Our Story

  1. Hello all. I got my Green Card through marriage to an American Citizen. We are still happily married. My original plan was to apply for citizenship at my third year of permanent residency. However, due to the COVID pandemic the process of removing conditions was delayed for about a year, and then some personal circumstances have further delayed me from applying for citizenship. I am now ready to continue with the process but I just realized that because I recently completed my fifth year as permanent resident I am now also eligible to apply under the 5-year as a permanent resident category. It seems to me that applying under this last category is a lot easier than under the category of married to a US national since I would not have to provide proof of a bona fide relationship which implies collecting and submitting a lot of documentation. Do you think that applying under the five-year category would raise any red flags at all and potentially make the application process more difficult? Should I stick to applying under marriage to a US citizen? Thanks for any insights you can provide!
  2. Hi guys, I filed N-400 in Nov 2019 and still haven't been scheduled an interview. Contacted USCIS multiple times and got the same answer that my security checks are pending. Tried congressman as well but got no luck, still same BS answer. Anyone in the same boat? Any advice?
  3. I have i751 pending filed last year feb2021 and now I’m eligible for n400.. I had filled up online application form . In the last step where I can review the filled application form , I can download the pdf as well. I see the Part2 #13 is not checked in the pdf I downloaded . But I’m not sure where is that option to select yes/no in online form . Can someone help ? 13. Exemptions from the English Language Test A. Are you 50 years of age or older and have you lived in the United States as a lawful permanent resident for periods totaling at least 20 years at the time you file your Form N-400? B. Are you 55 years of age or older and have you lived in the United States as a lawful permanent resident for periods totaling at least 15 years at the time you file your Form N-400? C. Are you 65 years of age or older and have you lived in the United States as a lawful permanent (If you meet this requirement, you will also be given a simplified version of the civics test.)
  4. Hello, my spouse came in on CR-1, applied for i751 and has interview for ROC scheduled. Also now applied for N400 as soon as they became eligible 90 days before the 3 year mark. Biometrics have been taken, was given the study guide and told to wait for interview, and online status has updated to the same. The question is, is it possible that the upcoming ROC interview can be a combo interview, with oath ceremony scheduled after the conclusion of 3 years of permanent resident status? Field office is Kansas City which as I understand doesn't do same day oath ceremony anyway. Thank you!
  5. Hello All, I got my green card through marriage. First, my conditional green card with no problems. During the covid, I applied for the removal of conditions and did not have an interview due to the Covid restrictions. They approved my request, and sent me the 10 year permanent resident card, re used my biometrics. Now, next week I will have my N400 interview. They didn't mentioned in the letter that my wife needs to go to the interview. does she need to go with me, or since it's for naturalization, she is not required to go? Any tips/advices for me to be prepared for the interview? Thank you so much.
  6. Hi all, My husband applied for naturalization back in February. When we filled out the application we forgot to list a 7 night closed-loop cruise (Fort Lauderdale - Mexico - Jamaica- Fort Lauderdale) on the trips outside of the US. When we listed all the trips we were going off of stamps in his passport. Because the cruise was 4 years ago it completely left our minds and we forgot to list it. There was never passport stamps, as it was a closed loop cruise. Now we are freaking out that we forgot to list it. Has anyone experienced this? Should we upload a document to his online account in the evidence section mentioning this? When he has his interview should he bring it up and tell them or wait for them to ask? Of if they ask if he needs to alter anything with the application. Any advice to help ease our stress would be greatly appreciated.
  7. Does the Greer, SC Field Office offer oath ceremonies the same day as N-400 interviews? Thanks!
  8. Hi all, I have a question related to “Name change”. I’m a Vietnamese with the common problem of incorrect name order. My middle name + first name has been changed into my first name (current legal name) on Green card and SSN. Despite my attempts to correct the name order, it never got fixed. It took so much time (the USCIS informed me it would take from 6 months to 01 year to replace the GC at the time), while I needed to start working right away to support family and couldn’t do it without legal paperwork. Therefore, I took the common advice to put it asides and plan to request name change when filing for naturalization. However, the problem is I was a J-1 student, married my American husband then left the US for a few years before coming back as a legal permanent resident. My name when I was a J-1 student was in correct American/English order. It was also the name on my kid’s CBRA and marriage license, which is now different from my current legal name. When filing the N-400 online I am being asked by the system to provide evidence of my name change. I have never legally changed my name. The USCIS and the US Consular in Vietnam changed my name order despites my desperate attempts to fix it. ( I have a trail of written communications back then with NVC, the US Consular and the USCIS). On my very same passport, my US visas prior to 2016 have my correct English name order, while the immigrant visa is the one with the incorrect order. Should I use my visas and the past communications records as evidence for my name (being) changed? Would be so thankful if someone in the same boat could give me some advice.🙏
  9. Hello everyone, My interview was scheduled today at 9:30 am at Holtsville NY, I got there at 8:30am the wait was around an hour the interview was okay the interviewer was really nice. First thing he asked me if your spouse is here with me today I said no, I didn’t knew he was allowed to be here (nowhere in the interview schedule notice saids to bring your spouse and more with covid restriction) I asked is it a requirement to he to be here? and he didn’t gave me a yes but he said just because your conditional status was not removed them I said my spouse is in the parking lot I can call him so he can get in, he said no is fine let’s get the citizenship process done first. We started the English and US history and government test, the officer asked me to write a sentence, and read out loud another sentence, asked me 6 questions I answered correctly he said good job and he proceed, unfortunately the server was down in his computer and he couldn’t have access to my documents, he asked me if I upload my taxes I said yes and he asked me if I have them with me and I didn’t so he gave me the Naturalization Interview Results I passed the exam but B) A DECISION CANNOT YET BE MADE ABOUT YOUR APPLICATION Because he needs to see my taxes… I feel so annoyed I took off a day off from work and drove 1 hour and because their server was down a decision cannot yet be made… The officer said that everything was fine and there’s nothing to worry about but I will get a notification by mail about an update but all know how long that takes… I will appreciate any guidance on this situation, thank you and good luck.
  10. Hi everyone hope all is well. I'm helping my mil to file her N400 online. I have a question that I would like to hear your feedback. 1. She stayed out of the USA for 181 (existed us on 11 July 2021 & reentered on 8th January 2022) days on her last trip, she doesn't have no evidence to show that she didn't abandon her residency to USA. Has anyone had this issue? What was the outcome on the interview date? Attached are 2 pictures, one from uscis showing that she may not be eligible to apply and one showing that the 181 days is 5months 28 day. Please advise what's best to do. TIA to all
  11. Hi I am filling up my Form N-400. Under the "Time outside united states" I should say how many days did I spent outside United states for the past 5 years. Time line: Today is 2022--- 5 years back track will be from 2017-2021 I arrive in the USA sept 19, 2019. So does this means my answer should be 932 days since I was still living in the Philippines for more than 2 years in 2017 to sept of 2019. Any answers will be very helpful. Thank you so much
  12. Hi all, Didn't see a topic for N400 February 2022 filers so though will open one. Not sure if it will help or not since I would say the processing times will depend a lot on the local office.
  13. Hi everyone, My husband moved to the US on a K1 in October 2015. We married in November 2015 and immediately adjusted status. His Conditional Permanent Resident card was approved in April 2016. Conditions were removed in and approved in February 2019. on USICS’s website under am I eligible, it asks if you became a LPR (lawful) before April 2017 and then it’s the 5 year rule. My question is does the 5 year rule Apply to when you became a Conditional Resident or a Lawful resident? Or does it mean when you moved here? Thanks!
  14. I had my N-400 interview on December 16, 2021 and was recommended for approval. IO told me to expect the letter in the next 30 days. I understand Christmas delays the process a bit and that's why I waited for a few more days outside of the 30 days window. Is there a way to inquire about Oath Ceremony letter? Thank you.
  15. 2014-2022 Entered the US with J1 visa. Married to a US citizen. Got the conditional GC Marriage annulled by default, due to me not being present at the court for the verdict, and my ex’s accusations of infidelity in court… Moved on and married again. My wife and I are married for more than 3 years now. After the second marriage, I joined the US Navy. (Got discharged under honorable conditions) Applied for naturalization through the military. But my first application was denied; due to being on informal probation for DUI.🤦🏻‍♂️ While still on active duty, and after my probation terms have ended, I re-applied for naturalization! I passed the civics test, completed my interview and have been waiting for a decision for over a year now. My conditional green card through my first marriage has expired/got lost/terminated…I just have never been notified by the USCIS about it. Honestly, I’m just tired of this whole process…it is so frustrating and stressful to wait for a decision! It’s taking a huge toll on me and my health…I don’t remember how many times I called USCIS to get an update, but they don’t have any. I don’t even know what’s going on, or what my status currently is. I need help! I need to be able to travel and come back to US. I haven’t seen my family in 7 years now, and I need to be able to adjust my status, or get some type of documentation/stamp/visa/permit/card, ……anything! On top of that, my immigration attorney ghosted me. I haven’t been able to get any correspondence from her, or her law firm for 3-4 months now…I would appreciate any insight, advice and referrals. Thank you!
  16. I got an interview notice to show up for my interview. However, I get to the office, they call my name but I see "requested" written by my name. The agent indicates to me that my case file has been requested and is not at the field office hence they could not proceed with my N400 interview. I tried to get indication on next steps but all they said was it varys and I will receive another interview notice when they eventually get the file. My case status on the portal has not changed to reflect this and still reflects my case has been scheduled for interview. Has anyone encountered similar issues? I am freaking out. This occured in the Newark office. Thanks
  17. Hi Gurus, Probably this has been asked before. I wondered how accurate is the time estimation in the USCIS MyCase website about N-400 processing. It was showing 3 months left but then it was pushed back to 9 months suddenly last month. Is it possible that I got the interview invite letter for USCIS before the estimated time? Thanks
  18. Hi, I passed my naturalization test, in New York City, on June 2 2021 and I'm still waiting for the date of my oath ceremony. That's 7 months, when the documentation says it shouldn't take more than 30 days. I understand that these are extraordinary times, but I was wondering if anyone else has had as long a wait for theirs, or longer? Is there some way to find out how long you might be waiting? Thanks in advance.
  19. I had a minor traffic accident in 2016 where the other party was denied for personal injury claim by my insurance which resulted them to filing a civil case which was settled and dismissed in 2018. Therefore, I answered yes to question 23 of my n400 and my interview is on Monday. Now I am worried on what to say to the IO.
  20. Hi All Members, i need your help as i am confused to file for N400. The problem is my Address. Let me tell you in detail in 2018 i came to USA after getting married to a US Citizen. Since then i was living in a Joint Family. Back in Aug 2020 i have filled a I751 using the address we were living in. In Jully 2021 we moved to our own apartment in the same street and as i told you we were living in a joint family i didn’t change my Mail address. And in have never requested to USCIS to for the change of address as that address is like my 2nd home. Now i want to file N400 and i am confused with the addresses. If i use new address for N400 then there’ll confusion as i’ll be having two petitions and both have different addresses. Can i use my new address as my current address but old address as Mailing address? Would it fine? Please help. Thanks in Advance
  21. Hello, My fifth birthdate of my Green Card is coming soon, I will apply for N400. Due to my work condition I had to travel a lot out of the US for periods less than 6 months, so I did not break the 6 months rule. However, I have many trips of around 4-5 months periods and the total physical presence is just few days more than 30 months, will this affect my application in anyway? I know it should be ok, but I want to make sure if I am missing anything. Any hints on that please? Thanks
  22. Hi, As title says, I got they interview in a couple of hours. I became 26 before I became a resident however, I was 26 AFTER I applied to change my status from student to resident. I was I-485 pending status I guess. Any ways, so I registered for Selective Service during this time before I got issued a SSN and the proof of selective service has my name, DOB but not my SSN.. Now on SS website they can't find my record for obvious reasons, they don't have my SSN. Now was I supposed to register ? what to say when immigration officer ask about it? should I hand it or say I wasn't supposed to register because I became a resident after being 26??
  23. HI, So after a hectic week, I ended up filing my N400. Though biometrics were last taken in 2015, I got the reuse notice as well. Things appear to be in order for now. Will keep this thread current as it moves forward.
  24. Greetings, I am compiling N400 under a five-year rule. During 2020, I was absent for 205 days, hence, presumed to break in the continuity of residence that is required for naturalization. Law requires that in order to overcome this presumption of break, an applicant must provide a range of evidence to establish that they did not abandon their US residency during the absence from the US. Now that I am applying for N400 online, should I attach all the evidence along with the application or wait for them to ask for it?
  25. This is for those folks who applied during pandemic (mostly in 2020) and whose cases are stuck and not moving while those who applied in 2021 are already becoming citizens, I came across this post by @AH2020 in one of the threads and thought this would help if anyone is in the same situation The below was posted in the May 2000 thread and in the "Federal Records Center" thread. I just sent an email to Susan, we should all contact her. Anything she can do to get things moving would be fantastic. ----------- The law firm Mintz Levin is interested in talking with constituents about their naturalization applications that are not moving forward because the files are sitting at the Federal Records Center. If this is of interest to you, please reach out to Susan Cohen at SJCohen@mintz.com and title the subject line "Federal Record Center" in your email. Please know that this outreach will be at no cost to you and they will not provide legal advice. They are exploring how large an issue this is nationally so that they can address the situation head-on. ------------
