  1. Basic info: Mom has green card >5 years. Has full custody. Dad is not in picture anymore. Stepdad is USC Child (middle school age) has visited during school break on B2 visa. After an emotional 3 week stay really does not want to return to home country, as they miss being with their mom and the mom can't visit frequently anymore due to work. So we are looking at applying AOS for a green card. Currently is authorized to stay 6 months. The process is complicated as always, but straightforward - but for a couple of items. I've looked around the forum for answers, but it does not seem common for kids to go through this process because they usually follow the parents. Unfortunately that was not an option at the time. So I have 2 fairly simple questions: 1. The "90 day" rule - from my research that is just a guideline to determine the level of scrutiny to put on an application. Is there a "too soon" to apply? 2. Since she is of school age, we don't want her waiting 3 months at home during the school year. I fully understand the B2 rules say that it's NOK to go to school on a B1 visa. But do we really have to wait until we apply for the AOS? Or would it be reasonable to send them to school since we plan to apply for GC anyway? Applying for AOS after 90 days is really hard due to these school obligations. Thanks all for your help.
  2. My wife and child are Dutch citizens. I am a US citizen. our child was recently born in the Netherlands and we just received an appointment date for CRBA 3 months from now my EU 90 day visa is about to expire so I have to head back to the US. my question is can my wife and child come visit me for 2 months with their Dutch passport after which all 3 of us can head back?
  3. My daughter was born oversea in 2018 while I was a green card holder. A year later I become US Citizen in 2019. I filed I-130 petition for my daughter in 2019, got approved in 2020, and got notification from the NVC. I logged in the NVC, submitted the fee, got the invoice number. Due to COVID, it wasn't in the best interest of my child to be located to the US during that time, so I took no action. NVC in 2022 notified me that unless I start taking action, they will close my case. I responded to the NVC in 2022 to let them know that now that COVID is over, I would like to move forward with the visa processing. NVC emailed me back saying the case is under review, and will let me know when its done, aka. asking me to wait until further notice. Now, 2023, the NVC mailed me a letter saying since I did nothing from their 1st letter, the case will now be close. My question is, 1. Why does the NVC suck so bad? Is there a way to file a complaint against them? There's no way to contact them beside public email inquiry. They took 2 months to response. And their response is confusing, on top of that, no way to contacting them for clarification. 2. Now that I'm a citizen, can I just go to the US Consulate at my home country where my child is currently reside to do CRBA instead of redoing the I-130? Thank you.

  5. So My friend who is a permanent resident of USA petitioned his unmarried son and along with him is his both unmarried son and daughter who are no 18yr olds. Their NVC are now documentary approved and sent to US embassy manila waiting for F2B becomes available. Can one of the child be removed for now since he just had a child and doesnt want to leave his young baby alone. if so how do you do that? thanks
  6. Hi Everyone, My brother has a 12 year old child out of wedlock in the Philippines and the child wants to visit us here in the US for the first time. The child currently lives with the mother and would just want to visit and not be petitioned or to live permanently here. Mother has no B1/B2 visa. My brother left for the US when the child was 3 years old but has not gone back to the Philippines since then although he supported the child financially and they constantly communicated. Would it be possible for the child's US citizen father to accompany on a B2 tourist visa application in the Philippines and the child be approved? Any insights, recommendations, or advice is greatly appreciated. Thank you!

  8. Hello everyone, I am the beneficiary and my case has been DQ'D at NVC and I am waiting for interview at Mumbai Embassy. My daughter who is a step child of my husband, her case has been approved at USCIS, but we decided to put it on hold before applying at NVC as they're documents we are awaiting for her to be DQ'D. My question is will it be okay at the interview if I say that my daughter will be joining later on and that she lives with my parents here in India, while I will be travelling back and forth for her. I read somewhere that if the dependent's case is pending at uscis or nvc, the embassy refuses the visa stating that it'll approve once the child's case is approved. Does the embassy takes interviews together of parents and kids in CR1 category or is it separate? Thank you in advance.
