  1. Hi, My spouse is a US citizen and we are planning to do the concurrent filing for my green card( Form I-130 and Form I-485. Applying for work and travel permit as well) . What is the current processing time for concurrent filing for marriage based green card? I am seeing different information on blogs. Some say its between 7 to 15 months, some say its 14 to 24 months and even more. Please advise.

  3. I have a question, I married my spouse in July 2021 and for reasons beyond our control, he returned to his country before the green card was finalized. Once he left I applied for a spousal visa which is now making its way through the NVC. If he is approved for his visa AFTER July 2023, that means we have been married over 2 years, though only living together 6 months. In any case, will he get a 2 year or 10 year green card? Thanks
  4. Hi everyone, I recently became an US citizen (2018) and my family is going to be migrating to the US. My parents are currently in line to get their I-130 processed (says 11 months). The plan is to move in about two years, after they wrap up all of their affairs (sell the house, store things, last 2 years of work before retirement, etc). Now here is my question. What would be the best way to get my brother over to the US? The sibling category is one of the lowest priorities, even for citizens. Should I wait for my parents to become a green card holder, and they apply for their son? Or should I apply for my brother directly? Any tips? if I go for option one, would it be an issues for my parents to apply for a green card for my brother while they still live abroad? (Netherlands) Thanks in advance, Bob
  5. Hello, I reside in Houston, TX. Fort bend county, and today my fiance and I went to our local county clerk to get our marriage certificate. I handed them my US passport along with my Fiance's Vietnam Passport, and they told me that they have to match the order of her name that is on her passport. So on our marriage certificate it shows her name in the following order (Middle Name, First Name, Last Name). Which is wrong. My name is shown in the correct order. They told me it has to be this way and that it can't be changed. I'm worried that we may have complications when we apply for ssn, greencard, us citizenship, buy a house, opening a joint bank account, etc that her name being in the wrong order will give us problems. Could someone please help me with this. I'm not sure if this is a normal thing and it can be somehow changed later and not to worry about it. Or is it something we must look into and get it resolved ASAP to avoid future complications? Any help is greatly appreciated.
  6. Hi, I filed a I-130 petition for both of my parents. Beneficiaries/parents arrived in the United States last week of March 2023. How long after arrival will the green card arrive? Will there be any fees that I will need to pay for their green card? They both have a "UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCE FOR 1 YEAR" on their passport. I also applied and paid the Immigrant Visa and Alien Registration Application (DS-260) and Affidavit of Support fees a couple of years ago. Thanks in advance to anyone who can help.
  7. Hi All, I wanted to know if anyone is going through the same situation my wife and I are. We had our GC Interview in San Francisco on February 2nd. Were told everything was good to go, except for the medical exam, which had to be resubmitted. Since COVID delays, my wife's medical exam had been done more than a year before the interview, and we received a RFE to complete an I-693. I found a certified Civil Surgeon, she went ahead and went through the entire process, the surgeon signed off on it and after a few days, we sent the signed/sealed packet to the address listed. The RFE deadline is May 4th and USCIS has still not "received" or updated her case. I have sent a few e-requests, which were answered with a generic response, and have actually spoken to live reps 3 times, all of whom did not give any specific info. but said they can send an internal request. The last rep. stated that there is an extension for the request, but I am not sure how concrete this info. is since it's not listed anywhere. Has anyone gone through this situation or is currently going through it? If so, mind sharing your experience, results, and maybe what to expect? Many thanks in advance!
  8. Hi, I'm a permanent resident of the US. My wife is Canadian (She’s born in Taiwan). We got married in the US last year, and our baby was born in the US last year, too. My wife entered the US with her Canadian passport every time, based on agreement between the US and Canada, she can stay up to 6 months per visit. Currently, my wife would like to apply for the green card. Based on our investigation, there are two options: Adjustment of Status and Consular Processing. Currently, we prefer Adjustment of Status since my wife can work in the US after getting the EAD card and the Advance Parole document can allow her to travel back to Canada. Consular processing does not support EAD card or travel document. If we choose Adjustment of Status, is it OK for my wife to stay in the US when the application is in pending status? (Our concern is that she entered the US with her Canadian passport, there is no valid visa) If we choose Consular Processing, can my wife enter the US when the application is still in pending status? We know it might take more than 1 year to get the marriage based green card approved nowadays, which one option will take shorter time? Thanks, Kevin
  9. Hi! My husband received his green card in 2011. We lived and worked in Germany 2015-2017( he applied for a re-entry permit), and we went back to the states. In June he was about to be laid off, but was offered a role in his home country. Myself and the kids joined him a few months later. We are about to do taxes and the 330 day residence test for foreign income exclusion, and he just had a panic that he should have filed for a re-entry permit. I think his fear is that the US government will think he’s abandoned residence in the USA. The thing is, we maintain a home and a mortgage payment in the USA, and all my family is there. His contract in the home country had a probation period and is not a permanent role. And furthermore we found out in December his employer is laying off 99% of their workforce, so we will likely return to the states near the end of the summer. Should he be worried? Is there much risk in this situation? Apologizes if I haven’t called out all these forms correctly, thank you
  10. Hello everyone so I’ve been a GC holder for over 15 years and travel many times a year for vacation (typically 1 to two weeks each time) and spending around 40 days outside the US per year. I am a remote worker and can work anywhere. That said I am looking to purchase a vacation property in Cancun and would like to enjoy time working there. I’m aware of the 6 month/180 day guidelines and over 1 year that being out that long could trigger inspection. Question is… what if I rotated my time between the US and a Mexico? I spend 1 month in US then 1.5 months in Mexico, then 1.5 months in the US then 1 month in Mexico. The idea is to keep the total days outside the US under 6 months but spend more time in the US during the year. Does anyone see this as being a problem? I have my entire immediate family here in the US. Bank, credit cards, memberships, pay taxes, car loan, and typical responsibilities of living in the US. As an aside, I recently withdrew my n400 app and aware that getting naturalized removes this issue. thank you!
  11. Hey, I just received and RFE from local FO saying "Submit evidence [my name] and [my wife's name] share a marital life together. It should cover the time period from [Marriage Date] to the present etc." But the thing is we have been married for over 2.5 years and also submitted bunch of evidence when we filed in December 2021, such as lease, credit card statement, bank account statement, renters insurance, photos, jointly filed tax return and such. So, I am not sure why would USCIS will need evidence from the day we got married rather than the day after we filed which was a year ago. Should I resubmit all the documents already sent again and just add updated bank statement and leases and stuff? Thanks for your help
  12. Hello, I am currently filing an I-90 for green card (AS7) renewal. My spouse got the asylum status, then helped me get the asylum visa, then I entered USA as a refugee's spouse, then lived in US for one year, then applied for the green card. Here is one question on the I-90 form: Did you enter the U.S. on an immigrant visa? Immigrant visas are processed and issued by U.S. consulates in foreign countries. If you have obtained a green card by applying for permanent resident status after entering the United States, you are not entering on an immigrant visa. I don't know how to answer that question. The asylum visa of a refugee's spouse is an immigrant visa or not?. Based on the explanation by USCIS, it seems that it is not. But I'm not 100% sure. Please help me!
  13. I have interview for Eb3 (AOS). I was on dependents of the worker’s visa! 3 years ago my spouse renewed his visa on the border and then his lawyer wanted to renew my visa also! My visa at that time was valid for at least 2 years! So she made a mistake and sent his old visa so because that my extension was not approved and then we filed again with his current visa! So I got my visa extension approval after that . When I filled the 485 I put answered no for the question “ Have you ever been rejected visa?”, because on that time the lawyer told me your visa extension was not approved not rejected and my original visa was valid,so I don’t know on interview when the officer asks me about this question what should I answer him?
  14. Hi, please don't judge me. It was a stupid honest mistake. Back when I was 22 i was approached by a guy in college and he asked me some questions.. its been more than 15 years ago (hard to remember what he asked/I dint paid attention to his questions).... back then I thought it was a poll questions regarding the college I was attending (that night it was cold, and windy and I was extremely exhausted and sleepy). All I remember that some of the questions were regarding my name, DOB, and address.... so, it turned out that he was filling out a voting registration form for me. I never never voted.... I did reached out the the county clerk and got everything cancelled. Currently, I'm a DACA recipient and I just got married to a US citizen. we want to file for the green card but I don't know if I should do it because of this stupid mistake. Did anyone went thru something similar? thank you all
  15. My wife and I were planning to go overseas for the holidays this year. We had to cancel the trip yesterday while we were at the airport because she had left her green card at home and we could not check her in for her flight. (She still has a Singapore passport and isn’t going to pursue U.S. citizenship.) Although we initially had the airline reschedule the trip to today, we ended up canceling the trip. Her green card has an expiration date of over a year ago (September 2021). The I-751 NOA, which we received in July 2021, says her conditional permanent residency is extended for 18 months from the date which is on the card (not the date which is on the NOA, so March 2023). She originally moved to the U.S. in November 2018 under the K-1 visa. Her original EAD/AP combo card expired in 2020. Two employees at the airline check-in, who are immigrants too, told us that the airports in Europe would not allow her to board the flight and she would be stuck in Europe. They also said the airline would be fined $15,000 for letting an “illegal” immigrant back into the U.S. After we found this thread, we were no longer confident that she could travel abroad even with the green card and the original of the NOA. If she is deported, that is a criminal offense which would kick her out of the U.S. and cancel her Australia permanent residency (which she also has). We want to move back to Australia, so a 10-day vacation to Europe is not worth the risk of losing that. So this raises several concerns for us (aside from trying to get a refund on our expensive travel)… USCIS processing times at YSC for I-751 are now 26 months. Our extension was only 18 months, and the USCIS case inquiry said we could not even ask them about the case until October 2023. How can my wife still legally be in the United States and be able to work while we are still waiting for USCIS? Why don’t the extension letters cover this entire lengthy processing time? We filed the correct papers and paid all of the fees… why would she be treated like an illegal immigrant? How do we get an extension that the airlines and customs people will actually, consistently, honor? With the documents we currently have, it’s luck of the draw and we can’t travel abroad without worrying about this. If she had a family emergency and had to go back to Singapore or Australia, how can she do even that travel without running the risk of not being let back in to the U.S.?

Hi all, I am submitting my green card application (i-485) and there was a question "have you ever been denied visa previously" I was denied tourist visa before, basically nothing wrong with my paperwork, the interviewers at the embassy are just [censored] (I wish them the worst of luck. super rude [censored]) I was given a generic letter "you dont demonstrate enough ties to your home country" and I was stunned My question is: does a history of rejected tourist visa going to hurt my chances or make it slower/longer process in order for me to get the green card? Thank you
  17. Is it necessary to buy a roundtrip ticket for the flight entering the US after the interview to obtain the green card? We, of course, only want a one way but I am not sure if there is a problem checking in for the flight in Ecuador when we don't technically get the green card until going through immigrations in the US.
  18. My mom is the petitioner her last name on her green card is ********y ends with Y where her last name on my passport my country wrote it ending with i like that ********i. Knowing that English is not my country language it’s written in another language too. Is that going to cause me any problems? Because I can’t change it and I can’t make a new one it’s impossible here.

  20. Hi there, I'm writing here with hope to have some similar experience, or some advice. To make the long story short: I was sponsored by my work for the green card process and my husband is my dependent. We were waiting for our final interview when USCIS denied my I-485 (late January 2022), which led to the denial of my spouse (dependent i-485). Turns out we got denied by mistake and with the help of our lawyer, we filed for a motion to reopen my case. My case got approved and I received a green card in less than a week in my mailbox. But, here's my problem, my husband still haven't received his green card. His status was still denied until August 2022!!! And now has a "case reopened" status. I tried to call a billion times USCIS and I got told my husband's case is outside of normal processing time (no ). But there's just nothing else to do but wait. I started the process of the green card in January 2019. So it will almost be 4 years. Neither me, or my husband, have been able to travel back to our home country to see our family because of this process. I don't mind waiting a little longer but we're just left in the blur, without even a time frame. How long do we have to wait for his approval? There's literally nothing to do on our case, but approving it. How come this takes ages??!!
  21. Hi Group Members, My spouse had H1B 3.5+ years ago. Her company is processing GC for her but it takes too long and the company still has not submitted PERM yet (her prevailing wage is still processing by DOL at Oct 2022), and we don't know when it has been done. Just scared in the WORST CASE that her company may be STOP the hold process because of the Economic depression, WHO KNOWS I am H4 and I want to apply for EB3. If I do so, does it affect anything to my spouse OR myself when 2 of us are applying for GC at the same time? My visa only has under 2.5 years so does it enough for EB3? Please share your experience and advice. Thank you.
  22. Hi everyone, I (petitioner) filed for my husband's CR-1 this past April so we are still waiting for I-130 to get approved. I started a job in April but the pay hasn't been very good and I am looking to switch jobs to one with better pay (way above the FPL). Will this affect our application when we get to the NVC stage? Or depending on the length of time between me starting a new higher paying job and the date we submit documents to NVC it will be alright? Basically, how many paystubs are needed from a current job at the NVC stage after your I-130 is approved? I have my tax returns for the past three years, but I made foreign income because I was living abroad. However, it was still technically above the FPL. Do you think I will probably need to get a joint sponsor in this case due to having foreign income from 2019-2021 and switching jobs in 2022 in the U.S.? My lawyer made it sound like getting a joint sponsor is a lot of work paperwork wise, but I do have someone I can ask to be a joint sponsor if necessary. Thank you for any help or suggestions!
  23. I'm currently living in Canada and am married to an American citizen. I'm thinking about applying for a marriage green card and was just wondering how long I have before I have to enter the US once the green card is issued. I've read that a green card holder can be out of the states no longer than one consecutive year before forfeiting their status, would the same apply in my case since I would be living in Canada when issued a green card, i.e. I have one year to the enter the US? Edit: not sure if this is the right forum, but my concern comes from how long I have to find employment, while still living in Canada, once issued the green card. I initially thought I could keep my current job and just work remote, in the US but I no longer see that as a viable option.
  24. Hello all, I recently filed the i751 packet, on the 29th of august. My greencard expires on november 10th, as does my drivers licence. Im wondering, has anyone had any issues with their employer, once the greencard expires? And can you get a new drivers licence from the dmv? My employer immediately required my greencard when my employment authorization card first expired, so assuming they need something when this greencard expires, is the acceptance letter, confirming the i751 is pending, enough? Also, will the dmv accept the noa and extend my drivers licence? I live in north carolina Any info is appreciated. Thanks guys
  25. My husband came to America on the k3 spouse visa 3 years ago from Dominican Republic. My husband received his permanent green card a month after he arrived. We plan to travel outside the country back to the DR, since he’s been here. My husband don’t have an American passport, but he has the Dominican passport he arrived to America with. I’m not sure if his Dominican passport will allow him back into America. What does my husband need to travel out the country and back into America besides his I.D. and green card.
