  1. All, We sent the AOS package for my wife on 2/22 and got a 2/26 NOA. On 2/29 NBC MO sent Affidavit it of Support RFE, which I replied to on 3/12 via paper mail. I have been checking the USCIS page for updates and the EAD estimates have been consistent at 2-3 weeks. Well, yesterday afternoon the mailman dropped off my wife's SSA card (with the DHS work restriction of course). But the USCIS website still showed "in progress." What gives? Does SSA gets automatically notified when we submit package (or gets approved) and issue a card?
  2. Hi everyone! I recently got a RFIE for my I-485, at this time I still don't know what the request is about but i am afraid it is related to my joint sponsor's I-864. When we filled for AOS my mother-in-law accepted to be my joint sponsor since my husband's 2022 tax transcript was below poverty line and we filled before he filed for taxes. Now his 2023 tax transcript is way above poverty line, if the RFIE is about it can we withdraw my mother-in-law form and send a new I-864 of just my husband's? I already uploaded on march 1st our 2023 tax transcript as a proof of bona fide marriage since we filled jointly. thank you so much!
  3. On 2/22/2024, USCIS confirmed receipt on my wife's AOS package sent to Eglin. One week later they sent an RFE: "Based on the documents submitted, we could not determine that the petitioning sponsor on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P for information on the Federal Poverty Guidelines." I checked the form a thousand times. everything was filed out and signed properly. I included evidence of income for the past three years: IRS Transcripts, latest 1099 from the Social Security Disability, and a letter of benefits from the Veterans Administration indicating that my payments are permanent. My number of dependents (including my immigrant spouse and an adult disabled child NOT LIVING WITH ME, puts me a 3 people in the household, according to the worksheet. Even with her daughter coming next year (separate IR-2 petition), it would be 4 people in the household. On Page 5, questions 24.a,b,c, I wrote down my income over the past 3 years as per my Tax Transcripts for 2020, 2021, 2022. The IRS "computer income" is a bit below the 125% HHS Poverty guidelines because it reflects the reduction "on paper" of 85% of my SSDI being tax exempt. In reality between those two income streams alone my gross income is way over 125% limit for a household with 8 people. Adding my VA compesation, however, DOUBLES my annual income and makes it leap OVER the guidelines for a household of 15 people. I clearly stated my GROSS income on Part 5 (7), and Part 6 (20), which dramatically differs from the IRS tanscript, but for which I submitted official government documentation as proof. Having read beforehand that some veterans had problems with USCIS refusing to acknowledge VA disability compensation pay as a source of income, I included the following statements in the "Additional Information" page: "Real Gross Income is $xx1,711/yr, $x,316/ monthly: Military retirement ($x,124); Social Security Disability ($x,990); VA Disability Compensation ($x,202). VA benefits are tax-exempt and not reflected on tax records. 85% of SSDI is tax-exempt making Total Income Per Computer on Tax Transcripts artificially low." "IRS Tax Transcripts do not reflect VA benefits (projected $X0,424/yr for 2024) since these are tax-exempt and not reflected on tax records. 85% of SSDI is tax-exempt making Total Income Per Computer on Tax Transcripts artificially low." So my questions are: Are these forms machine read and therefore prone to "logic errors" or lack of context? Do they even bother to read the "additional information" pages for context? What new information am I supposed to send that I have not already submitted? *Should I send a message to the officer reviewing my case via the USCIS message tool? Of note, the letter was sent from- and must be replied to- this address. It is normal to parse out AOS packages to field offices? My assigned center was Chicago as I am in Maryland.   4. 81358331Hello all, Recently received THREE separate automated text confirmation messages of AOS package receipt by the Eglin lockbox. I attempted to add the cases to my case (I-130/A) but recived an error message. Does the immigrant applicant need to open her own USCIS account in order to keep visibility of the process, submit evidence, receive notifications? See screenshot below. Thanks!
  5. Just like the title said. Is an EAD document alongside Drivers license enough or does passport needs to be carried too?
  6. Basic info: Mom has green card >5 years. Has full custody. Dad is not in picture anymore. Stepdad is USC Child (middle school age) has visited during school break on B2 visa. After an emotional 3 week stay really does not want to return to home country, as they miss being with their mom and the mom can't visit frequently anymore due to work. So we are looking at applying AOS for a green card. Currently is authorized to stay 6 months. The process is complicated as always, but straightforward - but for a couple of items. I've looked around the forum for answers, but it does not seem common for kids to go through this process because they usually follow the parents. Unfortunately that was not an option at the time. So I have 2 fairly simple questions: 1. The "90 day" rule - from my research that is just a guideline to determine the level of scrutiny to put on an application. Is there a "too soon" to apply? 2. Since she is of school age, we don't want her waiting 3 months at home during the school year. I fully understand the B2 rules say that it's NOK to go to school on a B1 visa. But do we really have to wait until we apply for the AOS? Or would it be reasonable to send them to school since we plan to apply for GC anyway? Applying for AOS after 90 days is really hard due to these school obligations. Thanks all for your help.
  7. My mom has a pending i-485 but her EAD has been approved. However, my mom has work outside the USA. Its mostly online but I would like to know if thats okay. that she has a job that is not in the US. its on the business side. I’m wondering if she could get in trouble because of this. thanks
  8. Hello - I am going through the AOS Green Card process after coming to the U.S. on a K-1 visa and getting married. I recieved a Request for Evidence letter in the mail detailing that I have submitted an incomplete I-693 Form and that I will need to get another medical examination for the medical doctor to give me a packet to send to USCIS, this will need to be done by March 2024. When I was in Brasil for the Medical exam on 1/17/2023, I only recieved a DS-3025 Vaccination Documentation Worksheet. Which is what I included in the AOS packet latter after getting married, but I remember back in Brazil, the Medical clinic said that they'd mail info packet (presumably the I-693) to the embassy... and I went along to my visa interview and passed it just fine. The RFE letter I got is vauge and does not explicitly tell you what was wrong with the original I-693 form, but it does mention that civil surgeons must use the 03/09/2023 eddition and that USCIS will not accept the 07/19/2022 version if the civil surgeon signed the form after May 30, 2023. Do I really need to have another medical exam? Is there anything I can do legally? If I must get another medical exam here in the U.S., can I use a copy of the DS-3025 (Vaccination Documentation Worksheet) as my vaccination records, since what I have from Brazil is an old portugese card for vaccination that will need to be translated... again. That old vaccination card is literally what got copied to the DS-3025 I have... why would I need to do a translation again if I haven't had any new vaccinations since? This is my 2nd RFE and I am incredibly frustrated but beyond tired with the process to even muster emotion. It's been a long taxing, confusing 3yrs.
  9. Ok, I searched for this particular question and could not find it here. I scheduled the medical examination for my spouse and the civil surgeon's office says that they do NOT provide an interpreter. I know this is in violation of The Civil Rights Act of 1964 and Executive Order 13166, and Title II of American for Disabilities Act. Before I call them out on this and create an unfriendly environment pre-visit, I need to ask the group the following: 1. Even if the civil surgeon provides an interpreter, it would be a remote over-the-phone session BUT form I-693 instructions state that the interpreter must sign and date the form. How can a remote interpreter sign the form? I did get two quotes for $260/hour and another for $100/hr. but if they cannot sign the form and USCIS will reject it, why bother? 2. If i were to find an interpreter to come in person, would he/she need to be inside the room? I have read that some doctors check breast, genitals, etc. Sounds a little uncomfortable. 3. Assuming my spouse can't produce vaccination records, which vaccines will she be required to get? I was told TDAP/MMR/VARICELLA/HEP B/FLU/COVID, but want to confirm. 4. How long did you all wait for lab /x ray results before picking up the sealed copy? Thanks so much for your help.

They received their EAD already but i-485 is still pending. we are currently residing in California however, my parents need to go to Nevada for a while because of an ill relative. Can they live and work in Nevada for the meantime since they are legally able to work already? Or do they need to live with me until i-485 is approved? thank you
  11. Hello! My fiance had a J1 visa when he was in high school, and in his home country, they literally take your old passport when you get a new one, so he doesn't have his old J1 visa. I don't know what to do, and I am kind of freaking out. It was from 14 years ago.
  12. Hi. I am a U.S. citizen. I petitioned for my wife and my stepchild (13) years old. I mailed both concurrent applications at the same time. 3 months after filing my wife combo card approve nothing for my daughter. 3weeks ago ago my wife and I went to our AOS interview she was approved on spot but yet nothing for my daughter. Has this happened to anyone? How long before they approve her application?

My Fiancee will arrive soon and we'd like to visit my mom and dad in South Texas, we won't have an AOS because we will not have filed for it yet (we have a NOA1 but for the K1 visa application, not for an AOS), we may not have even married yet, as we have 90 days to do so and my parents want to see her. Does that mean she cannot visit my mom and dad in South Texas without risking deportation or a legal mess? Of course we'll get married as soon as possible but it's good to know ahead of time if she isn't actually free to move about the USA. Thanks for any info guys.

If there's one. please feel free to close this and direct me to it so we don't duplicate topics. I submitted in 28th of April 2023 and got a text that it was received on the 1st of May. Still waiting for the mail and so far no updates yet. I am new to this so lets se what happens next :). I know this would be a long journey so it would be great to not have to go through it alone!
  15. Hi all, In the past I was married to an American citizen, did Adjustment of Status from an F-1 visa, received my green card, and had its conditions removed. My spouse and I then divorced before I could be naturalized under the 3-year rule. I later naturalized under the 5-year rule with no incident except for a scary interview with an officer who was grilling me on my past marriage, saying that I divorced too early (I was able to satisfy his concerns at the interview). It has now been 5 years since I have been naturalized and almost 10 years since I have been divorced. I would like to marry my foreign fiance and sponsor her for a green card in the same way that I was sponsored, as she is on an F-1 visa (currently on OPT). I am concerned that the officials will view my case very harshly -- do you think I am likely to encounter any problems?

Hello all, When it comes to Form I-864, income and taxes, my wife started a new job over a year ago, her federal taxes was less than what they require but her total annual income at her new job exceeds the amount needed to be a sponsor. She doesn’t have the tax forms for 2023, so what can we do to show them that she’s capable of sponsoring me? Also do they care more about your current income or your previous years from the taxes? We received an RFE so I want to make sure we don’t get another or possibly denied. Thanks
  17. Hi everybody, my fiance and I applied for k1 2 years and a half ago were approved and interviewed. Everything went well but was put on administrative processing for months with no apparent reason (Canada). We have been ready to get married for over a year now not knowing that this was gonna take forever… i am currently on a visit in the US to see him and we just found out we are pregnant. We both want to marry asap not knowing how long this administrative black hole is gonna take, can we marry spontaneously right now, abandon the k1 and adjust status instead? I had no intent of marrying on this visit i’m simply here to watch his sports season just like every fall, as he’s a professional athlete. I’m aware it will take months but atleast we will be together during these times. Please share your experience or knowledge on the subject! Thank you!
  18. Hi All, My fiancee and I are in the process of finishing up the K1 process, with the hope that she will be able to come to the States this coming year. I have a steady (decently-paying) job, but a bit in the way of credit card debt. My fiancee is very smart, but hasn't yet finished college, and I was hoping that she might be able to attend a local university after getting her permanent residency, with the assumption that she might get it in 8-14 months. Now, however, I'm seeing that it could take her anywhere from 12-20.5mos to get her AOS, and I'm just feeling extraordinarily daunted by everything that lies ahead, particularly given that from what I've read, a person waiting on their AOS can apply to get a work authorization, but there is no such similar authorization for public college loans. I kind of feel like my financial runway just got significantly more complicated. Does anyone have any experience with this, or any strategies to get student loans while waiting on the AOS? My plan was to have her continue with her credits at a community college before finishing up at a 4 year. Thanks.

  20. We filed for AOS for my husband on June 30th for his K1 visa. His EAD was approved on August 2nd and he received the card on August 12th. He received his 1st social security card on August 3rd with the "valid for work only with DHSauthorization." On September 13th, we got a notification there was a change in the status of his case and received a new social security card in the mail without restrictions. It is the exact same card number as the previous one. However, when we check the status of his case there is no change, it still says "case is being actively reviewed by USCIS." We have not received any written notification either. Has this ever happened to anybody?

The petitioner is not filling an I130 for any other family members. The parent is living with the petitioner and will complete the process while in the US. The below questions will reference the I130 PDF with an edition date of 07/20/21 and expires on 07/31/2024. Form Filling Question Does USCIS prefer ALL CAPS when filling out forms? If ALL CAPS are used, will that affect how legal names appear on future official documents? Unanswered Questions: These are questions I have not found the answer to. Part 2, Questions 40a to 41, page 4/12 - "If you are a lawful permanent resident..." The petitioner was an LPR but is now a US Citizen. Q: Should the petitioner answer "N/A"? Part 4, Question 25a to 44, pages 6-7/12 - "Information About Beneficiary's Family" The petitioner is the daughter of the beneficiary. Q: Does the petitioner list her "maiden name" or her "current" Family Name (Last Name)? Part 4, Question 46d, page 7/12 - "Date authorized stay..." The Visa is scheduled to expire before the date on the I-94 online form. Q: Is it better to list when the Visa is scheduled to expire, or the date of expiration of the I-94 online form? Part 4, Question 58a to 58f, page 8/12 - Foreign Address in Foreign Alphebet The foreign alphabet is Cyrillic. Since the beneficiary is living with the petitioner during the AOS, does the petitioner list this as N/A? Unconfirmed Questions: I found answers to the below questions, but need one more matching source for validation. Or found conflicting information and need confirmation. Part 2, Question 28 to 29, Page 3/12 - "Information About Your Parents - City/Town/Village and Country of Residence" Parent 1 is the Beneficiary. Q: Since the beneficiary is living with the petitioner in the USA while on a valid visa and is establishing residency in the USA, does the petitioner put the beneficiary's foreign City and Country, or the current US city and USA as the country? Source 1 and Source 2 says to list the US City and Country. Source 3 says to list the foreign City and Country Part 4, Question 19, Page 6/12 - "Date of current marriage (if currently married)" Q: Does the petitioner leave this "N/A" since the beneficiary is divorced? Source 1 covered widow(erd) but not divorce. Need verification. Part 4, Question 20a to 20d, page 6/12 - "Place of Beneficiary's Current Marriage" Q: Does the petitioner leave this "N/A" since the beneficiary is divorced? Source 1 covered widow(erd) but not divorce. Need verification. Questions I had answered: Originally I was unsure how to answer. I found multiple sources to validate these questions. Please correct me if the answer is wrong. Part 1, Question 2, Page 1/12 - "If you are filing this petition for your... parent..." Child in this case refers to the petitioner being the beneficiary's "Child". "Child was born to parents who were married..." is the best fitting answer. "Child" does not refer to any children the petitioner has. Source 1 and Source 2. Part 2, Question 1, Page 1/12 - "A Number" Since the petitioner was an LPR in the past, enter the Alien Number, even though the petitioner is a US citizen now. Source 1, Source 2, and Source 3 Part 4, Questions 11a-13f, page 5/12 - "Beneficiary's Physical Address" Since the Beneficiary is living in the US during the I130 and AOS process put the US Address. Source 1, Source 2, and Source 3 Part 4, Questions 25a-44, pages 6-7/12 - "Information About Beneficiary's Family" No need to list ex-spouse in this area since they are no longer family.   23. When I was a child, under 10 years old, I was brought to the United States with a K-2 Visa and have been here ever since (am now slightly older than 21). My K-1 visa mother married my stepfather during the 90 day period, but they never went through the application process for the green card for my mom or myself. They have not made any progress on my, or my mom's behalf, so I am taking things into my own hands as I would like to get my green card so I can finish school, gain employment and travel. I am hoping to be able to complete all required documentation with minimal involvement to get signatures, proof documents, etc. from my stepdad and mom. From free consultations I have gotten a list of documents that I need to complete including I-485, I-765, I-131, I-864, etc. I am getting these completed and going to be talking with some free resources I have access through college that I attended for a period of time. Just to help my anxiety, if I go through this process and get denied at the end, what are the chances I get sent back to my mothers home country that I have very little relation to. Any tips and advice, as I wasn't able to find any similar posts to this situation, would be helpful. I think this is similar to the Matter of Le case from 2011. Thank you.
  24. Hi all, I wanted to make this group to post updates on everyone's AOS/EAD/AP etc. I'm personally very interested in everyone's work authorization status, if you've already received yours? My timeline is; Feb. 24 2023: AOS/EAD/AP submitted Mar. 03 2023: Rejected (used an old version of form) Mar. 04 2023: AOS Resubmitted Mar. 28 2023: RFE received May 19 2023: response to RFE submitted Waiting since.

Hello September 2022 AOS filers another month another round of AOS submissions, Please be aware that this checklist is NOT all inclusive and you must consult the USCIS website to crosscheck this checklist against/with. The AOS process has been confusing since the pandemic hit, not to mention the added politics. So please I want to stress that you only use this check sheet as a starting point and guide if you will. The USCIS site will be the final guide. Please ensure that you check your forms for the correct versions and editions because if you use the wrong forms USCIS will reject your application and send it back to you. This is easily checked on the USCIS website prior to downloading your forms. You should also ONLY download your forms from the USCIS website. The current and correct fees can also be ascertained from the USCIS website . Just a side note before we get started USCIS may decouple Forms I-765 and Form I-131 if filed jointly with Form I-485. Here is the quoted text taken directly from the USCIS website. "To improve efficiency and reduce Form I-765 processing times for Form I-485 applicants, USCIS may decouple Forms I-765 from Forms I-131 filed at the same time. Effective Feb. 1, 2022, when possible, we will adjudicate an applicant's Form I-765 first. If we approve it, we will issue an Employment Authorization Document without any notation about advanced parole. We will adjudicate the Form I-131 separately and if we approve it, we will issue an advance parole document". I know this is old news, but I thought it would be good to include it here for your knowledge. What this means is some people elect to include three (3) copies of their marriage license / certificates one attached to each form (I-485, I-765 and I-131 respectively). I do not know of anyone receiving an RFE for a marriage license/certificate missing on the I-765 or the I-131 since USCIS has started doing this new way of adjudicating the AOS (the marriage license / certificate with form I-485 is required though). This is an age old concern that has been in play before this new way USCIS started adjudicating these forms. Some filers including me when I filed the AOS back in 2019 sent in three (3) copies of their marriage licenses / certificates. I did it then because of peace of mind and there were some RFEs given out for missing licenses / certificates (back then). USCIS also used to issue Combo Cards, Employment Authorization Document and Advance Parole (EAD and AP combined in the same card). I've seen now where they have issued an EAD without the AP. Whether you include three (3) copies of your marriage license / certificate is going to be your individual call when you file your AOS. Having said that let's get into the checklist: AOS Checklist Cover Letter listing Table of Contents Check Payable to U.S. Department of Homeland Security - $1,225.00 (this includes the Bio-metrics fee) Form I-485 (completed and signed by non-US Citizen/beneficiary) Form G-1145 Copy of beneficiary's Passport with biographical page Copy of beneficiary's K1 Visa from Passport and entry stamp Copy of NOA2 Approval letter (from K1 process) I-94 Copy of beneficiary's Birth Certificate translation of birth certificate (if needed) Certified copy of Marriage License or Certificate Passport Photos (2) name written on the back Copy of DS-3025 Form I-864 (completed and signed by USC) (goes with form I-485) Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other) Current tax year 2021 and (optional 2020 , 2019) Tax Return (with W-2) or Transcripts (transcripts are better if you can get them) Employment Verification letter (updated one - not the one used during K1 process) Pay stubs (last 3 months) Form I-765 (completed and signed by non-US Citizen/beneficiary) Copy of beneficiary's Passport with biographical page Copy of beneficiary's K1 Visa from Passport and entry stamp I-94 Passport Photos (2) name written on the back Copy of NOA2 (from K1 process) Be sure to use the correct filing code of (c)(9) if this code applies to you. The I-765 instructions explains all the codes in detail. If you are filing under a different code (other than (c)(9) the fee for your AOS will not be correct and USCIS will reject your entire packet. Form I-131 (completed and signed by non-US Citizen/beneficiary) Copy of beneficiary's Passport with biographical page Copy of beneficiary's K1 Visa from Passport and entry stamp I-94 Passport Photos (2) name written on the back Copy of NOA2 (from K1 process Be sure to double check for the current fees as fees do sometimes increase and they can change on a dime so please check. Additionally, check the forms as listed above i.e., current version and or edition date, there have been many changes to various forms. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main cover letter. Make sure you send long form birth certificates and not the short form. Hope this helps in your preparation of your AOS. When in doubt ask questions. Please consider filing the I-131 and the I-765 even if you don't think you'll need them right now. You never know what changes your life will have on down the road, so I recommend you file these two forms from the start. There is no extra charge to file them with your AOS and it's better to submit them all at once. There has been much confusion coming out of USCIS, partly due to Covid-19 and partly self-inflicted. This confusion filters on down to the people filing for AOS. The above listing is subject to change at a moment’s notice so please check, recheck and check again BEFORE you send off your packet for any last-minute changes. Congratulations on a successful submission of your AOS packet!
