  1. Hi everyone, Me and my fiancé finally got married on March 18, 2023 on a K1 Visa. We are currently filling out forums I-485 and I-765. But cannot find clarity on how to mail them in (since we are mailing both forums together) and can't find the filing fees. If anyone has been through this process and can advise us where to look, etc. it would be greatly appreciated. We tried looking on the USCIS website but it wasn't giving us much information. Thank you in advance.
  2. Hi. I am wondering if it is ok to tick mark the P3 checklist and email it back to the consulate, even if I don’t physically have my fiancés i134 signed form yet? I have all of the documents ready, I am just waiting on physically having the i134 form with me right now… I will have it in 2 weeks from now. I just wanted to clarify if there is any issue with that or not? Thanks!
  3. Hi! For the new I-134 form, it asks to list Beneficiary Income and Assets. Question: Do I have to list this if I (petitioner) make the required income to support the beneficiary? My fiancé has a real estate holding that he makes passive income from, but isn't needed to help me support him. So is it relevant?? Screenshot for reference:
  4. Hello I was stuck in DS5535 AP since last 1.5 years for K1 visa (Montreal consulate) and finally on Dec 29th 2022 the Consulate requested new medical, passports and DS160 with updated pics. Sent everything by Jan 18th 2023 until now there have been 5 updates latest being on 28th Feb and the CEAC says "Refused". Now my Police certificate (RCMP) will be expiring on 17th March since they have a validity of 2 years. I am confused should I send the new RCMP check by Fedex proactively or wait for the Consulate to request a new one? It has been 8 weeks until now and they did not review a single medical file, I am worried if this Police certificate will give them 1 more excuse to delay my case 😞

Hello, sorry if I am posting this in the wrong part of the forum but I just need a little bit of insight from anybody who may have experienced the following RFE or know of a way to ensure that I can resolve this properly. I filed for divorce in the United Kingdom and it was granted back in March 2021. I received my Divorce Decree Absolute along with an email stating that the divorce has been finalised so I know this to be true. When sending the K1 visa application back in November of 2021 with my fiancée I included in the envelope a copy of my decree absolute to clearly show that I am divorced and free to remarry. The UK now sends these electronically to print off at home so am unsure as to whether or not this caused some confusion as to be fair the certificate does look rather lackluster. We received an RFE on the 6th of March with the following: "As evidence of the termination of the beneficiary's prior marriage, you submitted Decree absolute. The evidence is not sufficient because it is not a final divorce decree. - Submit proof of the legal termination of the marriage(s) of-" To be blunt I am Autistic so this has really thrown me off because that is exactly what I sent them? 😅 I am going to get it notorised tomorrow (the 15th) to be safe. I have also written a letter of statement explaining the divorce procedures and terminology here and printed off pages from gov.uk about divorce and highlighted sections where appropriate. Will this be sufficient? I just don't want to end up with a denial.
  6. Hello, I am rather new to this forum, and I hope I am doing this correctly. I am the U.S. Petitioner, and my Fiance is a Russian Citizen. We have received our NOA2 on the 31st of January 2023, and are awaiting the NVC to give us a case number. Due to the current situations in Russia, we decided it was best for my Fiance to move to Mexico, and live with some of my friends' family. We did this out of fear that the Russia would no longer allow their citizens to exit the country when they started conscripting their citizens to the war. She is currently in Mexico, on a 6 month tourist visa that will expire in the coming month. The problem is, that her tourist visa in Mexico is running out, and our immigration process is still months away from completion. We believe best option is to have her overstay her visa in Mexico, as the consequence for overstaying a Mexican visa is a small fee. We were thinking she could pay her fee for overstaying right before immigrating to the United States, but are worried this would cause an issue at the U.S. side of the border. Would the U.S. care that she overstayed her visa in another country?
  7. Hello! Quick question since our interview is coming up in April. My partner was born in Egypt but lives in the UK. She has her UK ACRO and police certificate/criminal record from Egypt as she lived there from 16-18. However the Egyptian police certificate was issued in 2021 and states on it that it's only valid for 3 months. However I read that foreign certificates are valid indefinitely as long as you haven't lived in the country since, which she hasn't, however she's been back for long vacations up to 6 weeks at a time. Does anyone know if those holidays count against her? Has anyone submitted an out of date foreign certificate before and how did it go? Thanks in advance!
  8. Hi everyone! Anyone here has any idea if I can travel back to the Philippines using my passport in my maiden name and my vaccination card in my married name. I know there is no problem with using the maiden name passport as long as I bring with me my married certificate and such. However, I have a friend who was recently divorced and she scrambled to get her vaccination card changed to her maiden name to match her new passport (back to her maiden name) few days before her travel because she got info that both documents must match. I think it's ridiculous, but how true is this??? I travelled to the US under K1 visa by the way, and is currently waiting for the removal of conditions adjudication. Thanks and I hope someone can help me clear this up.
  9. Oct 11 2022 I received a K1-FTP saying the consulate will contact me.. (haiti us embassy) it’s march 2023 already and I still havent received any email, mail or call I was told not to wait for k1 visa letter / instructions letter so I proceed with creating ds-160, payed with mrv slip and booked a schedule, but when I went to my medical, they’re asking for that letter.. Anybody here have the same case as mine? can you help with the steps I need to do next? Please
  10. We got married in 2021 on the K1 visa and now we want to file for the adjustment of status(I-485) ,I-765 , and I-131 but the problem is he worked and he’s the head of household. Also we filed our tax married-jointly this year. Will it affect the filing process? Do we need an attorney?

  12. Hello, I am filing for AOS for my husband which I brought to the US on K1 visa. I am trying to complete the I-864 as the sponsor. I have a question however, I just started working in January, this is my first job since my last one two years ago. My job from two years ago doesn’t meet the requirement, but my current job does. I make enough to sponsor him but I do not have any tax returns for this job since I just started. I have two or three pay stubs and that’s about all. Should I make a joint sponsor or can I be able to sponsor my husband with an employers letter and pay stubs plus whatever tax returns (which do not qualify) I had prior?
  13. Hello Everyone, I had a question about the Police Certificate requested by the embassy for the Visa interview. My fiancé and I met and lived in China for two years. Now we are getting ready for our Visa interview and we noticed that one of the required documents is a "Police certificates from all countries resided over one year since age 16". We were living in China when Covid hit, but luckily we were on vacation. We were unable to return to China and instead went back to our home countries. We've been trying for some time and we've not been able to obtain this Police Certificate. We tried calling a number given to us from the Chinese embassy in her home country. We also contacted a company that claims to be able to get it on our behalf, but also asks for documents that are no longer in our possession and that we are unable to get. My question is, what options do we have to fulfill this requirement? I've read that we should submit an a notarized affidavit explaining the situation, but I'm not sure if that will be enough. If anyone can provide any guidance or information we would greatly appreciate it. Thank you everyone!
  14. Hi everyone, our NOA2 approval is estimated to be any day now and we wanted to know if its possible to transfer our case to Mexico. We are living in Mexico City currently (I'm American, my fiancee is Russian). We aren't residents, but wanted to know the chances of getting the case transferred from the default location of Warsaw, Poland for Russian Citizens and what should we say the reasoning for the transfer request. (I was going to initially say the cost of flights, obtaining a Schengen visa, and travel time versus just going into our local Mexican US Embassy location). Thank you
  15. I am probably asking really stupid questions, but I want to make sure I do this properly so... HERE WE GO. 1. I'm filling for a fiancé visa, (K1). Question number 4 asks if I'm filing for fiancé or spouse. I chose fiancé. Question number 5 asks if I am filing for a spouse if I have filled out form I-130. Do I skip this question or type no? 2. My fiancé is from Argentina. He only has had one under the table job (which he quit a year ago because the man who hired him failed to train him some important things about the job and would abandon him and he'd be left alone to try and figure it out without training). He's been studying on and off trying to figure out what to do. I put that job down, but will not having a job cause problems? I know it's best to be honest on the visa.... 3. If no landline/daytime phone, use mobile phone in that place? Or just mobile phone number where it asks for mobile. 4. Part 4 (Other information about crimes). I have not committed any crime. So for P3 5.d I put "Not Applicable, beneficiary is my spouse or I am not a multiple filer?" Is this correct? 5. For questions about address, work, children, I put N/A for non-applicable on these extras (If I only have one)? or leave blank. I know there are things I put as non-applicable but I'm not sure WHAT specific things need or don't need. 6. For questions that say "If yes (on question above), please provide information..." If I select "No" do I write N/A or leave blank? Examples: IMB section, other information (about criminal record), If you have children, or your fiancé has children. 7. "If your fiancé is currently in the united states complete the following questions.." He is not, but should I still put his passport number and expiration or write N/A or leave blank? 8. Working dates. For my present LIVING LOCATION and JOB, you put the first one. They say to write MM/DD/YYYY. But if I'm working and or living there presently can I just write PRESENT? 9. Interpreter and Preparer sections: Leave blank, or write N/A? Sorry if these sound stupid. Paperwork stresses me out and I understand best when I talk to actual people than reading.
  16. We were notified that our approved K1 petition/case was sent to the Embassy in Rio de Janeiro, Brazil by the NVC on Feb 14th and our case status changed to ready the 15th. I emailed the consulate to see how long it would take to receive the email with the instructions (packet 3) and they replied that it could take up to 3 weeks for them to receive the case and send that email. I did the DHL hack and I'm pretty sure our case has been received by the Rio Embassy, but we haven't received the email yet. My questions are: 1. How long does it usually take to get this email for everyone else now-a-days, and do you even receive it? 2. I've been told we will need it for the medical exam and the interview, is this true? 3. Also, we went ahead and scheduled my fiance's interview as per the advice on one of these forum topics, so if we don't receive the letter by the appointment date, will we have to cancel the appointment?   17. Hello! These groups have been really helpful throughout our K1 process so I want you thank you all advance! We're almost ready to submit our DS-160 but I have a bunch of questions that came up during the process. Some may be silly but we just want to be diligent. I understand it's a lot but any answers are appreciated!🙂 1.) First off, our NOA2 has just expired about a week ago - we were busy gathering documents and waiting for the NVC welcome packet that never came (which we just realized not everyone gets). Our case is "Ready" according to the NVC site. I reached out to the embassy but haven't heard back - do you know if it'll automatically be reinstated/extended? 2.) I just want to clarify that when the DS-160 asks for Petition number, it's the USCIS receipt number starting with WAC and NOT the NVC case number starting with LDN. 3.) When they ask if I used any other email addresses in the last 5 years, should I include my work one or no? 4.) The question regarding any other relatives (aside from immediate family) in the US - should I answer yes if they're my 2nd cousins? 5.) Employment information - I put my current job but I've been there for over 5 years (12 years in total) so when they asked for previous employment over the last 5 years, I filled out my current job information however they would like an end date - there is not "current" or "until present" option to choose. Does anyone know if there's a workaround for this? Should I just put the employment I was in before my current employer, i.e in 2011? 6) They worded the next questions in a way that tripped us up a bit - they said if we answer yes to any of the following questions we may risk additional screening but the last question was "do you have documentation that proves your vaccinations in accordance with the US law?" to which I've said YES. Just want to make sure this is okay and that I haven't misunderstood the question? 7) Am I supposed to register with a courier service on a separate website when I book my appointment? I read this somewhere a while back but haven't come across anything recently. Or will I just be redirected to the payment page once I click submit on my DS160 and book my appointment? 8.) Also on that note, for payment of the actual application fees, I'm assuming (as above) we pay once we submit the form/schedule the interview, is that correct? Or should I be paying the application fees elsewhere separately? And are there any other fees I need to be aware of (aside from the medical costs)? 10.) My last dose of the Hep B shot will be April 6th. If I show proof of that at the medical, would I still be able to go ahead with the medical before I receive that last dose? 9) for documents required for the medical: If I never had TB, do I still need to provide documentation saying I haven't? 10) How can I leave the country before my permanent residency is granted? My brother is due to get married in Egypt towards the end of this year and I'm already super worried and stressing about missing it as he's my best friend. Has anyone left the country after getting married but while still waiting for adjustment of status, and if so, would you mind sharing your experience? For example, is there a form I have to submit every time I want to leave? How long is it valid for? How likely is it to get approved? Etc. Thanks again so much and sorry about the length of this!   19. Hello me and my fiancé had an interview Jan 27th 2023. Great interview approved on the spot. On CEAC it changed immediately to "approved" on Feb 13th we called to ask about the visa. My fiancé received a email and a phone call requesting for me and him to go back on the 13th to finalize the interview. Due to the short noticed I was unable to go, I sent a letter explaining, he went to the interview by himself. They interviewed him for 15 min in a private room and informed him they will inform via email if they will grant him a visa or not. They did stay with his passport from the first interview. Yesterday on ceac it shows as non immigrant and refused. Any advice?? This process is really stressful
  20. Hello everyone! Earlier last year, I dropped down to a per diem position at my 12-year-old job to work at another full-time contract job that paid significantly more. After the contract was ended, I applied for another contract job, but nothing was available anymore. I was able to keep my employment at my old job by picking up the required shift. By the end of last year, I was back working full-time hours at my old job, still as a per diem employee. After getting our NOA2, I knew that I needed a permanent job soon in order to provide proof of a stable income. I am planning on taking a part-time position at my old job due to the fact that I will be able to earn more this way. My position would be part-time, but I will be picking up full-time hours plus OT. I also get health insurance benefits for being a part-time employee. But I am worried that we might end up being asked for a co-sponsor because of my part-time position. I'm already close to meeting the 100% poverty guidelines this year for a two-person household, and I'm above the 125% poverty guidelines from the last 3 years. I am confident that I will be over the 125% poverty guidelines this year too. Being employed by the company for the last 12 years should also be good enough proof that I did have a stable income. I have been working more than my full-time hours on this job for years, and I plan to keep doing it. I spoke to my manager, and she said that she would even write a statement for me saying that I do work full-time hours as a part-time employee. I have yet to talk to HR about the employment letter and am hoping they'll also make the same statement. Of course, I would be providing a current six-month paystub for the interview day. I've never been married and have no children. It's only going to be me and my fiancée. Does the petitioner really required to have a full-time job position? What is everyone's opinion on this?
  21. Hello everyone, I hope this is the right section, if not my apologies! I am writing today regarding a RFE for my I-693. The note says: Submit a completed Form I-693, Report of Medical Examination and Vaccination Record. The medical that you submitted to the consulate was signed by the physician more then 1 year from when you submitted form I-485, therefore you must submit form I-693. A USCIS civil surgeon must complete and sign the form, and you must also sign the form. If the civil surgeon refers you to a specialist, the specialist must include his or her medical exam results and complete the proper sections of the Form I-693 before the civil surgeon may sign the form. Once everyone has signed, the civil surgeon will place the completed Form I-693 in a sealed envelope and give it to you. You must submit the sealed envelope containing the original Form I-693 that the civil surgeon signed and the medical exam results; we will NOT accept photocopied Form I-693 and medical exam results. Civil surgeons must use the current Edition of Form I-693. You can find the current edition of Form I-693 on USCIS’s website at www.uscis.gov. In addition, the civil surgeon must ensure that all parts of Form I-693 were properly completed. Please Note: All Forms I-693 signed by civil surgeons on or after October 5, 2022 must use the 07/19/2022 edition of Form I-693. USCIS will not accept the 09/13/2021 version (or any previous editions) if the civil surgeon signed the Form I-693 after October 4, 2022. Therefore, the civil surgeon administering your immigration medical examination must complete and sign the 07/19/2022 edition of the Form I-693. I was surprised to receive this note for the following reasons: 1. My physician signed the I-693 on 6/29/21 and I submitted form I-485 on 12/21/21, only 6 months after and not more than 1 year later as stated in the RFE 2. In addition, the USCIS website states that I-693 is valid for 2 years, from the website: We generally consider a completed Form I-693 to remain valid for two years after the date the civil surgeon signed Form I-693 (https://www.uscis.gov/i-693) 3. Moreover, the same website states: From Dec. 9, 2021 until Mar. 31, 2023, we are temporarily waiving the requirement that the civil surgeon’s signature be dated no more than 60 days before you file Form I-485. Should I still book another appointment for I-693 or talk to a lawyer? I feel overwhelmed by this never-ending process and would appreciate your thoughts on this. Thank you.
  22. Hello! I was wondering if there is a difference in wait times between K1 & marriage based applications specifically for Kenya. Are we sharing the wait time? Or does K1 usually have to keep searching to pick the next available time? I’ve been told both things.
  23. Hi, new member here. My fiance is Thai but lives and holds residency in the Faroe Islands. Faroe is an autonomous region within the Kingdom of Denmark however it not part of the EU. She has to get a Schengen Visa to travel to anywhere in Europe including Copenhagen where the US and Thai embassies are located. We are both in our 60's so naturally want to be together as much as possible and a delay in getting a GC for work purposes is not a problem. From reading on this site the current wait times between K1 and CR1 seem about the same and most suggest the CR1. I can travel to her and get married but it will probably be a couple of months to arrange that. Of course I can start the K1 process now. She also has a B2 visa for the US as of last year and visited here last year for the first time. She has no family in Faroe but she has 2 adult children and grand children in the US. I feel like once we start the visa process she will not be able to travel to the US because of strong ties here and very weak ties in Faroe. As with most people on here we just want to be together. Any insight or suggestions are appreciated.
  24. Hi Does anyone know if there is a particular order in which i should have my k1 interview documents in, ready to hand over when i get to Sydney consulate? If anyone has had a recent interview with the latest procedures or information that is helping would be appreciated. Also does anyone know what the A number is to write on the back of the 2 passport photos? The ds160 confirmation number is AA, so not sure where to find the A number, its not on my NOA2 or k1-FTP Thanks
