  1. Hey all. Wish I'd been able to make it here sooner and on better terms, but I'm in a bit of a pickle. My name is Friedrich and I'm applying for a K1 on behalf of my fiancee and two K2 visas for her daughters, age 16 and 11. NOA1 November/04/2021 NOA2 January/19/2023 The NVC submitted everything to the embassy in Warsaw and I received an e-mail today saying to fill out form DS-160s for everyone within 48 hours to continue our case. We had planned to submit our DS-160s and then try transferring her case to Jerusalem, El Salvador, Bishkek, or anywhere plausible that would take her case as it would be cheaper than getting them Schengen visas and bouncing around Europe to pass illegally into Poland. The problem we're facing is that since August, the Russian Foreign Ministry has suspended the issuance of biometric travel passports indefinitely and her youngest doesn't have one. Since February, my fiancee's inquiries have only been answered that they may open services again at the end of March, but as of yet nothing. The 48-hour window the Warsaw embassy gave to file is not happening. Non-biometric passports are still being issued but from what I understand this is not good enough. What are our options? What do I even say to the embassy? Really feels like the whole world is against you sometimes. I really congratulate each and every one of you who's stayed the course through all of this.
  2. Please help! A friend and his mom arrived in the US together on a K1/K2 visa. My friend was younger than 10 years old at the time of entry. His mom and stepdad married within the 90 days. Again, this all happened before he turned 10 years old. HIs mom and stepdad are still together and have had kids together. However, his mom and stepdad never filed for AOS for mom and him. My friend is now over 21 years old. Can he file for AOS on his own without his mom? Or does he need his mom to apply with him because he is a K2 derivative? Is K2 still dependent in K1 at this point? I looked and it said that as long as marriage occured within the 90 days, K2 can always apply for AOS but does he need his mom to apply with him at the same time? I understand his mom needs to apply for AOS as well but l am only asking for my friend. He spoke to a few attorneys (free consultations) and they said yes to applying on his own. But found out a lot of applications get denied. I did some research and it said that as long as marriage between K1 and USC is bonafide and within the 90 days, visa overstay in this situation is forgivable due to marrying the USC within he 90 days and green card will be available to them granted they fill the forms out correctly and provide all documents. Is Matter of Le relevant because he entered the US before 21 and marriage occured before he was 18 years old and within the 90 days. Also, because he arrived in the US before 21 years old, he wouldnt 'age out' of getting a green card. He has gotten forms together: i485, i131, i765, i864 (stepdad will fill out) and supporting documents such as i797, visa, passport, birth certificate, etc.
  3. Can anyone tell me if this is normal? My fiance was approved on her first interview. During a second interview with the two children a different interviewer told her that I lied on my paper work and that I was a violent man ( I got in a street fight at 21 years of age and went to jail at 23 years of age for driving with a suspended license , I am 45 years old now and I wrote all that down. I did not hide anything ). He said he needs me to write down why I got in a fight, why was I driving with a suspended license and he wants word for word transcripts of my court hearing ( over 20 years ago). Is this common? Why would my fiance be approved only to have some guy reject the kids? Id there anything I can do other than o what he ask ( Which I am doing anyway) Thank you Jesse
