 y.o. and my parents used to live in Kazakhstan when it was part of USSR and some time after USSR fell apart. It seems that the online platform for obtaining the police report (http://Egov.kz) requires an ID that only is assigned to Kazakh citizens, which my parents are not. How can they obtain the police reports without those IDs? Many thanks!!🙏
  5. Hello everyone, Quick question to all of you folks that are more experienced on the CR1 side of things. My other half is Russian, she lives there. I cannot just simply go there due to the current world situation, so we just meet in 3rd countries. Our next trip will probably be in Dubai or Turkey due to the relatively ease of travel for her to be able to go there. Now we are also in the process of deciding if go with K1 or CR1, for CR1 my question now is, I read somewhere that the interview is had where you get married. Example, if we go to Turkey and get married there, then our Visa interview WILL be in Turkey? Am I correct in this? I cannot marry her on Moscow for obvious reasons that is somewhat dangerous for me to go. Another thing would be to do a Utah Zoom Marriage, which apparently it is fully recognized by USCIS and there are no issues with it whatsoever according to some posts here. Is that correct? In the case that we marry using the Utah Zoom Marriage, where do we have our Interview? (Assigned consulate for Russia is Warsaw, Poland. Problem is that Russians cannot enter there unless they get REALLY creative, so most people doing K1 for example are having the case transferred to Turkey, or Kazakhstan.) As a side question, any idea if AFTER applying to CR1, will it be ok for her to apply for B2 so we can at least meet here whenever we want while she waits for the I-130 to process?   6. Hi everyone! My girlfriend and I met while on a trip. We exchanged numbers we were purely friends then. She went back to her country, and I came back to US. We kept talking as friends and as usually things goes, we planned a trip to see each other for 2 weeks, we did and it was amazing and all great. Because we have been talking for so long and also because we are already planning another trip to see each other and be together, we also discussed the K1 possibility since we do want to be together. I have not proposed yet, and I completely understand the whole K1 process and it's requirements. However one thing stood up to me, do I need to be engaged to her before starting the process? Can I start the process, get engaged, then marry as soon as she come? I have evidence of our intentions, due to chats, and also photos of us together since we were a relationship pretty much from day 1 since we just clicked. Will have even more photos on the second trip but that is like 2 months from now. In essence, any issues I submit now and don't have specific wedding plans or are not engaged yet? Even though I do plan on getting engaged with her.
  7. I just logged into NVC's application page for the first time after my lawyer has paid all the fees for NVC already. At the top I am seeing: VISA CLASS: CR1 YOUR CASE IS CURRENTLY AT: NVC FOREIGN STATE OF CHARGEABILITY: RUSSIA INTERVIEW LOCATION: TBILISI PRIORITY DATE: 07-JUN-2022 I see the interview location here is Tbilisi, Georgia although we indicated Warsaw on the application. Does this mean NVC has already assigned the interview location and it will not otherwise change? We were planning to transfer to Kazakhstan like so many others anyway but I am a bit confused if this indicates NVC has already determined to transfer our case. A bit odd but we were married in Georgia but hold no legal residency there. This is positive news I guess? Separately, is there a way to check how quickly Tbilisi processes/interviews immigrant visas? I see B1/B2 appointment wait times are at 280 days.... does that indicate I should try to transfer to Kazakhstan for a quicker interview appointment anyway?
  8. I'm an American living in Russia with my Russian wife. I applied for my wife to get an immigration visa to the U.S. and I finally I got an email notification from the NVC that my wife's documents were qualified on November 7th, 2022: "The National Visa Center (NVC) received all of the fees, forms, and documents that are required prior to attending an immigrant visa interview at a U.S. Embassy/Consulate General overseas. NVC will work with the U.S. Embassy/Consulate General in ANKARA, TRKY to schedule an interview appointment for you. Once we have confirmed an interview date, we will send a notice to you, your petitioner and attorney (if applicable)" But since then, we haven't heard anything from the NVC. Currently, the usual location for Russians to have their U.S. immigration visas processed is in Warsaw, Poland, but due to the state of the world and the difficulty for Russians to get to Poland at the moment, I was able to ask my congressperson to get my wife's case transferred to Ankara, Turkey. Russians don’t need a visa to get to Turkey so we thought it would be easier to apply from there. I have tried various approaches to expedite my wife's case, including contacting my congresswoman, senator, White House helpline, and submitting a Statement of Hardship with evidence. However, nothing has worked so far, and I've only been asked to “please wait.” Things here in Russia are continuing to deteriorate and as my wife is unemployed and entirely dependent on my income for survival, I can't just go to the U.S. and wait this process out. Does anyone have any advice on how to get my Russian wife a U.S. immigration visa as soon as possible? I’ve tried every reason to show a need to expedite my wife’s case and all I’m met with is silence or just that I need to keep waiting. I’m really open to anything at this point.
  9. Hello Everyone, new to the forum! I was wondering, USCIS has varying wait times for Visa processing centers (K1), for example Texas and California have 16.5 months wait time as of now. However Vermont for example has 5, and Potomac 14 I think. Obviously we all want our cases to be approved and followed as fast as possible. But is there even a way to decide where does your application go to? For example I do not mind traveling to Vermont for 1 or 2 days just to submit my application there. (I live in FL). Or can you specify so in Form 129F? I understand patience is key and part of the process, but it just feels so off that processing centers have such a varying degree of wait times. Thanks in advance!
  10. My Russian wife (IR1) and daughter (IR2) got an interview scheduled in Poland in mid April. We are trying to preparing the interview. One of the things to do is to register their visa delivery address. Since the interview is held in Poland, I need to register at https://cgifederal.secure.force.com/?language=English&country=Poland but it keeps taking me into Russian site indicating "Apply US Visa in Russia" instead of "Apply US Visa in Poland" at the top. I do not know if it is because my wife made a profile to apply US tourist visa in Russia before or simply her nationality is Russia and take her to Russian site as default. When I try to choose the delivery address at "New Application / Schedule Appointment" --> "Visa Type" (Immigrant Visa) --> it only has a choice of Moscow at "Post" instead of Warsaw. If I keep going to "Personal Data" to enter delivery address, it says enter Russian address only. What did anyone who is Russian who already had an account in https://cgifederal.secure.force.com but whose case was transferred to Poland, do to register delivery address in Poland? Also, is MBE pick up address in Warsaw the following?: Mail Boxes Etc. Warsaw ul. Wiertnicza 115, Warszawa, Poland 02-952
  11. Hey all. Wish I'd been able to make it here sooner and on better terms, but I'm in a bit of a pickle. My name is Friedrich and I'm applying for a K1 on behalf of my fiancee and two K2 visas for her daughters, age 16 and 11. NOA1 November/04/2021 NOA2 January/19/2023 The NVC submitted everything to the embassy in Warsaw and I received an e-mail today saying to fill out form DS-160s for everyone within 48 hours to continue our case. We had planned to submit our DS-160s and then try transferring her case to Jerusalem, El Salvador, Bishkek, or anywhere plausible that would take her case as it would be cheaper than getting them Schengen visas and bouncing around Europe to pass illegally into Poland. The problem we're facing is that since August, the Russian Foreign Ministry has suspended the issuance of biometric travel passports indefinitely and her youngest doesn't have one. Since February, my fiancee's inquiries have only been answered that they may open services again at the end of March, but as of yet nothing. The 48-hour window the Warsaw embassy gave to file is not happening. Non-biometric passports are still being issued but from what I understand this is not good enough. What are our options? What do I even say to the embassy? Really feels like the whole world is against you sometimes. I really congratulate each and every one of you who's stayed the course through all of this.
  12. Hey everyone! Quick question, does the case status always update to show that your I-129f has been sent to the NVC on the USCIS page or can the case sometimes be sent to the NVC without the case updating as, "case was sent to the Department of State" ?
  13. I am an American citizen living in the US. My fiancee is a Russian citizen living in Russia. Living so far apart is really not ideal, and I just submitted the K1 packet so I've been trying to think of ways to live together while the visa processes for the next 12-18+ months. I'd definitely like to go to Mexico first but am looking into Canada as a place to go afterwards... Canada has a visitor/temporary resident visa which allows recipients to stay as tourists for up to 6 months. This seems like a great option as it is close to where I live and I can work remotely without having to deal with different time zones or find a job that will allow me to work such hours while also being close to the US if I have to go back for any reason. Has anyone here applied for this visa? I have a few questions: Can you apply on another person's behalf despite not being a Canadian citizen? Can you apply from a country other than where you reside (i.e. Mexico) Can you submit financial information on behalf of someone else to satisfy the visa? https://www.canada.ca/content/dam/ircc/migration/ircc/english/pdf/kits/forms/imm5484e.pdf
  14. Good morning, So, this is my first post on VJ. I have had my account since November 2021 after filing my K1, since then I have just lurked in the shadows of VJ and never posted until now. I filed my K1 with an NOA1 date of 11/11/2021 and an NOA2 approval date of 02/08/2023. My situation is kind of unique, but I'm sure most of you have similar headaches. Basically, my fiancée is a Russian citizen who has been living in Mexico since the Russian invasion of Ukraine. As of now NVC has not received our documents from USCIS. I know they wait time is 30-60 days so I will wait at least until April 8th before I get really impatient. I need to transfer my case to a different embassy because Poland is a no go and (given the history between Poland and Russia it is understandable). However, it still baffles me that the DOS designated Poland in the first place because Kazakstan, Turkey, Armenia, and numerous other countries would be way more suitable than Poland. I digress, I have reached out to Kazakstan and practically every single Central/South American embassy/consulate and received a no regarding the case transfer. I am waiting from a reply from Israel and will try Turkey and other Latin American countries after receiving the NVC welcome letter. What countries would y'all suggest? I am active-duty army is there any way I could swing that to my advantage? I know military service doesn't really come into play or have significant impact until the AOS. Also, how would I go about updating my fiancée's address as she no longer lives in Russia? As stated previously she has been residing in Mexico for about a year now, but it should be noted that she is not a resident. She just came on a visitor visa and has been there ever since. We went to Mexican immigration, and they told her that because of the war Russians and Ukrainians can stay in Mexico for long as needed (makes sense, why would they kick them out when they are bringing surmountable wealth and contributing to the GDP). That said, will I need to provide police/criminal records for her from Mexico? All the information I found only pertained to residents and given she is not a resident this will be very difficult. Any input would be helpful. Also, when we eventually do get the NVC welcome letter will it come by mail or email? Also, will I or my fiancée receive it? All in all, f*** the American immigration system this s*** broken as hell. Its honestly why I am going to law school when I leave the Army. Considering America is a country of immigrants this system should not be the way it is. I get we can't let everyone in, but c'mon man there got to be a better way... I literally work for the American government, and I thought the Army was bad when it comes to bureaucracy, but hell no immigration takes the cake for sure. Overall, I'm just really stressed out as I'm sure most of you can relate to. This summer will mark four years since I met my fiancée when I studied abroad in Russia back in 2019 when I was enrolled in university. Then in 2020 I enlisted in the Army and that hasn't done any favors for us in terms of immigration (which is stupid because there are supposed programs to help with immigration for service members). So, I really applaud the strength, dedication, and resolve of my fiancée for staying true throughout this whole endeavor. She literally sacrificed her whole way of life and seeing her family in the hopes of starting a better on in America knowing full well she may never return to Russia (given the current situation) or at least not be able to go back for a LONG time. I know people on this forum have similar experiences with their fiancés, fiancées, or spouses. So, I would like to applaud them and you all for being persistent for love in a situation that doesn't foster or cater to growth or love in a relationship. However, I will say that this whole process has made mine and my fiancée relationship stronger and we have both grown together and as individuals as a result. Going from long distance for a long time and seeing each other once or twice a year to a semi-long-distance relationship but with the ability to see each other practically every other month has really put things in perspective. While this situation sucks, I'm grateful and thankful for the lessons it has taught me (especially patience), and I think in the long run people like us will have longer lasting and more meaningful relationships in marriage. I am currently with my fiance overseas and I was reading that most of the documents for the interview need to be the originals. is the affidavit of support a document that would need to be brought to the embassy as an original with my signature on it? or would a copy be fine?
  16. Hello All, My fiancé and I have had our application in review since April. With everything going on in Russia, should we wait for our review and interview, or should we try to get her here and seek asylum? It is an uncertain time, and I would like a second opinion on the idea. It seems as if we do not try asylum, we will never get the chance to get her out. Thank you for the help.
  17. I’m a naturalized citizen of the US. In January 2021 I filed I-130 petition for my mother to bring her here from Russia. All I’ve received since then was the receipt notice and when I check status online it says as of March 2021case is being actively reviewed by USCIS. My brother is turning 17 this year. I need my mom (once she get a GC) to file a petition for him before he turns 21. It’s been 17 months since I’ve filed for my mother and I’m very worried. I just hope it’s not lost somewhere. When I try to submit online inquiry due to outstanding timeline it says that the case is not out of the timeframe. Calling USCIS isn’t helping either because it’s impossible to get a person which is reasonable because of the amount of petitioners they have. Just wanted to ask if anyone experienced the same thing or have any idea how else I could get an update on the case. I’m also concerned since all the immigration matter for Russian citizens are handled in Warsaw. My mom will need to obtain Schengen visa to go there I assume. Her current visa expires in November. Considering circumstances getting Schengen visa isn’t easy either.
  18. Hi everyone, With the Ukraine/Russia crisis happening right now, has anyone seen any updates from the U.S. government on expediting K1 visas, or any Ukraine visas in general? I reached out to my immigration lawyer and I'm waiting to hear back. Right now I'm stuck in the NOA1 > NOA2 process. We received our NOA1 in July 2021 but are still waiting for our NOA2. Right now it appears they are wrapping up March filers and moving to April 2021 filers soon, so this means we will still have at least a few months until receiving our NOA2 which makes me nervous given the last few weeks of escalation. I appreciate any thoughts/comments you may have!
  19. Does it include the first two digits or not? My wife's K1 visa which she used to enter the states does not have these two digits in the "passport number" section, and neither does her DS-160. Did our lawyer make a mistake here? If so, would she need to correct it during the adjustment of status? Thank you.
  20. Hello! So, my husband and I have a few questions regarding how interviews work. We're still at the beginning of this process but we thought we'd get this cleared up early on. For background, he is Russian living in Armenia. He only really has 6 months to stay in Armenia before he has to probably go back to Russia for a bit, although it's all really uncertain. There's a chance he could get his passport and go to Georgia for a bit and then reenter armenia later, but he doesn't have a passport and if he tries to get one while in Russia, he will no doubt be dragged into the war, since he hasn't done his required military conscription yet anyway, and if he tries to get one from armenia, we're completely unsure if they'd issue him one. But I guess that's a separate issue. Basically, we have no idea where he will be in the future. Maybe still in Armenia, maybe Georgia, maybe Russia in the worst case scenario. We're hoping to get an expedite since he's displaced due to the war but i've heard its unlikely, since he's russian and not ukrainian. If we start this process now and he has to leave Armenia after he submits his greencard app, then where is the interview located? Is it just whatever US embassy or consulate is near him, or would he need to reschedule the interview to match where he currently is? I've also seen conflicting information about where russian citizens are getting processed. I heard that he would have to do everything in Poland but I've also seen that he just needs to use whatever embassy is closest to him. Is it that if he's physically in russia he needs to go to poland and if he's still in armenia he goes to the US embassy in armenia? It's a really confusing situation, so any thoughts or information to help us out would be greatly appreciated! Thanks!
  21. Hello! New user here. I just recently got married to my Russian husband, who is currently residing in Armenia due to the war. He has no intentions of ever returning to Russia. I am the US citizen petitioner filling out the I-130, and in the "Information about beneficiary in their native written language" section, it's asking for his name and address in his native language. His name I understand should be in Cyrillic, but the address he's living at right now is Armenian. Should that also be in Cyrillic, or should it be in Armenian? Thanks!
  22. I am not sure if this belongs here or in the RUB thread but here it is. We are expecting to move soon from Omsk, Russia to Detroit, MI and are looking for options to ship our household goods. We are struggling to find a company due to the current international humanitarian crisis over here as well as the COVID-19 pandemic. Does anyone have any ideas or companies they could suggest? We are at a loss and do not really want to just leave behind 8+ years of our possessions. We are primarily looking at sea freight due to the weight of the goods. Thank you!

We already had our invitation to Warsaw and an interview scheduled for April when the war broke out and now we cannot go, because there are no planes and no one in Europe is issuing Schengen visas. We are on K1 fiance visa from Russia. So what are people doing in our situation? Are they asking for transfers to Erevan, Armenia or somewhere else? I don't think Bucharest will work, because they are in the EU and due to the sanctions there is no way to get there from Russia right now. Any suggestions? Has anyone tried anything that actually worked?
  25. I just wanted to share this here because my husband found it. Biden passed a new EO, which to my understanding, makes it illegal for an US person to send money in USD to any person in Russia. (a) The following are prohibited: (iv) the exportation, reexportation, sale, or supply, directly or indirectly, from the United States, or by a United States person, wherever located, of U.S. dollar-denominated banknotes to the Government of the Russian Federation or any person located in the Russian Federation; I'm not 100% clear on the "banknotes" thing, does that mean we can still wire money/do digital transfers? Does it mean cash only? It's super unclear, if anyone has insight let me know.
