  1. I had filed my application on 12/15/2022, but due to having two expired forms, the USCIS sent it back to me. Now I found out they released a new form I-485 with this question about Public charge. It is my understanding that since I'm applying as a immediate relative (U.S. Citizen spouse), I would indeed be subject to the Public charge ruling. This is making me really scared since I have a joint sponsor. My question would be how is this affecting applicants from inside the United states? Has anybody heard of marriage green card applicants (AOS) being denied during the interview part? I have been working and supporting myself for the past 6 years in the USA, never used any type of benefits and never even been to a Hospital.

Hi all, I am submitting my green card application (i-485) and there was a question "have you ever been denied visa previously" I was denied tourist visa before, basically nothing wrong with my paperwork, the interviewers at the embassy are just [censored] (I wish them the worst of luck. super rude [censored]) I was given a generic letter "you dont demonstrate enough ties to your home country" and I was stunned My question is: does a history of rejected tourist visa going to hurt my chances or make it slower/longer process in order for me to get the green card? Thank you
  3. Hi, i just received our rejection notice for my green card application. I applied for a concurrent filing i-130 and i-485 (from tourist visa). It was rejected due to missing one page. Which is i completely sure i submitted all pages and the missing one page is the page 16 of i-485 where i signed. All documents submitted were returned with their initials and barcode st the bottom of each documents. My question is do i need to print all forms and supporting documents? Or only the i-485 which is they told me there is missing page. And when i checked the updated forms online the i-765 and i-131 has oct 31, 2022 edition. My i-765 form is july 2022 edition but valid til jan 2023. So im confused if i need to reprint it again with the new edition. i hope someone can help me with my inquiries thank you
  4. Hi there, I'm writing here with hope to have some similar experience, or some advice. To make the long story short: I was sponsored by my work for the green card process and my husband is my dependent. We were waiting for our final interview when USCIS denied my I-485 (late January 2022), which led to the denial of my spouse (dependent i-485). Turns out we got denied by mistake and with the help of our lawyer, we filed for a motion to reopen my case. My case got approved and I received a green card in less than a week in my mailbox. But, here's my problem, my husband still haven't received his green card. His status was still denied until August 2022!!! And now has a "case reopened" status. I tried to call a billion times USCIS and I got told my husband's case is outside of normal processing time (no ). But there's just nothing else to do but wait. I started the process of the green card in January 2019. So it will almost be 4 years. Neither me, or my husband, have been able to travel back to our home country to see our family because of this process. I don't mind waiting a little longer but we're just left in the blur, without even a time frame. How long do we have to wait for his approval? There's literally nothing to do on our case, but approving it. How come this takes ages??!!
  5. My wife and I are a lesbian couple. We sent her AOS forms in late March, and she did the biometrics the following month of this year. We just checked the USCIS on the status of her case today, and it says "request for initial evidence." They're requesting our marriage certificate. Did the USCIS actually lose our marriage certificate carelessly, or are they being stricter with us because we're homosexuals? We don't mind mailing or scanning the certificate, but it leaves an uncomfortable feeling right now. 😔 My wife and I are dealing with my mother who is becoming more physically and mentally ill these past several months, and even 911 couldn't take my mother to a hospital a few days ago. My wife and I need something good to happen in our life right now, and we're losing a lot of hope on things.

  7. Hello! Im about to file i824 for my parents. I filed i130 and was approved but missed the portion of where to file. I saw the screenshot of where to file on this thread with IOE receipt number. Did that change? It says on uscis "where to file i824 with ioe" is send to Phoenix Lockbox.
  8. Our case is I-485(AOS) family-based, was submitted in June 2022 together with I-864 affidavit of support. The questions: my wife (the petitioner and the sponsor) wants to quit her job, and do not work for a about 6-12months while we are waiting for the interview invitation. Can this negatively affect our interview and our case? Do they ask for any documents regarding the current income and active job on interview? All was fine for the moment of our application, but is the sponsor expected to maintain her sufficient income during the whole processing time (which is around 20months for our field office)? Details: My wife, LPR, is the only sponsor. She has been working in USA for more than 2 years, having a decent annual salary that is several times higher than the poverty guideline. For the form I-864 she showed with her tax report this decent situation for the year 2021. We estimated, that even if she quits right now in September, her income for this year 2022 is far above the guideline. She wants to quit and do not plan to work for about a 6-12months, because she wants to sit with our 6m old baby. Our family can live on her savings for about the same amount of time. I am ready to start the work as soon as I got the work permit (but still waiting). I am highly grateful for any answers and suggestions.
  9. Hi everyone. I received a generic RFE requesting a new I-864 based on the I-485 forms I applied for my parents. To give a background, I'm currently a full-time student and my income is $0. So previously, I submitted the I-864 forms for my parents with an I-864A, which showed my father's foreign assets since he doesn't have an income either as he's retired. The number was well above 5 times the 125% of I-864P, alongside supporting documents like property documents, appraisals, etc. Not to mention, I last filed my taxes in the year 2020, and I didn't file taxes afterwards since I was out of the states + my income was well below the required minimum to file. What I do know I did wrong was I put my household size as "3", including myself, my parents, in each form, when I should have put 2 instead. I'm not sure whether it's the fact that the immigration officer has a hard time being convinced that the assets are liquidated easily given it's from a foreign country, or something related to the cash limit of the originating nation. Or whether it's just some typos, as it's a very generic RFE which you can see attached below. I'm considering finding a joint sponsor to make things easier and smoother, as a more concrete proof of income, but I'd like to avoid that since most people aren't willing to do so. If possible, I'd like to show that my household has enough money in the form of assets to not require a co-sponsor which we do, but I don't know whether I should submit more proofs like county tax assessments of the properties and assets, or just find a joint sponsor altogether somehow. Also, if I were to go to a lawyer, can anyone give an estimation of how much the expenses would be to go through this RFE and whether the lawyer would act as a joint sponsor if given money?   10. Hi guys! I am getting ready to send my AOS, and still not sure for this question - WHAT IS YOUR CURRENT IMMIGRATION STATUS OR CATEGORY? This question is on Form I-765, and I-485! Looking for an answer for a long time, and until now get so many different answers and options , not sure what to do! I got married on my last day of Visa Waiver Program (ESTA), so is my status now : OUT OF STATUS (because my visa expired, even though I got married before that) or VISA WAIVER PROGRAM EXPIRED - PENDING I-130 , or IMMEDIATE RELATIVE- SPOUSE OF THE US CITIZEN ? I am struggling with how long the process is taking and have heard people in other states get their interviews for the GC waived, so am trying to work out what to do, if there is a massive backlog in NY, etc. Any advice would be appreciated!   12. Hi, our case was recently approved by the USCIS. But we don't know what next steps to do. This is their email to us: The above petition has been approved. However, you indicated on the petition that the beneficiary intends to apply for an immigrant visa abroad at a U.S. Embassy or a U.S. Consulate and will also apply for adjustment of status in the United States. Since you have indicated both options, USCIS has retained the petition. If the beneficiary intends to apply for adjustment of status in the United States, they should submit a copy of this notice, along with a Form I-485, Application to Register Permanent Residence or Adjust Status. They can obtain Form I-485 from the USCIS website at www.uscis.gov, by contacting the USCIS National Customer Service Center (NCSC) at 1-800-375-5283, or by visiting the local USCIS field office. Filing address information can be found on the USCIS website at www.uscis.gov. If the beneficiary decides to apply for an immigrant visa outside the United States based on this petition, you should file Form I-824, Application for Action on an Approved Application or Petition, to request that we send the petition to the U.S. Department of State National Visa Center (NVC). The NVC processes all approved immigrant visa petitions that require consular action. The NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition to that consulate. The NVC will contact the beneficiary of this petition with further information about immigrant visa processing steps. Me and my daughter are still in the Philippines and we've never to America. My husband is a green card holder. What's the next step that we should do? Should we file for the i-824, we're not sure if our case is also sent to the NVC. Hope you can help me. Thank you!

Hello AOS gurus, I'm following the visajourney timeline for K1 to AOS https://www.visajourney.com/guides/k1-fiance-visa-flowchart/ Since many of the AOS Field Offices processing times are over 2 years https://egov.uscis.gov/processing-times/ And if the interview date is after the 2-years of marriage from K-1 and AOS is approved, is the 10-year green card granted or the 2-year green card? If the 10-year green card is granted, then it would save a Removal Of Condition process, and we should be rooting for the AOS interview delays? Thanks for any responses.
  14. Hello! Hope you all are doing well and that I'm in the right section here. My parents recently filed the I-130 form for me (unmarried son, over 21 years old / F2B). Right now I'm living in Germany but I want to leave it in the end of the year and live as a perpetual traveler / digital nomad until I'm allowed to enter the US as a permanent resident. This means I won't stay longer than 180 days/year in the same country. Unfortunately my family and I are running into a problem. As we understand we have to immediately notify the USCIS when I as beneficiary relocate somewhere else. Since I will fully deregister myself from Germany and don't register somewhere else officially (like a normal relocation), we don't know what we should tell the USCIS to prevent the application getting cancelled. I won't obtain any special visas and travel only via normal tourist visa if that's important to know. I already thought about asking my sister here in Germany if she would be willing to let me user her address for this purpose but she declined. Also my parents and I are wondering if I can just tell the USCIS that I won't have a permanent address anymore but my parents (petitioners) address in Florida as contact address? Which consulate would be responsible for my case when I officially deregister from my home country? Does anyone know how I can handle this correctly? I'd be absolutely happy if someone can help me out since this topic gives me nightmares and absolute headache for weeks now. Thank you very much in advance!
  15. Hello all, I am in the process of applying for a green card through my US citizen. I had a question regarding the Report for Medical And Vaccination Record aka I-693. If I live in OH and apply for a green card from OH. Is it okay if I get my medical checkup from a different state? I have already sent my package that had I-130,I-485,I-765 and I-864 to the lockbox and plan to bring the I693 to the interview. Thanks in advance!
  16. Short summary, I came here on Visa waiver. Got married. Filed for adjustment of status with wife and MIL join sponsor. I was given an RFE for proof of status of the joint sponsor. We sent in her birth cert originally but it was old and the seal was impossible to see in the photocopy. Figured that might be why it was rejected. But it also has her maiden name listed on it and we filed with her current legal name, her married name. We ordered a new birth certificate and figured we'd send a copy of her marriage certificate along with it. Unfortunately I found out today, she's only listed as her maiden name on the marriage certificate and it doesn't mention the name change. It does show her husband listed with her new married name though, is that enough? I know we could file for a new passport and that would cover it but the evidence needs to be submitted by June 27th and her expired passport is a decade+ old so I think we'd need to go through the full new passport process. We're also moving and I have exams in June so we can't really add more to the plate. My core questions are: 1 - will a full birth certificate showing a seal be valid even though it shows her maiden name? 2 - if not will the marriage certificate with her maiden name but showing her husbands last name being the same as her current legal name be enough to prove her name changed? 3 - Am I worrying about nothing or should we expect it to be rejected? 4 - What is the process if it is rejected, will we get another RFE or should I prepare to file a motion to reopen with a different joint sponsor or even just refile? Thank you very much for any advice. This website has been a godsend throughout this whole process.
  17. Hello, a few weeks ago, I went to my local DMV to renew my ID with my new EAD card. Just like the first time, I needed to wait for a letter from the DPS stating my lawful presence had been verified by USCIS and come back to finalize the application. I finally received the letter but it says they verified my I-551 permanent resident card (green card) and that my lawful presence was verified. The problem is that I do not have a green card and applied with my EAD. All the other info on the letter is correct. One important note is that between applying for my ID and receiving this letter I got an update that my case was ready to be scheduled for the green card interview. Has this ever happened to anyone else? Any advice? thank you! ps: I tried calling USCIS but cannot get to a real person. I’m going to the DMV tomorrow.
  18. Hi everyone, We are preparing for our interview, which is scheduled on May 18. I know this has been discussed throughout VJ, but wanted to see if anyone who completed their interviews recently have encountered issues with your DS-3025 vaccination records, since the new COVID vaccine requirement was put in place? My husband was a K1 visa holder and had his medical done in Oct. 2019. We filed for AOS at the end of April 2020 - well before the medical's one-year mark. I know of an April filer who was asked to do a new medical despite meeting these same requirements, so I'm curious if anyone else was asked to do the same thing. Right now, we're just planning to bring my husband's DS-3025 and COVID vaccination card.
  19. Hi Everyone, We filed I-130 and I-485 together for green card for Spouse of US citizen in Sept 2021. Biometrics were taken in Oct 2021. I-485 is moving forward with status showing "case is actively being reviewed" while I-130 is still pending on "Just Received". It has been now 8 months for I-130 not moving and we tried to enquire about that and we were told that it is still in "pre-processing/background check" and that cases in this phase cannot be expedited. 1- Is this usual 2- Is there something we can do about that? Thank you
