  1. Hello. My mom arrived here in the US last month. She has a tourist visa. How soon can I apply for her i-130 and i-485? do i have to wait for 90 days before filing? thank you
  2. Hi everyone. I’m going to try and make this short but any help is appreciated. I’ve been living in the U.S. with my spouse after an unplanned elopement last July, we filed for my Adjustment of Status concurrently with my I-130 petition, as well as my I-765 EAD, and I-131 AP. I am Canadian and crossed via land border to visit my wife for the Canada Day & 4th Of July holiday week in 2022. So I was not issued an i94, as well as did not have any valid visa status. But since I am Canadian I did not need a visa to visit. when we got married and decided I stay, we contacted a lawyer and he said it would be no problem since our wedding wasn’t planned. Fast forward to a year from then, my EAD has been approved and i’m about to start my new job on this coming Monday, but I just got a letter in the mail saying my interview has been scheduled for this Wednesday. When it comes to Bonafide evidence of our marriage, my wife and I have affidavits from our family and friends (we even lived with my father in law for many months while we worked through this process), we just very recently signed a lease and moved into our own apartment in the city so we do have a lease. I am on her health insurance card as a dependent, as well as I am a named insured on our car insurance. We do not have joint bank accounts because we just use an online no-fee bank and they don’t allow joint accounts. however, we just downloaded my wife’s tax transcript from the most recent filing year (we filed her i864 with the 2021 tax year and she’s since filed for the 2022 year) and we realized that her tax agency filed her as “Single” and not “married filing separately” (as I did not work in the U.S. that year and have filed in Canada for myself.) we did not realize this error until today, which is one week from the date of my interview. will the other evidence we have as a married couple be enough that the IO won’t question it ? Or will this severely hinder our chances of a successful interview ? She is filing an amendment for 1040-X to change her marital status with the IRS tomorrow, but it takes about 3-5 weeks to receive that confirmation. It was an honest mistake, as she has been using this tax preparer for years and we truly didn’t realize until right this moment. many advice on next steps? Or if I should or should not be worried?? thanks xx
  3. Need advice with drivers license! Has anyone else struggled with getting/ renewing their driver's license? The background info is: December 2022 I moved to Maryland on k1. Got my Maryland driver's license on AOS in April 2023, BUT it has the expiration of 4 months from the day I get it. Fast forward 3 months later which is today, I went to renew my license. They told me I need to have my green card to renew it otherwise, even if I renewed it today, it will still expire in a month. They told me there's nothing they can do about it because the expiration date is what the homeland security gives to the motor vehicle administration. Has anyone had this issue when trying to renew their driver's license? If so, what did you do to resolve it?? Any help is much appreciated!!!
  4. Hi i need to file my AOS within the next week. Adjusting from my K1 and have a few questions if anyone can help, they might seem a bit silly but i just want to make sure im filling them in correctly. Also I am still waiting on my marriage certificate, will this have my married surname on it? I-485: current legal name- do i use my now married surname for this and then put my maiden name in other names you have had? Assuming the name i use if i use my married name will be whats going to be on my green card when issued? then for immigration history details it asks for passport number on arrival, travel document number on arrival, expiration of passport or travel document and country that issued passport or travel document- question is do i use passport or k1 visa details for this section or does it not matter which one i use? status on form I94- would i write k1? what is your current immigration status ? Do i write k1? And to sign off on the form, if i want to use my new married surname do i use a signature with that name or do i use my maiden name / usual signature as it is what is on my passport? Sorry if these sound dumb, I’ve not had to change my name before. I-765: full legal name- do i use my now married surname again asks for my immigration status on arrival which is k1 and current immigration status- still k1 as i am still to file my AOS etc? And same with the signature i should use to sign off on I-131: name i use (does not ask for previous used names) Part 7- Advanced parole travel info? i dont have any trips planned so do i still fill this in, want it just incase of family emergency mainly ? and finally I-693: i had my medical and all my vaccinations ticked off complete before my k1 interview and have my DS3025 to attach to this. what parts of this form do i complete and not complete. if anyone can help clarify would be great.   5. Hello, We're getting ready to submit our AOS paperwork however even after thoroughly reading the instruction pages, we still wanted to double check/clarify a few things. Any input on any of the questions would be highly appreciated! On the I-485 AOS form, I just want to confirm that the K1 visa IS subject to the public charge ground of inadmissibility under INA section 212(a)(4) - (pt. 8 #61). I believe I choose yes which then brings me to #62. #62 - I am using my brother as a joint sponsor for my wife's petition since I don't have an income however my brother and I don't live together - would he still be considered in our household? #63 - Do I include his full income in our annual household income? #64 - Should we share my wife's savings account information as an asset (do we provide bank statement as proof?) #65 - would car insurance be considered a liability? We're living rent free with my cousin for now so we're unsure whether to include any liabilities On form I-864 Affidavit of Support, (pt. 7 #6- use of assets to supplement income) Should I add my wife's checking/savings info when it asks "Assets of the principle sponsored immigrant?" For reference, my brother as a joint sponsor will be filling out his own I-864 so he wouldn't need to fill this part out being that he exceeds the federal poverty guideline, however I will add my minimal assets, but I'm wondering if I should add my wife's savings account to both our I-864 forms. I don't believe I need the I-765 worksheet for K1 family visa however I wanted to verify that as well. Thank you in advance and good luck everyone!!!
  6. Hello everyone I arrived in the US on a K1 visa on 5/15 and married my fiancé on 6/23 we are organizing all the AOS paperwork to send it in the next few weeks. My fiancé was just offered a promotion at a new company and would start in 1 month from now if he accepts (at both his current and new job he would earn above +125% of the poverty line). - Do you guys think it can be a problem that it is a new job? - Is it better to send the i-864 with the information about his new job or send the i-864 with his current job? - What kind of evidence can we include? We can get a letter of employment but we would have at most 1 paystub from his new job, we also have the tax transcript for the last 3 years. Thank you very much.
  7. Hello, my spouse and I officially got married (she's on the K1 Visa), and we now have our Marriage Certificate. We want to change her last name to the married last name, but keep her maiden name as her new middle name (she has never used any middle names previously). She went to apply for her SSN and they said they can't do anything about changing names, and she has to wait until after AOS to update then. Now we are going to file for I-485 and I-765, I'm not sure how to proceed with the middle name and last name on the form in order to have the desired names. We're worried about when she can finally receive her green card, if the name will be incorrect. We're trying to do this correct the first time so we don't have to change her name through the courts later on. Thanks for any input.
  8. Hello, I have a quick question - my wife is filing for her AOS and we're a bit confused with the I-864 forms. I have been unemployed for a few years so we're getting my brother to sponsor her. Since I am the one who petioned and brought her here, I thought I still had to sponsor her and fill out I-864, and my brother would fill out I-864a as a household member. However in part 1, question #1 of I-864 it asks if "I am the petitioner. I filed or am filing for the immigration of my relative" (1a) which I assumed was the correct box to check off, but I see there's an option to check "second of two joint sponsors" (1e). -Does anyone know which one would be the correct one? And if my brother would need to fill out I-864 or I-864a? I really appreciate your help in advance and good luck to everyone with their journey!
  9. Hello all, I have 2 questions but first let me layout all the important details...I submitted an I-130 for my wife and another for my stepdaughter in August 2019. USCIS approved the I-130 petitions in April 2020. I filled out, signed and uploaded 1 I-864 into CEAC May 2020. I did not "Submit Documents" until much later due to a custody case that we were waiting on for our daughter. (Biological father has never been in the picture or helped out regardless of how much my wife tried. So he lost custody in 2021, which he never exercised to begin with.) All of our documents were approved and documentarily qualified in May 2023. Our visa appointment is in Ciudad Juarez, Mex on 21-Jul-2023. So, I've had 3 tax seasons in between that time. The I-864 has an "expired" expiration date. I used 1 I-864 for both my wife and our daughter. Questions: Expired I-864: Should I complete, sign and upload another document into CEAC? Or should I complete and sign an updated one so that my wife can hand carry it juuuuust in case they ask for a recent one? We have all of my tax documents for the last few years already. I cannot find where I read that 1 I-864 would be good for both of them. Even though the forms have been documentarily qualified, should I fill out one for my daughter? The one i uploaded to CEAC was the same one I did for her mother. If I should complete a second one.....upload it? or have it on hand in case they ask? Thanks in advance!!!!
  10. Hello- My brother’s stepmother filed a I-130 and I-485 on his behalf. She received an RFE in December asking for the affidavit of support form and supporting documents. She responded to the RFE, but she made an error by filling out an expired I-864. Needless to say he got a denial. We want to know what the best option is for this case. Should we file a motion to reconsider? Can we just file a new petition? I have attached pictures of the denial letter. Please help 🙏🏽

My husband came to the US after I petition him k1 visa year 2017 we got married the same year and I didn’t file I-130/aos right away and now we’re ready will it affect that it took us this long to AOS? I just started working will it be ok to just send my paystubs since I wasn’t able to file last years tax because we didn’t have income? Me and my two son was on calworks and calfresh during those year will it affect if we file our aos now? Should we just wait until next year so that i have tax returns to show?
  12. I have a question if my husband worked in the US over 10 years will I still have to file affidavit of support 864 and we did taxes jointly 2022. And I am also dependent on him financially. Since he is the main provider in our house. I am a stay at home mom. But we have to file for the 601a waiver for entering illegally and staying over 10yrs.
  13. I’m a k1 holder and I’m in the US. I married my spouse within the 90 days. My lawyer filed concurrent i-485 with “ I-130 “ In addition to i-765 and i-131. I saw people posting that k1 holders don’t need to file i-130. My pd is March, 31. My status is “ Case was received and a receipt notice was sent “. I don’t prefer withdrawing the process and wait again. I didn’t even have my work permit. What do you think guys ? I called my lawyer and they said they know how things work and just relax!
  14. I see websites (Boundless) say that the U.S. citizen sponsor must 100% meet the income requirements for a K-1 visa as a minimum, while it's 125% for the Form I-864 AOS. I am confused though because another website (VisaNation) says it should be 125%, and that the 100% only applies to active duty members of the Armed Forces. If ever the 125% does need to be met by a k1 visa sponsor, can the beneficiary combine her income (I work as a freelancer, and I earn around $1.8k a month) to her sponsor's? My sponsor at the moment can only meet around 105% of the HHS Poverty Guideline.
  15. Hi all, Thank you for allowing me to join, I read about the page on Facebook. A little about my background, I arrived in the USA on my visa waiver (WVP) for a 2 week trip with my USC fiancé, on the last day of the trip she asked me not to go home, stay with her in the USA and get married earlier than we planned. We are now married, I have overstayed my WVP and I'm out of status. We are about to file our AOS package. The question I have is, what date do I put in for the 'move in date' to her address for the I-130 and I-1485? Do I put the date I arrived in the USA, the date she asked me to stay with her, the date we are filing the AOS package or another date? I'm not sure if it complicates things, but I also have a lease back in my home country which I'm still paying for as obviously I didn't expect to be moving across the world without notice so I 'legally' haven't left that lease yet. Is it safe for her to add me to her lease in the USA as well? Any help would be gratefully received.
  16. Hello! My sister-in-law is petitioning for her parents to come to the USA and both I-130 applications have been approved (parents live abroad). We have decided to continue with her mother's process as her dad's case hasn't been created at NVC yet. She made around $30k this year which is enough for her to file an affidavit by herself. However we're not sure if she would need a co-sponsor when we she files an affidavit for her father. We're willing to help as we live in the same household. We made $38k this year plus have a house, bank accounts etc. Should we let her file only her as a sponsor for her mom and then add ourselves as co-sponsors for her father?
  17. I am married to my husband and I file all my paperwork for my adjustment of status. USCIS now wants my husband divorce papers from his previous marriage and now he refused to give it to me and he put me out of the house. I don’t know what to do? Can I apply for wawa without the divorce papers??
  18. Hello all, this is my first time writing in this forum. I was searching if there were any April 2023 filers, but couldn't find any. If there's one. please feel free to close this and direct me to it so we don't duplicate topics. I submitted in 28th of April 2023 and got a text that it was received on the 1st of May. Still waiting for the mail and so far no updates yet. I am new to this so lets se what happens next :). I know this would be a long journey so it would be great to not have to go through it alone!
  19. Helping my sister-in-law with her AoS and it got rejected. It appears they want a fee for the employment authorization. In checking my own application 10 years ago we didn't pay an extra fee for employment authorization. Thanks
  20. Hello everyone. I’m on here to ask for advice from people who have experience with the adjustment of status while in the US. I am Spanish and my wife is from the US. We met online two years ago and met over a year ago in person and have been visiting each other since, meeting each other’s family and friends. We got engaged in new years 2022 and decided to get married in Spain to file for the CR1 visa. we found out we were expecting a baby in early February and decided to get married sooner in Spain to start the visa process. However because of work and Spanish bureaucracy we decided it was easier to get married in the US with intent to going back together to Spain. once we were in the US and married, we had several medical visits about the baby and it was taking a huge toll on both on us the massive immigration challenge we had ahead and did not want to raise the child in two countries while waiting for the visa. She suggested we explore the AoS route but I’m worried the government might think we were committing visa fraud. In our defense we had already paid for the health insurance for her in Spain and were looking at apartments to rent together there. Is our case viable? Are we doing anything wrong? thank you in advance for your help.
  21. Has anyone ever had a name misspelled on any of their approval notices? I am filing my AOS forms for k1 and k2 and I noticed my husband's name is misspelled by 1 letter on the end of his first name on the I 797! What the heck! We never noticed this, which is weird because we scan everything to make sure it's correct and we are here in the states and married awhile now and finally filing! We never encountered any problems with that form or our visa and the misspelling but since I'm submitting the I 797 with my AOS packet, I'm thinking it could cause some problems. I submitted an e request to have it fixed but the wait time is a month and I wanna send my packet in ASAP with these new fees possibly coming In May. Has anyone ever encountered misspelling on any notices from USCIS? And if so what did you do? Any information or help would be greatly appreciated!
  22. Background: I am a USC petitioning my husband who is F1. The 130/485/etc package was sent in January 2023 and priority date is current. No movement except for biometrics. We met after he arrived on F1. My husband will complete his edu program next month however our lawyer is giving confusing advice. She says "you should keep going to school during AOS. Don't stop going to school." But she doesn't explain or offer any more info. He is not dropping out, he is finishing his program. I thought as long as he completed his F1 program, there should not be an issue adjusting as he followed through with the original intent of the F1. Questions: Does he have to enroll in more school or no? If yes: What about when his EAD arrives? He would begin working, which invalidates his F1 correct? So this conflicts with the "keep going to school" advice. We assume he will not receive or active the EAD anytime soon anyway, possibly not for many more months. If he does have to enroll in more school until his GC is approved, does he have to finish that program too or can he stop going once the GC arrives? Wouldn't enrolling in another edu program be considered F1 fraud as he now has immigrant intent b/c he filed for AOS? We can't afford to pay for school for potentially another 2 years. Would this be taken in to consideration? I believe the lawyer is advising him to stay in school in case of GC denial, he would have F1 as a safety net. But we don't really foresee a denial, our case is strong. If he is in fact denied, he'd have leave the US anyway. There is no point in remaining on F1 forever. Please help me understand what he is supposed to do next. Thank you.

Did somebody take foreign property as an sponsors assets for i864 form (USA) in Adjustment of status (AOS) process? if yes, what is the better way - to make foreign property valuation with foreign appraiser, translate it notary to English (with apostille?) or with American appraiser making evaluation remotely (if possible)? Thank you!
  25. Hello, it's complicated here but any suggestion appreciated.. I came to States under J1 (2 years rule waived) 09/15/2012 - Changed the status to F1.. while on F1, my wife's employer sponsored us for Green Card. She was on E1. Her status approved to PR but I got denied because didn't maintaine the F1 status for a week or so.. because I forgot to pay school fees and the school removed me from Sevis. after couple of motion applications and re-applications I kept denied. so we decided to apply for 601A along with the I130. I130 approved no interview but 601A got denied. Now my wife became a US citizen and I applied for AOS again on 04/04/2022 with my consular approved I130. On 01/13/23 I have my AP approved. didn't used it for travel still waiting.. no rfe or interview request since then.. what are my chance to be approved for AOS. no criminal record or anything.. no deportation letter.. it's been a year since I applied again, people keep getting rfe's for medical but I didn't receive anything yet.
