  1. Background: I got married to my spouse in January 2021 and received my conditional green card in March 2022. I'm about to file i-751 in December, however, we have been separated since June this year (2023). We tried so many things and went to marriage counseling for almost a year and even our counselor agreed that sometimes the best that we can get out of the counseling is realizing that we shouldn't keep causing each other pain anymore. We were in a relationship since 2017 and I thought I knew the person well enough but long-distance relationship can be cruel, I didn't learn about his issues with alcohol until we started living together. He also had severe attachment and abandonment issues that didn't allow him to connect with me in a deeper level. We tried going through individual therapy, for him to work through those issues and for me to learn how to cope when I'm triggered (I have a father with alcohol issues as well). But it just didn't work out unfortunately. Current Situation: Right now, he wants to get divorce as soon as possible (he's going through much pain and has been suicidal because of the breakup) but is willing to push it back until a few months after I file i-751. I also want to get it done too but I'm not sure if it's better for me to start the divorce process while i-751 is pending. I'm willing to push as much as I need to. So right now I'm considering... 1. Starting the divorce process now, before filing i-751. My concern is that my chances of getting approved would be lower and the process would take longer. 2. File i-751 in December 2023, and sometime at the first half of 2024, start the divorce process. My concern is that it would complicate the immigration process. But I also feel like it might give me a better chance of approval. I'm also not sure if I should hire a lawyer to do this for me. I know I'm very capable of getting all the paperwork ready. I did everything myself the first time around to get the conditional one. But I was wondering if having a lawyer would increase my chance somehow. I attached a picture of the documents I have prepared so far to prove that my marriage was of good faith. If anyone thinks lawyer is a way to go, can you give me an estimate of how much it would cost? Thank you so much. P.S. Other info about me... I'm based in Madison, WI and have been working full-time since I got my green card. I work as a research analyst. I also had been supporting my spouse financially since he's still in school and only works part-time. So, I was the main source of income in the family. He's still on all of my premium insurance and is also my beneficiary since I know he needs it until he graduates next year and starts working full-time.
  2. The big day is coming up and I've been given conflicting advice about whether or not I should bring lawyer to my Naturalization interview. My case: • I'm a Canadian who entered on K1 visa, married promptly, and received my 2yr GC without issue. • My USC spouse became abusive/unfaithful/an addict. We divorced: I applied for ROC with a divorce waiver and was granted my 10yr GC without an interview. • I applied for naturalization under the 5yr rule. Many people on this site have been vocal that USCIS will go through your "entire immigration history" to make a decision on Naturalization, and given the way my USC marriage went I'm dreading the idea of having the IO dredge up/pick apart the details of my failed relationship. With this in mind, some have suggested I bring a lawyer so that the IO won't ask any off-color questions, etc. Others have said that since I applied under the 5yr rule that the details of my former marriage aren't necessarily relevant -- and that especially since I was given a 10yr GC without an interview, I already gave USCIS enough evidence to prove without a doubt in their mind that what happened-happened and won't need to get into it again. The details of my failed marriage are heavy - it was exceptionally traumatic, and needing to make a decision about this is causing me a lot of grief - so I may as well open it up to public discourse. ^^^ All of that said (and to benefit others considering legal assistance) what are good reasons to hire a lawyer to accompany you to the interview? Weigh in!
  3. Hi hope everyone is doing well. So I made a post last year worried about me aging out since am 21 years old and our priority date is 14 December 2014 and you guys helped me out but now I have another issue. So me and dad and little sister is under the F1 green card, my dad mom filed for us back in December 2014 and we got our approval letter back in may 2020. The visa bulletin finally moved forward for us too but here's the thing there's a lawyer my aunt hired to help her with the process she had us send up our birth papers and police records last year around October and called to get out person information February or march this year am guessing for the iv application since our iv fees were already paid last year too and when the lawyer called she said to expect a call from the embassy any time soon but we haven't heard anything yet....is there a reason as to why it's taking so long ? I also check a month or 2 ago that our iv application hasn't been filed out as yet...my mom had a fried doing the same thing and he was saying that the lawyer probably mailed all that info to the embassy for them to full and and it's a long process..what do you guys think? Sorry that this is so long and that my English is bad just a bit upset about how long it's taking don't want to age out
  4. Hi, group. I hope everyone is doing fine today. 18 years ago my dad (LPR back then) applied for my mom (beneficiary) and me (me as a derivative) with the form I-130 in 2003. USCIS sent us a notice of approval in 2005, but after that, my dad didn't follow up with NVC. I asked NVC for my case number and they replied. I checked the status and it says "At NVC". NVC sent a notice of 1 year in 2011 but still my dad didn't follow up for reasons beyond his control. Is it possible to continue with this case after 18 years? maybe with a lawyer? Or do I need to start over with USCIS and a new I-130? I am 27 years old (not married) and my dad is a USA citizen now (naturalized). USCIS still shows as "My case was approved" NVC shows: At NVC. I hope someone can help. Thanks in advance!

  6. Hi everybody! My lawyer, who filed I-751 on my behalf is retiring end of this year. I guess it indicates how long I-751 processing times are 😃 I checked G-28 form, and it had one box checked: "I request that USCIS send original notices on an application or petition to the business address of my attorney or accredited representative as listed in this form." 1. Does this mean only notices, including potential RFE and / or interview notice are sent to attorney? 2. Does this mean GC itself is sent to my address (didn't check boxes 1.b., 1.c. on G-28)? 3. What should I do if RFE / interview notice is sent and I want to use lawyer? Do I need to send new G-28? I asked for a copy of my full file from the law office for the future use. Are there any other things I need to consider? Do you have any recommendations? Thank you
