I am on H1B visa currently which is valid till late 2025 and applying for my Green Card through marriage. I want to know if I should apply for Advance Parole (I-131) with my application in case I need to do international travel to see my family? I have read some conflicting information- -Some say if I do international travel without Advance Parole while my application is in process, USCIS might cancel my application. - Some say advance parole is not required since I have a valid H1B visa. - I have also read that If I use advance parole while I'm on H1B, I will lose my H1B status. Please advise.

Hi everyone, I'm US citizen and my fiancé is Canadian H1B visa holder, we plan to get marry in September and start the green card process asap. I have a few questions, hoping someone can clarify. We are currently in 2 different states due to work (CO and MN) but I will move to MN by end of this year or early next year at the latest. All these questions mostly for if we file before the move happens: 1. Do we use different addresses or should we use just the MN one? Will either scenario cause any problems later on? 2. We will file I-130, I-485, I-765 (I'm not 100% sure, but I think this is the EAD) and advance parole together. In that case, can we leave the US before getting advance parole or will we have to wait? Does filing for EAD affect his H1B status? 3. If we file immediately after getting married, does it look suspicious to USCIS? 4. When will I have to file Affidavit of Support (This is the income proof, right?), as well as other proof of our marriage? I'm worried that if we file before the year ends & have to send those at the beginning, we won't have proof of tax joint. We are currently living apart so we have very limited proof (no joint lease nor tax), mostly just health insurance and joined bank account. Thank you in advance for your help

Hello, I (beneficiary)am currently on my H1B visa and in the process of applying for my green card through marriage. My husband(sponsor) does not meet the income requirements so I am planning to provide my income as financial support for my green card application. My income meets the requirements. In this case, will I be able to switch jobs while my application is being processed by USCIS or will I have to continue working at my current employer until I get my application results. Please advise and thanks in advance for your help!

Hello everyone, I have a situation where I can use some community guidance. I am planning to move to a different city from my worksite. They are definitely in other Metropolitan Areas i.e., they are around 120 miles apart and in different counties. Although they are in different locations, I'll commute there 2-3 days a week. I already have a valid H1B visa. I know I need to file AR-11 for address change but other than that do I need to change anything in my H1B visa to USCIS? I read that there is an Amendment for Location Change, but it looks like that is only if you are fully remote or the employer has changed their location. Any help is appreciated. Thank you.

Hi Group Members, My spouse had H1B 3.5+ years ago. Her company is processing GC for her but it takes too long and the company still has not submitted PERM yet (her prevailing wage is still processing by DOL at Oct 2022), and we don't know when it has been done. Just scared in the WORST CASE that her company may be STOP the hold process because of the Economic depression, WHO KNOWS I am H4 and I want to apply for EB3. If I do so, does it affect anything to my spouse OR myself when 2 of us are applying for GC at the same time? My visa only has under 2.5 years so does it enough for EB3? Please share your experience and advice. Thank you.

Does anyone have experience with traveling while on OPT and with approved (but not activated) H1B COS? I want to visit my family during the summer and would try to return on OPT status before Oct. 1st. My lawyers have stated that while this should be possible since all my documents are valid, I could have trouble at the port of entry showing non-immigrant intent even if my H1B is not active. Has anyone successfully done this?
