Our Story

  1. Background: I got married to my spouse in January 2021 and received my conditional green card in March 2022. I'm about to file i-751 in December, however, we have been separated since June this year (2023). We tried so many things and went to marriage counseling for almost a year and even our counselor agreed that sometimes the best that we can get out of the counseling is realizing that we shouldn't keep causing each other pain anymore. We were in a relationship since 2017 and I thought I knew the person well enough but long-distance relationship can be cruel, I didn't learn about his issues with alcohol until we started living together. He also had severe attachment and abandonment issues that didn't allow him to connect with me in a deeper level. We tried going through individual therapy, for him to work through those issues and for me to learn how to cope when I'm triggered (I have a father with alcohol issues as well). But it just didn't work out unfortunately. Current Situation: Right now, he wants to get divorce as soon as possible (he's going through much pain and has been suicidal because of the breakup) but is willing to push it back until a few months after I file i-751. I also want to get it done too but I'm not sure if it's better for me to start the divorce process while i-751 is pending. I'm willing to push as much as I need to. So right now I'm considering... 1. Starting the divorce process now, before filing i-751. My concern is that my chances of getting approved would be lower and the process would take longer. 2. File i-751 in December 2023, and sometime at the first half of 2024, start the divorce process. My concern is that it would complicate the immigration process. But I also feel like it might give me a better chance of approval. I'm also not sure if I should hire a lawyer to do this for me. I know I'm very capable of getting all the paperwork ready. I did everything myself the first time around to get the conditional one. But I was wondering if having a lawyer would increase my chance somehow. I attached a picture of the documents I have prepared so far to prove that my marriage was of good faith. If anyone thinks lawyer is a way to go, can you give me an estimate of how much it would cost? Thank you so much. P.S. Other info about me... I'm based in Madison, WI and have been working full-time since I got my green card. I work as a research analyst. I also had been supporting my spouse financially since he's still in school and only works part-time. So, I was the main source of income in the family. He's still on all of my premium insurance and is also my beneficiary since I know he needs it until he graduates next year and starts working full-time.

My time line: Came to USA as F1: 1/2015 Met Spouse: 3/2015 Got married: 10/2015 Filed I485: 4/2016 Got approved Conditional GC: 9/2016 Got Separated: 6/2017 Spouse filed divorce: 8/2017 Divorce approved (No kids): 10/2017 Filed ROC with Divorce waiver: 4/2018 USCIS Status after filing: June 1, 2018 Fingerprint fee for your Form I-751, Petition to Remove Conditions on Residence received. Your case is now properly filed. March 4, 2019 Your Form I-751, Petition to Remove Conditions on Residence, was transferred to another USCIS office. March 5, 2019 We transferred your Form I-751, Petition to Remove Conditions on Residence, to another USCIS office that now has jurisdiction over your case. February 4, 2021 Case is Ready to Be Scheduled for An Interview My case status is case ready for interview since 02/2021 and almost 4 years since I filed ROC. As per USCIS citizenship application eligibility, I became eligible to apply for N400 (naturalization) since July 2021. I am confused now what to do. Is this timeline or length of case is normal? Should I file N400 for naturalization or wait for ROC adjudication first? I contacted USCIS customer service in October 2021 about my case status and they said I should be interviewed soon. I filed case with sufficient evidence or whatever I had: Marriage certificate, My personal affidavit, Marriage pictures, Joint lease, Joint electricity-water-wifi-cell phone bills, Joint tax return of 2016 and 2017, 2 joint bank accounts, Joint 2 credit cards, 2 joint car loans, 3 affidavits from friends and family, 15-20 pictures, Counseling proofs and counselors letters for attempts to fix marriage, Divorce decree. I did not get any RFE for ROC yet and also USCIS customer service representative during phone call mentioned it was a good signal that I did not get any RFE which means I had necessary supporting papers in submitted file. I am really confused now about my status, my life and everything. I am almost 34 now and feeling like a boat without radar who does not know where his destination is going to be. Any advice or opinion regarding my situation? Thanks!
  3. Well I hate to have to come here and say this, but after 8 months of marriage my wife and I are going to get divorced. Were going to do it here in Mexico then I'm going to take off once its finalized. Her I-130 is still in process. If it gets approved during the divorce process and I ignore the RFE's I assume nothing will move forward correct? If we don't go to the interview, if I dont sign the Affidavit of Support, if we don't go to medical I assume nothing will move forward? Therefore I don't have much to worry about in that regard? Should I write to USCIS requesting a withdrawal or something even though were not divorced yet? She has not been handling this process at all so she wouldn't be able to try to move anything forward anyway. Any advice is appreciated. Best
  4. Not sure if this is the right forum for this question. Asking for my friend, he is within the 90 day window to apply to get the conditions removed from his green card. He came here on a spouse visa and got a conditional green card. They are in the process of getting a divorce, but the divorce papers won’t be finalized by the time he needs to submit his papers to uscis. Does he have to apply jointly with his wife? Or can he still file separately even though he doesn’t have divorce proof yet?

  6. Current situation: My foreign spouse's 2-year green card expired in Dec 2022, and I helped her apply for a 10-year green card, it’s now in a pending state. We had a fallout during these 4 months, and I want to get a divorce. Just last week I got a letter from USCIS regarding the green card, and they gave her a temporary extension green card letter of 48 months. With her current situation is she entitled to get a split of my assets when I do the divorce? I don’t have any property only saving money. We do not have any kids. What rights does she have in terms of demanding money from me for the divorce? Can she sue me for doing the divorce? If she doesn’t sign the paperwork to divorce what are my options? Can I do the green card withdrawal or cancel the pending temporary green card? Anyone with experience in immigration/divorce law please help answer these questions. I really appreciate your help. Reason for divorce: Our marriage was entered in good faith, but we have a lot of problems in our relationship. One thing is that my wife doesn't want to pay for anything. I take care of all the bills and living situation. She been in the US for 2.4 years and worked for 1 year and still currently working. I asked her to help pay for the food, but she said no. I'm to a point where I had enough of this bull. That's why I'm divorcing her because she just using me. I know she will fight and not want the divorce, that's why I need you guys to help me answer the above questions. Thanks

  8. Hello! I am about to go through a divorce. My husband already filed for it, but Im not agreeing with a uncontested divorce. I have my 2 year greencard and have to do the removal of condition next year. So my first question is should I be the one who files for divorce bc of the matter that he was cheating on me and mentally abuseing me, or should I let the uncontested divorce just go through? (What is better in my case when it comes to removal of condition and getting the ten year gc?) Also who has done the removal of condition and getting the 10 year greencard on their own? Do I have to show them that I went through hell and this is why we got divorced, or should a lawyer do that for me? I have so many questions... I hope someone can help. Thank you much in advance!
  9. Hi all, Husband USC, Me UKC Since me and my husband have started this process and he has gone home, and found himself again, but now he wants to split from me and stay friends. Obv, I'm heartbroken but I'm not going to beg him to stay, because I think his long distance work has caused him to be too tired to continue with this. That being said, I overstayed my ESTA in 2017, by less than 180 days. Regardless I know I'll never be able to get an esta again. We haven't received NOA2 yet and I have yet to have that conversation with him about what happens then. I don't think he will pay NVC or go ahead. I would like to visit at some point so I can collect my belongings if it's really over, but I don't have strong tie to the UK with being married to a USC. I had cut all ties here knowing I was following him. So all I have is a job, I live in my parents spare room and no car finance or mortgage etc I just pay rent to my mum. Will I be able to obtain a visit visa from the embassy or will I have to wait for the NVC stage to expire?? Thanks in advance. X
  10. Hello everyone. I need some help. I am a 10 year greencard holder (IR1). Since leaving my spouse (please refer to previous topic). I was able to file a divorce case with a court in CA. My spouse got served and this must have triggered him as he has reported me to USCIS (I'm not worried about this as he has no evidence since it’s all lies) but my concern here is that he told me he will be filing a response to my divorce by ticking the box “annulment based on fraud”. I appreciate that this maybe not be the right place to ask but I cannot afford a lawyer and wanted to know how I proceed if I filed for a divorce based on irreconcilable differences and he is responding with annulment based on fraud? He is doing anything and everything he can to spite me and I just want to move on.

I am filing an i-130 online for my spouse can someone please tell me that in what section can I upload my divorce certificate as I was previously married , i-130 has specific sections like proof of us citizenship and proof of marriage section for evidence so I am confused in what section do i need to upload my divorce certificate P.S I am a LPR and I came here based on previous marriage with a US Citizen but my marriage was real and I had children from previous marriage which shows it was legitimate so I also want to know in what section I can upload the birth certificate of my child from previous marriage to show that marriage was real
  12. Hello everyone, I am a USC. I'm preparing the i129F packet for my Fiance and I have some questions for those who've been in a similar situation of being a previous petitioner. In 2014 I got married overseas in Egypt and petitioned for my ex, he was approved for a CR1 visa. After a 15 month process my then-husband flew here the following year in July 2015 and we stayed with some of my family where I was currently living. Everything started off great until issues between he and my family started. Then he wanted us to move out on our own so he started looking for a job, met with managers but never got call backs. He arranged to go stay with a mutual close friend out of state because he claimed he was feeling uncomfortable living with my family. He also wanted to try getting work out of state there. I was very upset about the change in plans, it was not what I was expecting at all. This created a lot of issues between us. Within a few months of his arrival that happened and he was staying out of state. I later flew and stayed for a month with him and for the most part it was horrible for me, lots of fighting and not getting along. I returned home after and separated (informally), which he did not like. When we did talk it was still more fighting and then a week or 2 of no talking. After a month and a half to 2 months I tried to reconcile and I sent him a box of marriage therapy type books I had been reading, treats, amazon gift cards etc for him and some things for our friends family he was staying with. He is the type to hold a grudge about everything and didnt reciprocate trying to reconcile. After going through depression, I felt fed up and filed divorce a few months later the following year. Shortly after I filed he contacted me apologizing and wanting to reconcile and mentioned that he was considering coming back home. I paid for a 1 year family pass for the zoo (I have 2 kids from a previous Relationship) to have something to do together. I even added him as an authorized user to my credit card in attempt help him start building his own credit. After a few months he ended up not coming back, instead he suggested I and my kids move there with him, which I didnt feel it was right removing my kids from their life and family here. Then he suggested I move there with him and leave my kids here and i could visit them periodically, that I wouldn't have to work and he would take care of it all. I was definitely not about to leave my kids behind and move away just because he decided he wanted to stay living in another state. I knew that my state gives a 6 month period before divorce finalizes incase the couple reconciles and decides to cancel it. I let the divorce process continue without cancelling and I'm glad I did. Clearly it was not working out and we couldn't even agree on what state to live in. We divorced based on irreconcilable differences and it was finalized Dec 2016. He had to file a divorce waiver and remove conditions by himself and go the rest of the way without me. Fast forward, he attended his interviews, did his biometrics, gave them everything they wanted to know and was granted US Citizenship in the end. Now about my Fiance. We knew of eachother through a mutual female friend on fb 7 years ago but he and I never had contact back then. Over a year later He messaged me saying happy new year and gave advice about staying happy in marriage and sent a link but I never responded. I was married at the time and it wasn't my thing to talk to men even though he wasn't showing interest or trying to flirt or come on to me in any way. During my separation from my husband I contacted this man asking for help with translating some things. He happens to also be from the same country as my ex husband. So he finally responds back over a month later because apparently he was away in the military. We talk a little and he wants to block because he doesnt want to cause problems in my marriage. He had no idea that problems already were there and I was separated. It wasn't an issue any longer to me talking and being acquaintances. I let him know the current circumstances and then we didnt talk again for several days. We ended up excepting eachother as friends on fb several days later. While me and my ex were having problems and were separated, me and my now fiance were becoming friends. We became close, I considered him a best friend to me and he was there for me to vent a lot about the problems in my marriage. At the same time we started becoming attracted to one another and did like eachother but i didnt consider us as being officially dating or in a relationship. After my divorce became finalized I tried to move on with my life and went on to pursue a long distance relationship with my now fiance. But it wasn't entirely easy for me having been down this road of long distance relationship before and this whole process. I still had some fears of another relationship failing especially during that year after my divorce. I felt like all my heart, emotions, effort, time, etc. I put into my marriage and that whole process was for nothing in the end and it left me shattered inside. I feared this type of let down happening allover again. But I continued on having this new, long distance relationship. Several times we planned to meet in person but due to our work schedules and circumstances it became delayed. At the same time I felt like I needed this delay to fully heal and be whole again. In Nov 2020 we broke up for a short period without talking, due to other things. Mostly he felt the distance was becoming too much and felt that I was often purposely delaying our relationship even more from going foreward to the next step. Though he was trying to be patient through it all with me, we have had ups and downs over the last 3 years. Many times we talked about a future together and for the most part we get along great together and see eye to eye with many things in common. I also knew inside that I didnt want to pass him by and live with regrets later in life of what if. I arranged with work and got approval for vacation and flew to where he resides for work in Bahrain. This turned out being the best decision I could have made. We had an amazing time together. During that period we flew to kuwait to spend time with some of his family and I loved it. I took them each gifts and in turn they took me out and wanted to shop for me, my kids and my mom. They took me to dinner..it was really nice and they were so welcoming. After flying back to Bahrain I had one week left before returning home to the US. We talked about engagement before going to see his family and wanted to have it with them there and wanted to find rings in Kuwait but our trip was shortened due to missing a flight and having to schedule a later one and pay all over again, plus his work schedule.. he couldn't take more than just a few days off. So after returning to Bahrain, we shopped and purchased our engagement rings and became engaged Feb 28, 2020. Since then the pandemic picked up more and I havent been able to make another trip. I also work in a covid facility so it's been pretty hectic this past year and with my kids and my dad also getting covid and having to care for them too through it. Thank the Lord I have not had the virus yet. We have made some arrangements and discussed the details of our wedding and I know time is ticking and I need to file this now as it has to be within 2 years of meeting. I know that there are some red flags being I was married before and previously filed a CR1. Both are from the same country of Birth and Starting a relationship just after my divorce. I'm hoping for the best and just want to know if others have filed k1 after marriage and divorce, how did it go? I'm wondering if I will have to prove at some point the bonafides of my previous marriage. It's been just over 7 years since I had gotten married and just over 4 years being divorced. I've moved a few times and dont have much proof of anything left as he took whatever there was with him. Should I expect them to ask for some letter from my ex husband? Any thoughts or advice is appreciated.
  13. So I’ve done a bit of research, but I’m honestly too overwhelmed and anxious about all of this and just have no idea what to do. Even posting this is difficult. 😔 Could someone please point me in the right direction? My husband (who is Ecuadorian) and I have been separated and living on completely different continents for 3 years now. He moved out of the US in 2018 (essentially letting his green card expire, as he never applied to renew after 3 years). I wanted to work things out; he does not. He wants to file for divorce but is now living in England and works a ton. I told him if he wanted the divorce he needed to do it because I wasn’t the one that wanted it. But now.. I’m tired of being in limbo and just want to start over already. But how? I have no clue what to file or how. I’m in NJ, and luckily we do not have any kids or property together. We only lived with family. Both of us really don’t have very much, nor do we have anything to really split between us. We have lived completely separate lives for the past 3 years. I never even changed my last name. I read about filing for abandonment, but I am partially to blame for him leaving, so I don't think I would qualify. I would rather do this without lawyers if it’s possible, especially considering that we have nothing between us. I just want this nightmare to be over. 😞
  14. Hello, So the petition for my mother was approved on May 2020, and she is still waiting for an interview appointment in the Philippines. I checked the NVC website today and it still says that her papers are still with NVC. My divorced got finalized on August 2020 and my ex-husband is in her petition papers as "Household member", I'm the only "Primary Sponsor". I'm no longer living with my ex-husband and got married to a different man now. I'm about to change my name to my new married name. My questions are, do I need to let NVC know to remove my ex-husband as Household Member and add my new husband to her papers? Doing so, will all her papers change and cause more delay on her interview appointment? Or do I just continue with my name change and not do anything with her papers? I'm very concerned about this because I don't want to cause further delay on her papers, all she needs is an interview and medical exam. She could have been here by now if CoVid didn't happen. Please help...
  15. Hello everyone, My 2 year conditional green card is about to expire in Dec 2021. My 90 day window just opened. Me and my spouse are about to start living separately and will start the divorce process soon as well. Since we are still cordial with each other and care about one another, we will go the Summary Dissolution route. My questions for you, which I'd SO appreciate the help on are: Since we are not even separated yet, nor divorced, do we file jointly and then add in the Divorce Waiver later on? I've tried looking up the Divorce Waiver examples where there hasn't been abuse, but I am unable to find any - Can anyone please link me? Thank you all!
  16. Hello Everyone, Need your advise. I am the US citizen petitioner living in the states. My wife is from Iran and her I-130 was recently approved. We are in the process of finalizing the NVC document gathering process. Two Questions: 1. My wife was never married before we met but I had a divorce five years ago. Should I upload my divorce decree under the beneficiary's civil documents section on the NVC website? 2. According to the State Department's website (below link) people from Iran applying for immigration visa: "Police records are not required for immigrant visa applicants because posts cannot verify them." ......... However, on NVC's website it shows Police Certificate as a required civil document. What should I do? https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/IranIslamicRepublicof.html Police Certificates Available Comments: Available but unreliable. Police records are not required for immigrant visa applicants because posts cannot verify them. Clean record certificates can be obtained in Iran or from Iranian Embassies and Consulates, and the physical appearance of the certificate changes significantly depending on which authority issued it.
  17. Hello, I have a few questions, I have been waiting and finally in the process of divorce from my first wife. While waiting I fell in love and we want to get married, if we get married a few days after my divorce is finalized, will that be a red flag? Also if I submit the I-130/A soon after the marriage would that be a red flag? I would not be in such a rush but we know we want to be married and live together and I want to start the process especially if it takes 8-10 months or longer. Thanks in Advance.

I could not find it; So I am starting the new topic. 2015/10: Got Married to USC 2016/09: Got Conditional GC 2017/09: Got Divorced 2018 April: Applied for ROC with waiver (Bonafide marriage) 2018 June: Received extension letter Since then nothing till February 2021. In February 2021, Online system says: Your case is ready to be scheduled for an interview. Since February 2021, it has been like that for 8 months almost and no update. Also it has been almost 3.5 years since I filed for ROC. Are these normal situation? I did not get any RFE yet though. Also, September 2021 is my 5 years anniversary of GC (still conditional technically). I heard a permanent resident can apply for Citizenship after 5 years. Can I apply for Citizenship? My ROC is also pending. What I do?
  19. Going through a divorce right now but still under my conditional green card which is expiring Nov 2022. What steps should I be taking in terms of the GC?
  20. I finally got a response form an attorney in Manila. They are quoting me the following: "Our fee starts at 150k pesos , at 5 payments of 30k upon signing of a contract then monthly until the150k is fully paid, plus appearance fees of 8k pesos per appearance, plus expenses ( filing fees, court fees,). Only 30k would be needed to start the process. Let us know if there are other concerns, or if you are ready at this time to review a contract for the handling of the case." This seems rather expensive for Philippines??? Does anyone have any suggestions for other attorneys? The one year timeline they give is that realistic, or is it likely to take longer? Any suggestions would be greatly appreciated. Mahalo, David O
  21. Okay I have one question. I was married to a Filipina in 2012 in the Philippines. (That was my first mistake) I brought her to USA, she became US Citizen and all that. Last year she came home one day "After visiting a friend" and said it was over, there was no hope for us, she would not participate in counseling, church, etc to try to save our marriage. She left. So now we are divorced in the US and every other country in the world except for the Philippines. Does anyone have any information how I can get the Philippines to recognize my divorce. Any suggestions of an attorney in Manila? Estimates of cost and time frame? Any help will be greatly appreciated, Mahalo, David Olsten
  22. Has anyone gotten divorced from their partner after becoming a permanent resident? This morning, I discovered my husband emotionally cheating with over 100 people on Tinder and other social sites. I confronted him about it and he does not want to go forward with reconciliation, just a divorce. We have two young children here in Washington State. I am not working (youngest just turned 1 year) and not sure what to do at this point. Ideally, I would like to bring them with me back to Canada. If I do this, my permanent residency will be abandoned. Does anyone suggest becoming a US citizen first and then doing so or just returning back to their own country? What else should I consider? Thank you
  23. I got my 10 yr green card a few months ago through marriage. I met my spouse almost 8 years ago, and after being in a relationship for 4 yesrs or so, we got married. I got a conditional green card, but I got the condition removed and got my 10 year green card. My marriage has been rough since a few months before I got my condition removed, and now I really can't stand it anymore. 1) I now have the 10yr green card, but does a divorce afffect my immigration status in any way? My attorney told me that if the divorce has to happen, make sure it is not due to mu fault, but should be my spouse's. For example, even though I have the 10 yr GC, if I am the one who got violent, or even cheated on my spouse, and that was the cause of the divorce, it would look bad. My attorney said the divorce should be due to my spouse's, but I dont even think this is true. Can anyone clarify? No one in our marriage has cheated, but I want a divorce asap. 2) It has only been a few months since I got my 10yr green card. Would it be bad if I divorce too soon? 3) If one day I want a citizenship after 5 years from now, would my divorce become an issue?

Hello, I am writing for a friend and I'm not sure where to place this topic or if there's any other topic that talks about this specific issue so please feel free to transfer this to somewhere else. My friend really needs help right now. She applied for naturalization in 2020 and had her interview last June 1 2021. However the officer did not approve nor deny her application. Please see attached detailed file. Is she in danger of deportation? She is now married to another person but according to her, when she got interviewed for the removal of conditions in 2013, she was already pregnant with her first child to her 2nd husband, who she only married 2 years ago. She came here through K1 visa, got her conditional GC in 2010, applied for removal of conditions in 2012, got interviewed for removal of conditions in 2013. I dont know when they got divorced but i think she mentioned after 3 years of marriage so i think in 2013 also? Im not sure. So, will she get deported guys? What can she do on her end if she is unable to give what uscis has asked of her (evidence of marital union from 2010-2013)? Thank you for your time.
  25. Greeting everybody, I hope everybody is doing well! I want to share what’s going on in my life at the moment and see if I could get any help from the community. I’ve been married for about 2 years but we are no longer partners but we still living in the same place but in separate rooms, I’ve been a Green Card Holder for about 8 months, and this whole situation has always been hell since we got engaged, my partner has always been aggressive verbally and physically towards me and on top of that, she starting doing drugs (cocaine) and I’m concerned that could get me in trouble. Since I stopped letting her do whatever with me, she has been threatening me, saying she will deport me or cut herself (Which has happened 3 times) if I don’t do what she wants/needs! There is a good amount of people who have witnessed some of her actions and also messages of her being verbally aggressive towards me. My question is what kinda lawyer should I be looking at this point? And also how would that affect my ROC process?
