Our Story

  1. I had my N400 interview yesterday at the Dallas service center. The officer mentioned he did not have my removal of condition file but we proceeded with the N400. After successfully passing the N400, he handed me a form marked decision cannot be made now and explained it was because he had to approve the I-751 but he assured he was going to approve both. Both status are still the same, is it normal? Thanks!
  2. Hello Everyone. I’m planning on applying for citizenship by filing the N-400. I initially obtained a 2yearsGreen Card from a first marriage but got divorce and filed a i-751 as divorcee ( provided the divorce decree in the i751 and currently still pending…since 2019 🥵) I’m now eligible for citizenship. However, since I got married last year, I’m not sure if there is a different form « to update my marital status » or should I simply include that new marriage certificate in the n-400 with the old one + divorce papers, or shouldn’t I provide any of that…? I’m a bit/big confused! I appreciate your help. Thank you!
  3. Hello VJ community My wife had her interview today at USCIS and passed all the requirements. However she was not recommended for approval and he application was marked as: A decision cannot be made yet about your application on Form N-652. The immigration officer explained that her I-751 is still pending hence why they cannot recommend her for approval. She did her biometrics over a year ago and the I-751 processing time has been extended since there is a backlog of cases. Has this happened to anyone else? It seems a bit odd that they determine you are eligible to become a citizen but still want to go through the permanent resident process. Any information would be helpful. Thank you
  4. Starting this thread as I submitted my application this morning! I've been a LPR for 12 years but I was so unexcited about the idea of dealing with the USCIS again that I hadn't filed until now. Then time came to renew my green card and I thought, oh well, I might as well file my N-400 instead. What eventually convinced me is that citizenship applications are apparently processed much faster than I-90s! I'm the anxious kind and traveling around with an expired card and a piece of paper didn't sound great to me. Anyways, the online application was shockingly fast and easy. Now the waiting begins!
  5. Hello, I am stuck filling out the N400 online (under the 3 rear rule) on the question - [ Date your current spouse became a U.S. citizen? ]. My wife became a US Citizen through the naturalization of both her parents (Under the age of 18) and she doesn't know the date she became a USC. Her parents did not file N600 for her as they were probably unaware of that process! And applied for her passport based on her father's naturalization certificate. I red a few posts regarding this on VJ, but didn't get clarity on this. My confusion is what date should I put, and what evidence should I provide? 1) Date of her Passport? 2) Date of her father's Naturalization certificate? Thanks in advance for any help regarding this!
  6. I did my AOS based on my marriage to a US Citizen and got my two year GC in early 2021. I have been eligible to apply for N400 for a few weeks now while I wait for my 10 year GC to arrive (already have the 4 year extension to after removal of conditions). My wife and I are legally separated for almost a year. She ran off after I threatened to call the cops after continuous and regular domestic violence. She then filed for divorce on charges that were proved to be false during a hearing. She is telling our mutual friends that since I'm not a US citizen that I intend to run off with our child to another country (also untrue). I want to apply for my N400 to prove that I am not running away anywhere. Will USCIS accept my case instead of making me wait for the 5 year period?
  7. Hello again everyone, starting from January 2024 I can file the N400. However, the main concern in requesting the US citizenship or not, is the tax implications. I basically own an apartment in my country, which was purchased by my parents in 2014 and right after was donated to me. It has a certain value (range 500k to 1M $), hence I am afraid I have to pay high taxes on it. Btw, I am not getting any income from the property. My parents live there. Question is, if I decided to become a US citizen will I have to pay taxes on it? Or, since it was purchased before US neutralization and do not get income, should I be fine? thank you !
  8. Hello everyone, I am currently eligible to apply for my naturalization process. When I first moved to the United States, I initially lived with my in-laws for a month. Afterward, my family and I moved to our rented home, but I never officially updated my address with USCIS. Consequently, all my documents, including official communications, are still being delivered to my in-laws' address. Furthermore, my driving license displays my in-laws' address. The only document that reflects my current rented home address is my LLC, where I have mentioned it as my place of work since I work from home. I'm seeking advice on whether I should include my current home address on my N400 form or continue using my in-laws' address, given that we share the same zip code. If I do choose to mention my current address, I'm concerned it might raise a red flag with USCIS, as I haven't updated my address in three years, and it doesn't match my driver's license. Please advise on the best course of action.
  9. Hello, I have submitted my documents online for the n400 application. Long story short, I came to the US in 6/2020 and lived with my inlaws for a month before finding a place for me and my wife. We applied “married filing seperately” that year. Why? I really don’t know and neither my wife did but her parents said thats what we should do so we did (I barely knew anything regarding taxes at that time). I just checked the 2020 tax returns and found that the address on wife’s return is her parents address while my return shows our address that we moved to in 7/2020. Her W2 shows the correct address so I upload it too. Will that cause a problem? Our leese shows both our names in 2020, even bank statements.
  10. I am about to apply for citizenship, marriage based, we did our tax me and my wife together last 3 years using H&R block and randomly I was checking our account and I found that’s we gave a balance due to pay for IRS, However we already paid and done our tax with a professional agency. I m pretty sure H&R block miscalculate our tax. My question is do I need to fix that first and wait to apply for citizenship or I just send my tax return for 3 years, Since fixing that tax thing may take time
  11. Hi guys, I been stressing out for years. I was charged with possession of controlled substance. The case was dismissed VA 251 deferred disposition with a plea of not guilty. It’s been 5 years since the case was dismissed. Is it okay to happy for naturalization? That’s the only charge I have no other crimes expect small traffic tickets
  12. Hi all, I filed my i-751 a year ago and I'm preparing to apply for citizenship. We just found out that my attorney made a mistake on my I-751 form and had me as unemployed despite me being employed. Did anyone have a similar situation and how did you fix it ?
  13. I am in a strange predicament. We filed for my husband's removal of conditions in June 2020. Then last year in Nov 2022, we also filed the N-400. On October 11, we received the notice for an interview for both which is scheduled for Nov 15,2023. We have a trip planned to Mexico and Mexico doesn't accept the I-797 as a valid proof of residency. We were trying to get a Mexican Visitor Visa using my husband's Indian passport and all the supporting forms but the passport becomes invalid after the interview (if we take the oath the same day as it is an option). If we take the oath, we would have to apply for a US passport which definitely would not get here on time for our travel. If we delay the oath, do we get the 10 year green card pretty soon before our trip (scheduled for Dec 16,2023)? What else can we do? We really don't know what to do at this point and we really don't want to miss the trip to Mexico. Any suggestions would be appreciated please!!
  14. Hi, I submitted my N-400 around a week ago, and when I got to the following question, I answered NO: 19. Did you EVER receive any type of military, paramilitary (a group of people who act like a military group but are not part of the official military), or weapons training? Yesterday I completed a concealed weapons license class. Would this change my answer? I haven't actually submitted the paperwork to the state yet. If it does change it, how do I proceed? Thank you!
  15. Heya, Came upon another snag whilst filling out the N400 during the section about employment. I need additional paper but is there a specific template for this additional sheet? The instructions don't specify what it's supposed to look like or not look like.
  16. Hi, I have a simple question regarding the N400, part 10, item 3: "How many times have you been married? (including annulled marriages, marriages to other people, and marriages to the same person)?" I'm tripping over the tense used in that sentence and I've only been married to the one person and that is my current spouse (US citizen). I'm overthinking it and i don't know whether i should answer 1 or 0? Bit of the background; I'm planning to file the N400 under the 3 year rule.
  17. Hi all, I am wondering which case would be better when filing for N400 with a pending i751. Do I wait for my i751 to be approved first then apply for N400 or do I apply for n400 while my i751 is still pending ?
  18. Hello, I would be eligible based on (90 Day period) on Dec 1st, 2023 to apply for N400 (3 year Marriage eligibility). We have been staying in US for entire 3 year period. We will be traveling out of USA on vacation (visiting multiple counties ) from Nov 1st week and coming back on 1st week of Jan 2024. I have below questions and any help on those would mean a lot!. 1) Would I be able to apply right after we are back in US (Jan 1st week)? 2) Do I still qualify for 3 Months Residency period rule, as we will be out for 2 months right before applying \(We have been staying in same address for more then 4 years)? 3) If not, do i need to wait 3 months from Jan to apply for N400 ? 4) If the form is only and i am eligible in Dec, Could i still apply online when i am on vacation from out of USA ? Appreciate any feedback on these, thanks !
  19. I am curious if there is a minimum required advance notice that an applicant is entitled to before appearing to the interview? On a purely anecdotal level, I know that these notices usually come in 4-6 weeks in advance, but I am not sure what is legally mandated (if anything).
  20. The big day is coming up and I've been given conflicting advice about whether or not I should bring lawyer to my Naturalization interview. My case: • I'm a Canadian who entered on K1 visa, married promptly, and received my 2yr GC without issue. • My USC spouse became abusive/unfaithful/an addict. We divorced: I applied for ROC with a divorce waiver and was granted my 10yr GC without an interview. • I applied for naturalization under the 5yr rule. Many people on this site have been vocal that USCIS will go through your "entire immigration history" to make a decision on Naturalization, and given the way my USC marriage went I'm dreading the idea of having the IO dredge up/pick apart the details of my failed relationship. With this in mind, some have suggested I bring a lawyer so that the IO won't ask any off-color questions, etc. Others have said that since I applied under the 5yr rule that the details of my former marriage aren't necessarily relevant -- and that especially since I was given a 10yr GC without an interview, I already gave USCIS enough evidence to prove without a doubt in their mind that what happened-happened and won't need to get into it again. The details of my failed marriage are heavy - it was exceptionally traumatic, and needing to make a decision about this is causing me a lot of grief - so I may as well open it up to public discourse. ^^^ All of that said (and to benefit others considering legal assistance) what are good reasons to hire a lawyer to accompany you to the interview? Weigh in!
  21. Hi. For people who received their interview notice, about how long before the scheduled interview did you receive the notice? I am seeing that for people in my area (Los Angeles) people are having their interviews about 4 months after their biometrics, but I was wondering when they are receiving the notice for the interview, because this website does not record that. Thanks!
  22. Hi there! Back after a long absence... I have been eligible to apply for citizenship for years but couldn't find the motivation to deal with the USCIS again, lol! Anyways, I started my form online and it's asking me if I have USCIS Online Account Number. Did I not get one by creating the account necessary to file online? I can't find any number. The instructions say that it should be in the Profile section, but I don't see such a section?? I haven't dealt with the USCIS since my ROC in 2014 and apparently the online account I had back then didn't exist anymore, so I had to create a new one. Where do I find that number? Or do I not have one?? I want to be sure that I can follow my N-400 process online.
  23. My wife and I both got our interview notices in our portal on May 24 - over two weeks ago. We downloaded the PDFs and the mailing address is correct in both It's been two weeks of daily checking USPS informed delivery - no letter from USCIS at all. With the previous notices (after filing and for the biometrics appointments we got the physical copy within a week). Any idea what could have happened here? The interview is still over a month away, maybe there's a backlog in sending out mail on the USCIS side? Or did USPS lose them? (I'm planning to contact USCIS in about another two weeks once the 30 day window has passed) And presumably showing up with a printed copy of the interview notice is fine, right? I had to do this when I walked in for my GC biometrics, when USCIS wrote down the wrong city and state and called me up to ... an ASC in a different state, but a bit worried it's more serious for actual interviews. Thanks in advance!
  24. @Mike E mentioned that it's best to use the Employer address on the W-2. I'm also a remote worker and my working location is my home address. On the W-2, my company uses a PO box, but on the Form 1095-C, they use the street address of my company. Can I use the street address instead?
  25. Hi, I am eligible to file for citizenship under the 3 year rule with a pending 1-751 (since August 2022) and I wanted to check with others if my evidence list would be sufficient or if there would be anything else I should include in N400 application. I have recently filed 1040X with IRS to amend my status on the past 2 tax returns and I scanned a copy of the signed 1040X’s so I can include that in the evidence also. I was advised it could potentially take up to 20 weeks for IRS to complete amendments, so I was hoping I can send the proof of amendment in my application. Current list of evidence: -Marriage certificate -Copy of front and back of green card -Husband’s birth certificate -2022 tax transcript -Tax returns and 1040X amended forms for both 2021 and 2020 -Lease agreements for past 3 years -Renters insurance -Health insurance (for me and my husband through employer) -PDF document comprised of photos of us over the past 3 years, including with friends and family (with dates and locations) I have bank statements, internet bills, phone bills and utility statements that I can send if extra evidence is recommended, although I have them printed so I can bring them to the interview. Lastly, I worked remotely for most of the past 3 years and I was confused on the application question that requires the location we worked at for each employer. From my understanding, would it be best to include the employer address listed on my W2’s and specify in my job role that I was a remote worker?
