Hi there, I'm in a bit of a weird situation here. I would have completed 3 years out of my 4-year Bachelor's degree after the Spring 2023 semester. I'm transferring to a community college for a year starting Fall 2023, and will return in Fall 2024 to complete the 4-year Bachelor's degree afterwards. Say if I complete a certificate of achievement at the CC at the end of the Spring 2024 semester, will I be eligible for OPT for Summer of 2024? One factor that's complicating things a little is that I'm also doing CPT this summer based on my Bachelor's degree. I believe there is a rule against using OPT at a lower degree after having used it at a higher degree level, but I can't find any information about using CPT at a higher level, and the OPT at a lower level. Any advice would be much appreciated! Thanks!

Hi guys. I'm in a tough situation like many of you here. My OPT is expiring in Jan 2023. I have a STEM degree, but my employer (Walgreens) is not willing to fill out I-983 training plan for me as a part of STEM OPT application. I'm trying to fight this and convince them to fill out the form. However, it seems like the best bet for me is to expedite the pending AOS EAD (F2A). I've submitted an expedited request with the reason of job loss and not being able to pay rent, insurance, and e.t.c. Is this convincing enough for my request to be approved? I'm also thinking to ask for help from my congressman if my attempts don't succeed. This is a long shot but has anyone here worked for Walgreens and applied for STEM OPT through them? Is there anything else I can do to salvage my situation? Any advice is appreciated. Thanks!

My Wife (American Citizen) and I (Canadian Citizen) are beginning the process of filing 1-130A. My question revolves around providing information from my OPT and time in the United States from 2014-2019. I attended school on an F-1 Visa (Massachusetts) for 4 years and then received work authorization through OPT from November 2018 - July 2019. I exited the country on time and have been living in Toronto since. On I-130A they ask for a USCIS Online Account Number (if any) or Alien Registration Number (A-Number) (if any). Are these applicable to me still, even though my OPT had expired back in 2019? If they are, how can I find this information as I don't have it readily available? Any insight to others who have gone through a similar situation would be great.

I am out of the country from September 2021, but I have a valid Job and a residential address in the USA and submitting my stem opt reporting on time to my DSO and I could see the same in my SEVIS portal. I planned to come to the USA in December 2021 but I couldn't come back for some personal reasons but continued to work. I just came across the 5-month rule. Now I am worried if this going to be a big mark on my profile. Could you provide some guidance on what are the consequences as I am willing to come to the USA on a different visa in future. Please let me know what I should tell my DSO and how to handle this situation.

Does anyone have experience with traveling while on OPT and with approved (but not activated) H1B COS? I want to visit my family during the summer and would try to return on OPT status before Oct. 1st. My lawyers have stated that while this should be possible since all my documents are valid, I could have trouble at the port of entry showing non-immigrant intent even if my H1B is not active. Has anyone successfully done this?

Hey guys! I just graduated from college in April, and got married to a U.S. citizen in May. Before getting married I submitted an opt i765 late April because everyone else was doing it. Now me and my wife are filing i130 and i485. It’s been more than a month and my opt hasn’t been approved yet (I know it takes 2-3 months). My question is should I wait for my opt to be either approved or rejected before submitting my green card package? Because on my opt I had my status as single, and my status on i485 will be married…. I don’t know if that will be a problem at all. thank you!
