  1. Dear all, Hope you are having a good day! I need urgent advice on this very complicated situation I am in right now. If anyone already went through this or has experience with the topic, I would be happy to have your feedbacks! Long story short. I was living in the US and got my permanent Green Card in 2019. In 2021, I filed for the reentry permit (I-131) because me, my American husband, and our daughter, we came to my home country, Switzerland, and I anticipated staying more than 12 months. We didn't exactly know how long we would stay because of various reasons. So, to be on the safe side, I applied for the permit. I knew I had to physically be in the US to file for the reentry permit that is why I sent my application while in the US. I sent it on October 28, 2021 (I have the USPS receipt) and USCIS cashed my check on November 2, 2021. I left the US on October 29, 2021. Just two weeks after, I received the letter from USCIS saying I don't have to give my biometrics because they already have it. Just wait for the decision. In my application, I indicated that I wanted my permit to be sent to the local embassy in Switzerland because that is one of the option when you are abroad. I knew it woud take quite some time to receive a decision because of the backlog at USCIS. So, I waited 17 long months and yesterday, I got their letter saying my case was denied. I'm in disbelief! The reason is: "USCIS records indicate you departed the United states on October 29, 2021 and you have not returned. USCIS records further indicate that you filed your application for reentry permit on November 2, 2021." Why do they mention that I filed on November 2? I sent everything on October 28. Is the date of reception at USCIS the date of filing? I'm lost. I want to appeal because there must be a way out of this. Also, how many times can one file for this permit? If I appeal and it gets denied, can I file again next time I'm in the US? Thank you in advance!
  2. Hello friends! First, I just wanted to thanks in advance to this lovely community 💜 A little about my status: I am currently working abroad since Feb 2023 until Feb 2024 as a deployed delegate for an US company. I'm permanent resident (conditional, based marriage) since March this year. I got it while overseas. My issue!: I'll be back to the USA next week, and will stay there for 5-6 weeks (until biometrics) to apply for the reentry permit but was hoping someone could provide advice if that is necessary because I will only be abroad for 11 months (as LPR) when my work contract ends, should I still apply for reentry? I asked USCIS agent and told me that estimated processing times is 17 months, so I'm worried 😕 maybe I can extend my contract but definitely not enough to cover all the months, and, overall, I have a conditional LPR, 2 years, so I have to be back before March 2025... If I decide to return to the USA, let's say in March - April 2024, with a pending reentry application, would I be ok? Thanks in advance! Michelle
  3. I know that this is an old thread, but I thought it might not be best to start another one on the exact same topic. The reentry permit interests me for a similar reason with a few additional questions yet to be answered. There is a high chance that either my husband will take an assignment abroad or I may decide to study back home which will take us out of the country for an extended period of time. Does the back-to-back reentry permit only apply to studies abroad or would it be. The reason I ask is that my husband's potential job assignment might be for 3-4 year. I know that to apply for citizenship I have to be resident in the US for at least 18 months of the last 3 years and have lived in the jurisdiction from which I'll be applying for at least 3 months. Does the reason for being abroad make a difference to that rule? Are there any exceptions i.e. for study? If not, after we returned to the US permanently, the clock would start from 0 again? No previous time is counted even with the reentry permit? If we decided to wait until I applied for citizenship (which would be April 2024), could I leave the country whilst that application was pending, with the intention of coming back to the US for any appointments, etc.? If so, would my husband need to be with me during any appointments for taking citizenship? For more information, my husband and I have been married since October 2018 and I've had my green card since April 2021 (took 2 years to be approved because of COVID). Many thanks in advance.
  4. Sent I-131 re-entry permit documents to USCIS via USPS. Showed as delivered on 3/31/21. It's been about 2 weeks but I have not received any notification that they Got it and credit card has not been charged yet. What is the timeline or hold up?! I need to leave the country in 2 months - technically if they do not need biometrics can the permit be sent to my home address in the USA and my spouse forward it to wherever I am? Thanks!
