  1. Hi everyone! I recently got a RFIE for my I-485, at this time I still don't know what the request is about but i am afraid it is related to my joint sponsor's I-864. When we filled for AOS my mother-in-law accepted to be my joint sponsor since my husband's 2022 tax transcript was below poverty line and we filled before he filed for taxes. Now his 2023 tax transcript is way above poverty line, if the RFIE is about it can we withdraw my mother-in-law form and send a new I-864 of just my husband's? I already uploaded on march 1st our 2023 tax transcript as a proof of bona fide marriage since we filled jointly. thank you so much!
  2. Hey Everyone, My wife (GC Holder) and I would like to sponsor our niece (18yrs) to come live with us to ultimately experience something new. There are many ways for our Niece to come to the US (Student, Tourist, Nanny, etc.) but we were wondering what the best route was to get her here, with the potential of her staying the longest. I hesitate a student visa, because she does not know what she wants to study, and I do not want to put that debt on her. Tourist visa is only 6 months, and we would like to see her longer than that. From my understanding being a nanny, you could live here for two years, but not sure how that logistically works, and if we could have family be our nanny through a visa process. Hoping for some insight into our options with the maximum amount of time for her stay. Thank you!
  3. I am a US citizen living in California. I have a history of sponsoring a spousal CR1 Visa. Marriage in 2016, divorce finalized early 2023. In 2021, due a history of bipolar disorder I had a severe psychotic break that led to criminal charges (nothing involving a minor of course). There was no conviction history for these charges as they went through a mental health pretrial diversion with records sealed and expunged. There was no plea or anything. This situation led to spouse filing for divorce and likely a VAWA. I'm currently in a good relationship with someone else. We would likely be getting married next year. Would there be any estimated significant issues to sponsor someone again with this history? I plan on consulting with an immigration lawyer when the time comes to file the initial packet of course, but this has me a bit stressed thinking of complications.
  4. Hello, I am filing for AOS for my husband which I brought to the US on K1 visa. I am trying to complete the I-864 as the sponsor. I have a question however, I just started working in January, this is my first job since my last one two years ago. My job from two years ago doesn’t meet the requirement, but my current job does. I make enough to sponsor him but I do not have any tax returns for this job since I just started. I have two or three pay stubs and that’s about all. Should I make a joint sponsor or can I be able to sponsor my husband with an employers letter and pay stubs plus whatever tax returns (which do not qualify) I had prior?
  5. Hi Everyone! I'm a long-time reader and first-time poster, so I thank everyone that contributes here and makes this such a great resource for all of us! I have been self-employed for about 6 years. I have a single-member LLC that files as a Schedule C and I take a "draw" bi-weekly as my income. However, (and I know this has been discussed before) obviously from a tax reporting perspective, my accountant is incentivized to reduce the bottom line income as much as possible to mitigate taxes. So despite the fact that I pay myself every two weeks roughly the same or more, the bottom line number reported number over the last few years is often under $30,000. (Comically, I have had a W-2 employee working for me since the beginning who would have zero issue qualifying!) My question is, do I go through any effort to try to explain this or just skip to a joint-sponsor? I do also own a home that has equity... but again, my question is really about what is the path of least resistance, having a joint-sponsor or trying to walk the person through my finances? I would be happy to have the property appraised if that is simplest.
  6. Hi, My case is in NVC. I am filling I-864 form Affidavit Of Support for my spouse. I came to know that US domicile is must for approval of I-864. Right now I own one current account in Heritage Bank and I also have recent 3 years of Tax returns. Am I qualified for US domicile from these proofs? I cannot own any real state and leasing in real state. I am living with my uncle ( My Mother's Brother) who will be my joint sponsor. Looking forward to hear some good suggestions. Thanks
  7. Hello! Me and my fiance are about to get married soon. He is an american citizen, however he moved out of US and back to Romania (where we met) 2.5 years ago. My questions are: 1) I understand that he, as my petitioner has to also be my sponsor, but how should he prove that he intents to get back to the US? 2) How should we get around the financial issues? He has a job here but he will most likely give it up and change it if we move. Can we get a joint sponsor? I will also specify that his parents and brother live there, would that be relevant?   8. I have a question. We are in the process of our K1 visa, waiting... But I am waiting here in the US and my fiancé is in his country. Since the distance is so hard to handle we are wondering if its worth it to cancel our K1 visa application, I would find a remote job so that I can still sponsor the visa from out of country, and I would move to his country for a little while, we would get married and apply for the CR1 visa and once it is approved we would come back to the US. So he would still get the visa, but instead of waiting for it apart we would wait together, already married. What do you guys think about this? is it okay to cancel the K1 and start the CR1? would the remote job work for the sponsorship ? What do you think the pros and cons of something like that would be? Our K1 application was received July 31st, 2022.
  9. Our case is I-485(AOS) family-based, was submitted in June 2022 together with I-864 affidavit of support. The questions: my wife (the petitioner and the sponsor) wants to quit her job, and do not work for a about 6-12months while we are waiting for the interview invitation. Can this negatively affect our interview and our case? Do they ask for any documents regarding the current income and active job on interview? All was fine for the moment of our application, but is the sponsor expected to maintain her sufficient income during the whole processing time (which is around 20months for our field office)? Details: My wife, LPR, is the only sponsor. She has been working in USA for more than 2 years, having a decent annual salary that is several times higher than the poverty guideline. For the form I-864 she showed with her tax report this decent situation for the year 2021. We estimated, that even if she quits right now in September, her income for this year 2022 is far above the guideline. She wants to quit and do not plan to work for about a 6-12months, because she wants to sit with our 6m old baby. Our family can live on her savings for about the same amount of time. I am ready to start the work as soon as I got the work permit (but still waiting). I am highly grateful for any answers and suggestions.
  10. My husband has his visa interview in London in a couple weeks. We want to add a joint sponsor before the interview because it was asked for at the point of our DQ. The joint sponsor is my father, but he sponsored my mother (a green card holder) decades ago. Will that be an issue? Can he sponsor again? Thanks for any guidance!
  11. Hi everyone. I received a generic RFE requesting a new I-864 based on the I-485 forms I applied for my parents. To give a background, I'm currently a full-time student and my income is $0. So previously, I submitted the I-864 forms for my parents with an I-864A, which showed my father's foreign assets since he doesn't have an income either as he's retired. The number was well above 5 times the 125% of I-864P, alongside supporting documents like property documents, appraisals, etc. Not to mention, I last filed my taxes in the year 2020, and I didn't file taxes afterwards since I was out of the states + my income was well below the required minimum to file. What I do know I did wrong was I put my household size as "3", including myself, my parents, in each form, when I should have put 2 instead. I'm not sure whether it's the fact that the immigration officer has a hard time being convinced that the assets are liquidated easily given it's from a foreign country, or something related to the cash limit of the originating nation. Or whether it's just some typos, as it's a very generic RFE which you can see attached below. I'm considering finding a joint sponsor to make things easier and smoother, as a more concrete proof of income, but I'd like to avoid that since most people aren't willing to do so. If possible, I'd like to show that my household has enough money in the form of assets to not require a co-sponsor which we do, but I don't know whether I should submit more proofs like county tax assessments of the properties and assets, or just find a joint sponsor altogether somehow. Also, if I were to go to a lawyer, can anyone give an estimation of how much the expenses would be to go through this RFE and whether the lawyer would act as a joint sponsor if given money? I am a dental hygiene student in Canada wanting to move to America… my boyfriend is going to get his student VISA transferred to a work VISA so he is good to go (he is Canadian who went to university in US). My case is a bit harder… I am looking for ANY advice or help for a dental hygienist to go to America. Has anyone else done this before? I don’t even know where to start. I believe I need a dentist to sponsor me… how hard will that be?! I appreciate any and all help I can get
  13. Hello, Our case got DQd on June 29th, 2022 and we are currently waiting for an email regarding next steps. In addition to the DQ notice, we received a review note that stated the following: "This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. The consular officer will make a decision regarding this requirement at the time of the interview." My wife had just graduated University and started her first job at the time of this sponsorship process and so her tax documents at the time I guess did not satisfy the minimum income requirements. As we went along the process, she got a new job and has been there for almost a year and we uploaded documents showing her current salary which more than meets the requirements. I didn't think we needed to have a joint sponsor because of this. Now that this note is on our file, we have a joint sponsor and we have completed the AOS form and gathered the financial documents to support it. In terms of uploading this on to CEAC, is there a specific way this must be done? Firstly because this is a joint sponsor and secondly because NVC has already accepted our previous documents and have stated we are documentary qualified. So I'm wondering if we just upload as normal or do something differently. It even says "an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted". I would like to do so anyways to avoid any further conflicts, delays, or issues. Secondly, at the time of me submitting my civil documents, my passport was not expired. It expired throughout the process. I have renewed my passport and have both my old and new ones with me. Should I be uploading the new one on to CEAC or is this not necessary? I'm assuming I should still bring both to the interview? Thank you for the help and feedback!
  14. Hi everyone! I have some questions about my case and help is very much appreciated. My interview date is close. 1- About the form I-134, it states that if the sponsor is married the spouse should also fill a separate form. How can the spouse fill it? What name does she put in the sponsor section? I'm having a hard time understanding it and there isn't much information in the internet. Another thing is the income part of the sponsor. With the new I-134 there is no part where the Sponsor writes his income, it says only how much of it will go to the beneficiary. What minimum is it required, My sponsor has said he will give me 1000$ for 4 months and also provide me with house and all other expenses. He has also put a bank account in the assets part. 2- Other than the taxes and wage receipts, do I need other documents to provide to the embassy from my sponsor? 3- Do I need to send the original documents with DHL to the embassy or I send copies of them? 4- Can I have another friend make me another affidavit of support just in case the first one is refused?   15. Good day, I saw a couple of posts from people who sponsored Ukrainians they are not related to or know personally. I was wondering how they were able to find each other? I am sponsoring a family who are my close relatives, but also have a good friend in need of sponsorship. We looked on welcome.us - there is only an option to sign up as a sponsor, but no links to resources where a Ukrainian could apply to be vetted for sponsorship from a volunteer. We would really appreciate any helpful information. Thank you!
