  2. Hi guy June 5th my K1 petition got approved and i received the NOA2 June 11th, are me and my partner right in thinking that we now need to wait for the NVC to send us our case number? We are getting a little concerned about not receiving or heard anything from them yet and i want to get on with filling out my DS-160 which i cannot do without the case number. I have looked around the site for info on this but there appears to be quite outdated/conflicting information. Does anyone know anything from recent history about this section of the process? Thanks in advance guys. Ps. We are using the UK embassy if that changes anything
  3. Hello, We're getting ready to submit our AOS paperwork however even after thoroughly reading the instruction pages, we still wanted to double check/clarify a few things. Any input on any of the questions would be highly appreciated! On the I-485 AOS form, I just want to confirm that the K1 visa IS subject to the public charge ground of inadmissibility under INA section 212(a)(4) - (pt. 8 #61). I believe I choose yes which then brings me to #62. #62 - I am using my brother as a joint sponsor for my wife's petition since I don't have an income however my brother and I don't live together - would he still be considered in our household? #63 - Do I include his full income in our annual household income? #64 - Should we share my wife's savings account information as an asset (do we provide bank statement as proof?) #65 - would car insurance be considered a liability? We're living rent free with my cousin for now so we're unsure whether to include any liabilities On form I-864 Affidavit of Support, (pt. 7 #6- use of assets to supplement income) Should I add my wife's checking/savings info when it asks "Assets of the principle sponsored immigrant?" For reference, my brother as a joint sponsor will be filling out his own I-864 so he wouldn't need to fill this part out being that he exceeds the federal poverty guideline, however I will add my minimal assets, but I'm wondering if I should add my wife's savings account to both our I-864 forms. I don't believe I need the I-765 worksheet for K1 family visa however I wanted to verify that as well. Thank you in advance and good luck everyone!!!
  4. Hello everyone I arrived in the US on a K1 visa on 5/15 and married my fiancé on 6/23 we are organizing all the AOS paperwork to send it in the next few weeks. My fiancé was just offered a promotion at a new company and would start in 1 month from now if he accepts (at both his current and new job he would earn above +125% of the poverty line). - Do you guys think it can be a problem that it is a new job? - Is it better to send the i-864 with the information about his new job or send the i-864 with his current job? - What kind of evidence can we include? We can get a letter of employment but we would have at most 1 paystub from his new job, we also have the tax transcript for the last 3 years. Thank you very much.

  6. Hello, I have a quick question - my wife is filing for her AOS and we're a bit confused with the I-864 forms. I have been unemployed for a few years so we're getting my brother to sponsor her. Since I am the one who petioned and brought her here, I thought I still had to sponsor her and fill out I-864, and my brother would fill out I-864a as a household member. However in part 1, question #1 of I-864 it asks if "I am the petitioner. I filed or am filing for the immigration of my relative" (1a) which I assumed was the correct box to check off, but I see there's an option to check "second of two joint sponsors" (1e). -Does anyone know which one would be the correct one? And if my brother would need to fill out I-864 or I-864a? I really appreciate your help in advance and good luck to everyone with their journey!
  7. Hello, I am the petitioner for my fiance k1 visa and we have an Interview appointment at the Guangzhou Embassy in August. We submitted the Ds-160 a month ago. Due to unfortunate situation I've had to change my permanent address. I've moved to a new house in the same town. My affidavit of support will contain my new address. The DS-160 has my old address. Do I need to update the DS-160, submit, print the confirmation and send again? -Matt
  8. Hello! I'm wondering if there's any K1 beneficiary here from Brazil that instead of going through the medical exam in Rio, chose to do it in São Paulo? What was your experience? Can all the exams and the medical appointment be made in a single day contrary to Rio that asks for the exams beforehand? And how long does the doctor take to send the results to the embassy in Rio? Do we need to go back to the doctor's office and retrieve anything to take with us for the interview? I ask because I'm closer to São Paulo so it would save me time and money to go through it there instead of Rio. I searched VJ and only found one person that did that, but it was for EB-2 visa. I wonder if it's the same for São Paulo. I also already emailed the SP doctor to ask, just waiting on a reply. Thank you!
  9. Hello everyone, Recently had our interview and were given a 221g to submit a document and the passport. We've since sent the document and the passport to the consulate (and it has been received by them) Any idea on how long they usually take to process? And where we could track this? We don't want to be waiting for months as we've given the passport alongside the document that was requested. Any help is appreciated. Thanks!
  10. Hi All, I'm filling out the I-134 for the K! Visa's affidavit of support, and when it comes to the income section for the sponsor on page 6, #14 -- https://www.uscis.gov/sites/default/files/document/forms/i-134.pdf, I'm trying to figure out what the correct information is to put in. For example, I assume it's asking for my current income, but I'm not sure how to distinguish that from the money that I'd be giving to the beneficiary. For example, let's say my full income were $100,000. Would I say: Full Name (Sponsor) - Date of Birth - Self - $80,000. Full Name (Sponsor) - Date of Birth - Self - Income Contribution to Beneficiary - $20,000 then for total income, at the bottom, write $100,000? Thanks!

  13. We will be using a joint sponsor for our k1 visa. We sent in the k1 packet early may but we didn't include form i-864. If we are not meeting the income requirements will will we get denied on the NOA2? Should we send in the joint sponsorship form now?

  15. i got NOA2 at MAR 15th and i send to mail at MAY 9 to NVC to want to know my NVC case nnumber and they replied at MAY 13th they said The National Visa Center (NVC) recently received your immigrant visa petition from U.S. Citizenship and Immigration Services (USCIS). Your petition is now waiting for data entry into our systems. and i send mail again i got reply at MAY 18 they said The National Visa Center (NVC) is unable to assist you with your inquiry.   16. We are an engaged Canadian and American who want to get married, obtain a spousal visa, and live together in the USA. We have a lot of flexibility in our lives for travel and want to be together as much as possible during the 1.5 to 2yr visa process. We are considering the following timeline and would greatly appreciate any advice about possible issues, hurdles, and/or other considerations. We get married in Fall 2023 in Canada, spouse then enters USA on tourist visa (as a tourist) for 6 months. Spouse stays at National's owned-home in those months and returns to Canada in early spring 2024. At which point National files for spousal visa and leaves for Canada for the summer, and Europe for the fall - winter- spring while the visa process runs its course. Spouse returns to Canada for visa interview at Consulate in Canada when requested Any experiences with: filing for spousal visa 6-7 months after marriage in Canada? is that enough of a marriage duration? National leaving the US during visa process? Spouse coming in to the US on a tourist visa while married to a national?   17. Hello again! This may sound dumb since there's so much information to help here, but still I feel better asking directly. So we just received an RFE for my wife's I-693, but we already have the medical exam paperwork from the Philippines, her D-3025. There's an option to upload her record to her USCIS account, would that fulfill the RFE? She took her medical exam on 7/5/2022 and she arrived here on 8/29/2022, we turned in her I-485 on 11/28/22.
  18. I’m a k1 holder and I’m in the US. I married my spouse within the 90 days. My lawyer filed concurrent i-485 with “ I-130 “ In addition to i-765 and i-131. I saw people posting that k1 holders don’t need to file i-130. My pd is March, 31. My status is “ Case was received and a receipt notice was sent “. I don’t prefer withdrawing the process and wait again. I didn’t even have my work permit. What do you think guys ? I called my lawyer and they said they know how things work and just relax!

I didn't think this would be an issue but I've been hearing from someone with experience on the matter that if my fiancée says that she's unemployed during the interview process, they're likely to immediately reject it as its "the worst way to answer that question". I'm skeptical because I'm seeing people here on forums saying the opposite and it also just doesn't make any sense to reject a k1 visa for that. Like if you're going to a different country you'd have to quit that job and start from scratch anyway, so what does it matter if you have a job or not? She does have a non profit organization that she co founded, I feel like that should be enough of an answer if they ask, right? This non profit work is also documented on her ds-160 and our i-129f. So, is this a non issue?

  21. I see websites (Boundless) say that the U.S. citizen sponsor must 100% meet the income requirements for a K-1 visa as a minimum, while it's 125% for the Form I-864 AOS. I am confused though because another website (VisaNation) says it should be 125%, and that the 100% only applies to active duty members of the Armed Forces. If ever the 125% does need to be met by a k1 visa sponsor, can the beneficiary combine her income (I work as a freelancer, and I earn around $1.8k a month) to her sponsor's? My sponsor at the moment can only meet around 105% of the HHS Poverty Guideline.

  23. Hi everyone! My girlfriend and I met while on a trip. We exchanged numbers we were purely friends then. She went back to her country, and I came back to US. We kept talking as friends and as usually things goes, we planned a trip to see each other for 2 weeks, we did and it was amazing and all great. Because we have been talking for so long and also because we are already planning another trip to see each other and be together, we also discussed the K1 possibility since we do want to be together. I have not proposed yet, and I completely understand the whole K1 process and it's requirements. However one thing stood up to me, do I need to be engaged to her before starting the process? Can I start the process, get engaged, then marry as soon as she come? I have evidence of our intentions, due to chats, and also photos of us together since we were a relationship pretty much from day 1 since we just clicked. Will have even more photos on the second trip but that is like 2 months from now. In essence, any issues I submit now and don't have specific wedding plans or are not engaged yet? Even though I do plan on getting engaged with her.
  24. Hello Everyone, new to the forum! I was wondering, USCIS has varying wait times for Visa processing centers (K1), for example Texas and California have 16.5 months wait time as of now. However Vermont for example has 5, and Potomac 14 I think. Obviously we all want our cases to be approved and followed as fast as possible. But is there even a way to decide where does your application go to? For example I do not mind traveling to Vermont for 1 or 2 days just to submit my application there. (I live in FL). Or can you specify so in Form 129F? I understand patience is key and part of the process, but it just feels so off that processing centers have such a varying degree of wait times. Thanks in advance!
  25. Hey all, sorry if this is something that has already been answered but as always i find conflicting information. Are vaccinations mandatory prior to the issuance of a K1 Visa or are they something that can be done before AOS and once in the US? Thanks in advance!
