I am in the K1 visa procesos and I've trying to complete the Form I-134 but I've having some issues understanding some parts of it: 12) Beneficiary's anticipated length of stay (what date should I write on the FROM (m/d/y) Part 2 Beneficiary's financial information 13) Beneficiary income (I am self employed and my salary it's not the same every month, should I put an stimated of my salary now? But i am not gonna be able to keep working when I travel to US) Also at the TOTAL NUMBER OF DEPENDTS, should I count myself as 1? (I don't have kinds of anyone else who depends on me) 16) Beneficiary's assets I have a bank account with not much money (should I add it there or is it not recommended) Financial information 14) Income (at the end of the chart, on TOTAL NUMBER OF DEPENDENTS, should I count my beneficiary as 1? And write it down like 1? (He doesnt have anyone else who depends on him) Part 3 information about the individual agreeing to support 21) Intent to provide specific contributions to the beneficiary (he Will provide everything for me, once I get there, how should I frase that?) Thanks for your help.
  2. My parents I-130 was approved in Dec 2023. I was in the process of filing DS-260 for them, but my dad passed away in Feb 2024. I'll have all the paperwork submitted for DS-260 (including Affidavit of Support) shortly. But, I have a few questions for which I am unable to get clarity on. Hoping this community can help provide some guidance on them. 1. My mom has a B1/B2 Visa. Can she come with me to USA on B1/B2 and file for Adjustment of Status in USA eventhough her DS-260 is filed here? If Adjustment of Status can be filed in USA, how long does it take to get approval for the GC? Will doing so jeopardize her DS-260/Green Card application process in any way? 2. Or is it better to wait till she gets her DS260 approved, finish the medical checks, biometrics, Visa interview (location: Mumbai, India) and then come to USA? 3. Do I need to notify NVC/USCIS to stop further processing of my dad's DS-260? If so, how can it be done? One option is I simply don't submit the supporting docs for his DS-260, so the process will not continue on USCIS side. Would that work? 4. Do I need to notify NVC in any way that my dad has passed away for my mom's DS-260, since the DS-260 has this question: "Is your spouse immigrating to the U.S.with you?" and my mom's DS-260 was submitted with a response of "Yes" before my dad passed away? I'm assuming that my mom can simply take the death certificate to the visa interview and update them at that time about my dad's situation. Would that work? 5. For Mumbai, India location, any estimates on how long does the approval take after DS-260, Affidavit of Support and other supporting documents are submitted to NVC? How long does it take to get the biometrics, Via interview appointment and the eventual visa to travel to USA? Thanks for all your help!
  3. Hello, As I understand it, the sponsor must earn 125% annually from the poverty guidelines to qualify for the affidavit of support for the k-1 visa, so more than 24,650k annually? Can someone please explain how does it work exactly? Do they take in consideration the debts, loans, and child support payments of the sponsor if he is divorced and has a child from a previous marriage and deduct those from the annual income sum? Do they take in consideration if the beneficiary has a sum of money from a previous property owned and that was sold? Would that qualify for self support?
  4. I have a some questions regarding the affidavit of support (joint sponsor) for our case. The petitioner did not make enough income so we needed a join sponsor We uploaded a joint sponsor who is self employed with his three most tax returns, so NVC asked for W2 and 1099, we submitted schedules and a wage and income transcript along with a comment explaining that the join sponsor does not have a W2/1099. After the above was completed, we review 3 RFE’s from NVC respectively: Provide evidence of income for Petitioner Provide evidence of income for joint sponsor This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. The consular officer will make a decision regarding this requirement at the time of the interview. My first question: I have a new join sponsor with three most recent tax years: $2500 in 2020, $49,000 in 2021, $127,000 in 2022. Will this be a good sponsor, can I just upload him and ignore the rest of the messages? My second question: Or do I continue providing more proof of income for first join sponsor? I have bank statements, paystub, and Tax Return Transcript.

Question 1: If the petitioner has the yearly salary of $40,000 and he gets additional $20,000 from the govt. for an autistic child that he is a guardian of then in the form i846 POINT NUMBER 7 what yearly income will he show? $40K or $60K? Question 2: In the Point number 8,9,10 what will be petitioner write, to my understanding name of the autistic child he is the guardian of, his relation to him and the income that he derives from govt (ie $20,000)? Or something else?
  6. My spouse has filed i130 for me and we are awaiting for its approval. My spouses' friend is bringing her mother through IR5 to United States. She has asked my spouse to become an added beneficiary in her mother's case. Q1) I wanted to ask that if my spouse files for the affidavit of support for the friend's mother, would it create any issues later for me when she will be filing for my affidavit of support? Q2) After filing for i846 for the friends' mother, would it increase our family size to 3 (since its me, my spouse & friend's mother) when at the time of filing for my affidavit of support when the time comes? My USC spouse currently earns $55,000/year
  7. Thanks. That's a useful piece of information! Can you provide a source for that? I am in a more difficult situation. My wife (petitioner) and I (beneficiary) are going to file coming week. For now, we're both in the Netherlands, but she might move within her American company into a post-PhD program that will start next year (around or just before we will enter the US). Which will put our US income (only on her name) on 120k+, meaning that it will provide above poverty line for both of us, for the coming 12 months. Would that be sufficient to count in and how can we proof such a thing?
  8. Hello everyone. I am a U.S. citizen living and working abroad, and I am filling out the I-864 for my spouse for the CR1 visa. As my income so far in 2022 is entirely from my job overseas, am I still allowed to include this in my "current annual income"? I have read the entire instructions of the form as well as the FAQ's on the state department's website and it doesn't say I cant. The only restriction comes from using the intending immigrant's income as it must continue from the same source after immigrating. I haven't been able to find anything stating that a U.S. citizen sponsor isn't allowed to use foreign income ( I mean, I will have to file a U.S. tax return on this foreign income and it is subject to U.S. taxes so I don't see why I cant use it). However, I have read on this forum that I am not allowed to use it. Could someone provide me a source for this reasoning on not being able to use my foreign income? Thanks a lot everybody:)
  9. Hello All, I hope you all are doing well. I have a situation. I recently had to resign from my job in the USA and had to come back to Pakistan and I have to stay here for some time. Now my wife CR1 case is documantarily qualified and our consulate is Islamabad. Considering all the backlog I don't think her interview would come any time soon. Although I had submitted my 2020 tax return and My 2021 tax returns are ready to be presented at the time of interview. Now my concern is since I am out of job atm and by the time her interview will come it probably be in mid of 2023 so I probably would have to fill another AOS and have to show my tax return of 2022. My question is will my assets will be enough to prove financial stability like my 401k which has almost 40k in it. Then I have investment in stocks. I also have a property here in Pakistan worth 26000 dollars. Will all of it be enough Or do I still have to come up with a joint sponsor. I am also looking jobs to work remotely but so far no luck. Thank you in advance.
  10. My wife and I just got married on a K1 visa and wanting to file AOS soon. My 2021 IRS tax transcript does not meet the poverty guidelines for i864, as I was unemployed for 2yrs and 2 & a half months due to living in my wife’s country. I just started a new job as of the end of March 2022. My question is; when filing AOS I864, can I use my 2022 predicted income backed up with paystubs and an EVL?
