All, We sent the AOS package for my wife on 2/22 and got a 2/26 NOA. On 2/29 NBC MO sent Affidavit it of Support RFE, which I replied to on 3/12 via paper mail. I have been checking the USCIS page for updates and the EAD estimates have been consistent at 2-3 weeks. Well, yesterday afternoon the mailman dropped off my wife's SSA card (with the DHS work restriction of course). But the USCIS website still showed "in progress." What gives? Does SSA gets automatically notified when we submit package (or gets approved) and issue a card?

Hi everyone! I recently got a RFIE for my I-485, at this time I still don't know what the request is about but i am afraid it is related to my joint sponsor's I-864. When we filled for AOS my mother-in-law accepted to be my joint sponsor since my husband's 2022 tax transcript was below poverty line and we filled before he filed for taxes. Now his 2023 tax transcript is way above poverty line, if the RFIE is about it can we withdraw my mother-in-law form and send a new I-864 of just my husband's? I already uploaded on march 1st our 2023 tax transcript as a proof of bona fide marriage since we filled jointly. thank you so much!

On 2/22/2024, USCIS confirmed receipt on my wife's AOS package sent to Eglin. One week later they sent an RFE: "Based on the documents submitted, we could not determine that the petitioning sponsor on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P for information on the Federal Poverty Guidelines." I checked the form a thousand times. everything was filed out and signed properly. I included evidence of income for the past three years: IRS Transcripts, latest 1099 from the Social Security Disability, and a letter of benefits from the Veterans Administration indicating that my payments are permanent. My number of dependents (including my immigrant spouse and an adult disabled child NOT LIVING WITH ME, puts me a 3 people in the household, according to the worksheet. Even with her daughter coming next year (separate IR-2 petition), it would be 4 people in the household. On Page 5, questions 24.a,b,c, I wrote down my income over the past 3 years as per my Tax Transcripts for 2020, 2021, 2022. The IRS "computer income" is a bit below the 125% HHS Poverty guidelines because it reflects the reduction "on paper" of 85% of my SSDI being tax exempt. In reality between those two income streams alone my gross income is way over 125% limit for a household with 8 people. Adding my VA compesation, however, DOUBLES my annual income and makes it leap OVER the guidelines for a household of 15 people. I clearly stated my GROSS income on Part 5 (7), and Part 6 (20), which dramatically differs from the IRS tanscript, but for which I submitted official government documentation as proof. Having read beforehand that some veterans had problems with USCIS refusing to acknowledge VA disability compensation pay as a source of income, I included the following statements in the "Additional Information" page: "Real Gross Income is $xx1,711/yr, $x,316/ monthly: Military retirement ($x,124); Social Security Disability ($x,990); VA Disability Compensation ($x,202). VA benefits are tax-exempt and not reflected on tax records. 85% of SSDI is tax-exempt making Total Income Per Computer on Tax Transcripts artificially low." "IRS Tax Transcripts do not reflect VA benefits (projected $X0,424/yr for 2024) since these are tax-exempt and not reflected on tax records. 85% of SSDI is tax-exempt making Total Income Per Computer on Tax Transcripts artificially low." So my questions are: Are these forms machine read and therefore prone to "logic errors" or lack of context? Do they even bother to read the "additional information" pages for context? What new information am I supposed to send that I have not already submitted? *Should I send a message to the officer reviewing my case via the USCIS message tool? Of note, the letter was sent from- and must be replied to- this address. It is normal to parse out AOS packages to field offices? My assigned center was Chicago as I am in Maryland. I attempted to add the cases to my case (I-130/A) but recived an error message. Does the immigrant applicant need to open her own USCIS account in order to keep visibility of the process, submit evidence, receive notifications? See screenshot below. Thanks!

Basic info: Mom has green card >5 years. Has full custody. Dad is not in picture anymore. Stepdad is USC Child (middle school age) has visited during school break on B2 visa. After an emotional 3 week stay really does not want to return to home country, as they miss being with their mom and the mom can't visit frequently anymore due to work. So we are looking at applying AOS for a green card. Currently is authorized to stay 6 months. The process is complicated as always, but straightforward - but for a couple of items. I've looked around the forum for answers, but it does not seem common for kids to go through this process because they usually follow the parents. Unfortunately that was not an option at the time. So I have 2 fairly simple questions: 1. The "90 day" rule - from my research that is just a guideline to determine the level of scrutiny to put on an application. Is there a "too soon" to apply? 2. Since she is of school age, we don't want her waiting 3 months at home during the school year. I fully understand the B2 rules say that it's NOK to go to school on a B1 visa. But do we really have to wait until we apply for the AOS? Or would it be reasonable to send them to school since we plan to apply for GC anyway? Applying for AOS after 90 days is really hard due to these school obligations. Thanks all for your help.

Just like the title said. Is an EAD document alongside Drivers license enough or does passport needs to be carried too?

My mom has a pending i-485 but her EAD has been approved. However, my mom has work outside the USA. Its mostly online but I would like to know if thats okay. that she has a job that is not in the US. its on the business side. I’m wondering if she could get in trouble because of this. thanks

Hi, i filed i-485 for both parents. They received their EAD already but i-485 is still pending. we are currently residing in California however, my parents need to go to Nevada for a while because of an ill relative. Can they live and work in Nevada for the meantime since they are legally able to work already? Or do they need to live with me until i-485 is approved? thank you

Hello - I am going through the AOS Green Card process after coming to the U.S. on a K-1 visa and getting married. I recieved a Request for Evidence letter in the mail detailing that I have submitted an incomplete I-693 Form and that I will need to get another medical examination for the medical doctor to give me a packet to send to USCIS, this will need to be done by March 2024. When I was in Brasil for the Medical exam on 1/17/2023, I only recieved a DS-3025 Vaccination Documentation Worksheet. Which is what I included in the AOS packet latter after getting married, but I remember back in Brazil, the Medical clinic said that they'd mail info packet (presumably the I-693) to the embassy... and I went along to my visa interview and passed it just fine. The RFE letter I got is vauge and does not explicitly tell you what was wrong with the original I-693 form, but it does mention that civil surgeons must use the 03/09/2023 eddition and that USCIS will not accept the 07/19/2022 version if the civil surgeon signed the form after May 30, 2023. Do I really need to have another medical exam? Is there anything I can do legally? If I must get another medical exam here in the U.S., can I use a copy of the DS-3025 (Vaccination Documentation Worksheet) as my vaccination records, since what I have from Brazil is an old portugese card for vaccination that will need to be translated... again. That old vaccination card is literally what got copied to the DS-3025 I have... why would I need to do a translation again if I haven't had any new vaccinations since? This is my 2nd RFE and I am incredibly frustrated but beyond tired with the process to even muster emotion. It's been a long taxing, confusing 3yrs.

Ok, I searched for this particular question and could not find it here. I scheduled the medical examination for my spouse and the civil surgeon's office says that they do NOT provide an interpreter. I know this is in violation of The Civil Rights Act of 1964 and Executive Order 13166, and Title II of American for Disabilities Act. Before I call them out on this and create an unfriendly environment pre-visit, I need to ask the group the following: 1. Even if the civil surgeon provides an interpreter, it would be a remote over-the-phone session BUT form I-693 instructions state that the interpreter must sign and date the form. How can a remote interpreter sign the form? I did get two quotes for $260/hour and another for $100/hr. but if they cannot sign the form and USCIS will reject it, why bother? 2. If i were to find an interpreter to come in person, would he/she need to be inside the room? I have read that some doctors check breast, genitals, etc. Sounds a little uncomfortable. 3. Assuming my spouse can't produce vaccination records, which vaccines will she be required to get? I was told TDAP/MMR/VARICELLA/HEP B/FLU/COVID, but want to confirm. 4. How long did you all wait for lab /x ray results before picking up the sealed copy? Thanks so much for your help.

Hello! My fiance had a J1 visa when he was in high school, and in his home country, they literally take your old passport when you get a new one, so he doesn't have his old J1 visa. I don't know what to do, and I am kind of freaking out. It was from 14 years ago.

My Fiancee will arrive soon and we'd like to visit my mom and dad in South Texas, we won't have an AOS because we will not have filed for it yet (we have a NOA1 but for the K1 visa application, not for an AOS), we may not have even married yet, as we have 90 days to do so and my parents want to see her. Does that mean she cannot visit my mom and dad in South Texas without risking deportation or a legal mess? Of course we'll get married as soon as possible but it's good to know ahead of time if she isn't actually free to move about the USA. Thanks for any info guys.

Hi all, In the past I was married to an American citizen, did Adjustment of Status from an F-1 visa, received my green card, and had its conditions removed. My spouse and I then divorced before I could be naturalized under the 3-year rule. I later naturalized under the 5-year rule with no incident except for a scary interview with an officer who was grilling me on my past marriage, saying that I divorced too early (I was able to satisfy his concerns at the interview). It has now been 5 years since I have been naturalized and almost 10 years since I have been divorced. I would like to marry my foreign fiance and sponsor her for a green card in the same way that I was sponsored, as she is on an F-1 visa (currently on OPT). I am concerned that the officials will view my case very harshly -- do you think I am likely to encounter any problems?

Hello all, When it comes to Form I-864, income and taxes, my wife started a new job over a year ago, her federal taxes was less than what they require but her total annual income at her new job exceeds the amount needed to be a sponsor. She doesn’t have the tax forms for 2023, so what can we do to show them that she’s capable of sponsoring me? Also do they care more about your current income or your previous years from the taxes? We received an RFE so I want to make sure we don’t get another or possibly denied. Thanks

Hi. I am a U.S. citizen. I petitioned for my wife and my stepchild (13) years old. I mailed both concurrent applications at the same time. 3 months after filing my wife combo card approve nothing for my daughter. 3weeks ago ago my wife and I went to our AOS interview she was approved on spot but yet nothing for my daughter. Has this happened to anyone? How long before they approve her application?

Hi everybody, my fiance and I applied for k1 2 years and a half ago were approved and interviewed. Everything went well but was put on administrative processing for months with no apparent reason (Canada). We have been ready to get married for over a year now not knowing that this was gonna take forever… i am currently on a visit in the US to see him and we just found out we are pregnant. We both want to marry asap not knowing how long this administrative black hole is gonna take, can we marry spontaneously right now, abandon the k1 and adjust status instead? I had no intent of marrying on this visit i’m simply here to watch his sports season just like every fall, as he’s a professional athlete. I’m aware it will take months but atleast we will be together during these times. Please share your experience or knowledge on the subject! Thank you!

Hi All, My fiancee and I are in the process of finishing up the K1 process, with the hope that she will be able to come to the States this coming year. I have a steady (decently-paying) job, but a bit in the way of credit card debt. My fiancee is very smart, but hasn't yet finished college, and I was hoping that she might be able to attend a local university after getting her permanent residency, with the assumption that she might get it in 8-14 months. Now, however, I'm seeing that it could take her anywhere from 12-20.5mos to get her AOS, and I'm just feeling extraordinarily daunted by everything that lies ahead, particularly given that from what I've read, a person waiting on their AOS can apply to get a work authorization, but there is no such similar authorization for public college loans. I kind of feel like my financial runway just got significantly more complicated. Does anyone have any experience with this, or any strategies to get student loans while waiting on the AOS? My plan was to have her continue with her credits at a community college before finishing up at a 4 year. Thanks.

We filed for AOS for my husband on June 30th for his K1 visa. His EAD was approved on August 2nd and he received the card on August 12th. He received his 1st social security card on August 3rd with the "valid for work only with DHSauthorization." On September 13th, we got a notification there was a change in the status of his case and received a new social security card in the mail without restrictions. It is the exact same card number as the previous one. However, when we check the status of his case there is no change, it still says "case is being actively reviewed by USCIS." We have not received any written notification either. Has this ever happened to anybody?

Hi everyone. I’m going to try and make this short but any help is appreciated. I’ve been living in the U.S. with my spouse after an unplanned elopement last July, we filed for my Adjustment of Status concurrently with my I-130 petition, as well as my I-765 EAD, and I-131 AP. I am Canadian and crossed via land border to visit my wife for the Canada Day & 4th Of July holiday week in 2022. So I was not issued an i94, as well as did not have any valid visa status. But since I am Canadian I did not need a visa to visit. when we got married and decided I stay, we contacted a lawyer and he said it would be no problem since our wedding wasn’t planned. Fast forward to a year from then, my EAD has been approved and i’m about to start my new job on this coming Monday, but I just got a letter in the mail saying my interview has been scheduled for this Wednesday. When it comes to Bonafide evidence of our marriage, my wife and I have affidavits from our family and friends (we even lived with my father in law for many months while we worked through this process), we just very recently signed a lease and moved into our own apartment in the city so we do have a lease. I am on her health insurance card as a dependent, as well as I am a named insured on our car insurance. We do not have joint bank accounts because we just use an online no-fee bank and they don’t allow joint accounts. however, we just downloaded my wife’s tax transcript from the most recent filing year (we filed her i864 with the 2021 tax year and she’s since filed for the 2022 year) and we realized that her tax agency filed her as “Single” and not “married filing separately” (as I did not work in the U.S. that year and have filed in Canada for myself.) we did not realize this error until today, which is one week from the date of my interview. will the other evidence we have as a married couple be enough that the IO won’t question it ? Or will this severely hinder our chances of a successful interview ? She is filing an amendment for 1040-X to change her marital status with the IRS tomorrow, but it takes about 3-5 weeks to receive that confirmation. It was an honest mistake, as she has been using this tax preparer for years and we truly didn’t realize until right this moment. many advice on next steps? Or if I should or should not be worried?? thanks xx

Need advice with drivers license! Has anyone else struggled with getting/ renewing their driver's license? The background info is: December 2022 I moved to Maryland on k1. Got my Maryland driver's license on AOS in April 2023, BUT it has the expiration of 4 months from the day I get it. Fast forward 3 months later which is today, I went to renew my license. They told me I need to have my green card to renew it otherwise, even if I renewed it today, it will still expire in a month. They told me there's nothing they can do about it because the expiration date is what the homeland security gives to the motor vehicle administration. Has anyone had this issue when trying to renew their driver's license? If so, what did you do to resolve it?? Any help is much appreciated!!!
