  1. Hi, my question is in the title but I will give more context. I'm a British citizen married to a USC and we filed our standalone i-130 in November 2023. When he had to leave the UK after we got married we couldn't stand being apart so we decided that I would move to Tijuana, Mexico and he would cross every day to be with me. He works and will maintain his address in San Diego. I'll be moving to Mexico as a temporary resident by family. (Previously we thought of us each visiting for long periods but that has it's own issues) So that leaves which embassy i'll be doing my American interview through. On the i-130 I put I would be going through the London, UK embassy because that was the plan at the time. But now I will be living in Mexico I just want to be 1000% sure can I still have my interview in London? I have a flexible ticket back so I can easily be there. It's about 1.5 years longer going through either embassy in Mexico compared to the UK. and BONUS QUESTIONS: when I do move to TJ i'm thinking i'll need to let USCIS know. How do I do that? or is it only by the NVC stage i have to submit the documents? We had an extensive amount of evidence up until this point. I've submitted unsolicited evidence before, in this situation should I put through more? It's an odd one for my husband as he will have an address in SD and in TJ and we'll be getting a joint Mexican bank accounts together which was not possible because we lived in separate countries. Great bona fide evidence but is it odd he's living in 2 places at once? Or just he's visiting me or what? It's hard to get my head round. I'm not worried about him having loose ties to the US but should I be? Thank you and hope I put this in the right category although my post has kind of evolved with these extra questions.
  2. Hello all, Years ago I started my immigration journey to the states and a year and a halfish ago I became a US citizen (now ha e dual canadian/us) via a marriage green card! My husband is a US citizen. As we are looking to start a family, we are considering moving to Nova Scotia where my family is, as housing is affordable and we want to be near my family as we have kids. This website seems to be US based only, but does anyone have any knowledge on the following questions or point me towards someone/a website who does? I've looked into lawyers and even the cheapest ones are so unaffordable. Money is really tight right now for us. 1. If I move back to Canada, will I lose my US citizenship? 2. Most importantly, the process to essentially start all over again in a different country with immigration is so daunting. This website was enormously helpful and there doesn't seem to be anything like this for people moving to Canada. Does anyone know what the immigration process would be like for my husband? I'm curious how he would work (as he is the main breadwinner) and what the steps to apply for marriage based Canadian citizenship would be like for him. 3. He works for himself, also curious how that would be impacted by moving countries/immigrating. Starting his business again on the other coast. 4. How does this work with his US citizenship- does the US gov really care that much or could he have both? I am sorry if this is totally the wrong place for this. I'm just so lost and anxious and this site was such a saving grace for me before. Helpful answers would be so appreciated, from one human to another. Thanks!
  3. Hi everybody. I searched the forum hoping I already started a similar thread where I could provide an update without success. My situation: I'm currently in the middle of move. In a few days I'm leaving rented place and moving into house, my lovely USC spouse and I purchased recently. The move out date is already agreed upon with the landlord, most of the stuff moved except some furniture. In preparation I set up USPS forwarding and changed address with DMV. I haven't filed AR-11 just yet, since physically I still live at rented place. Yesterday, out of blue, I got a surprise email saying my I-751 got approved and card getting produced. I doubled checked myUSCIS and the status confirms this. What do I do, what do I do, what do I do? 🥲 File AR-11 ASAP, prior to move? Leave as is until the move and ask landlord to check mail so I can pick it up? I really thought the probability of this happening to me was low, but life proven otherwise. Worried that GC can get lost or returned to sender. G-28 has boxes to send approval letter to lawyer, but card to my current rented place.
  4. My wife is a citizen of Singapore, a permanent resident of Australia, and a green card holder in the U.S. She arrived in the U.S. on a K-1 visa, and we successfully adjusted her status (I-485). She is on a temporary green card, and we have a letter from USCIS stating that its validity has been extended into 2025 (48 months past our I-751 filing date). We have been waiting over two years for her Removal of Conditions (I-751). For several reasons, we intend to move back to Australia next month. We can’t postpone this move further due to Australia's Resident Return Visa (RRV) rules. Because my wife has been outside Australia for over 4 years, the Australian government has told us that they will require her to get another visa if we delay the move further. Currently, we are not considering this to be a definitely permanent move. We need to try living in Australia first and determine if living there will be a better fit for us. We need to sell our house and cars to be able to buy a house and car(s) in Australia, so for now our ties back to the U.S. will primarily be my job (as a full-time contractor of a U.S.-based company) and my parents (who live here). If our house here does not sell, we will still own it and will pursue renting it out. We will also continue to file U.S. tax returns — and Australia tax returns when we have become tax residents there. I have seen some topics here at VisaJourney (like this one) about this type of move, but they are from years ago. I am not sure if the laws have changed. I am trying to find out how she can get back to the U.S. if we need to come back. So far, she got an I-131 combo card (EAD/AP) during the Adjustment of Status process, and she has already had biometrics taken for Removal of Conditions. What is the re-entry permit that we need to get for my wife? (Is this the same as either the I-131 Advanced Parole for the combo card from our I-485 process, or the Returning Resident Visa for the U.S.?) Does my wife already have this re-entry permit based on having a conditional green card (plus USCIS’s extension letter and an I-551 Extension stamp in her passport)? How long does my wife need to be in the U.S. for this re-entry permit to be processed? (She already had biometrics taken as part of the I-751 process.) Can we make the deadline of moving to Australia by a month from now? If not, what is our best option? Can my wife be outside the U.S. while the re-entry permit application is being processed? Is my wife’s (future) job with an organization based in Australia or the sale of our house a red flag? We most likely do have a place to stay temporarily if we need to come back to the U.S. Do we need to buy round-trip flight tickets to Australia? (One-way and round-trip to Australia are currently about the same price. But I don’t see why we should get another ticket to come back to the U.S. when we would need a round-trip ticket from Australia in order to make a trip back here.) Will changing our mailing address with USCIS to my dad’s address have any tax implications for us? (His state has state income tax; our current state does not.) What would happen to our ongoing I-751 application if we leave the U.S.? Will it still be processed?
  5. Hello, my wife (US citizen) and me (German) live in Germany, already for 10 years now. Before we had been living in the US. When we moved, we brought our household with us, at least a good amount of it, and were able to ship it without paying any custom taxes. However, some nice furniture has been sitting in the attic of my wife's parents ever since. Now we would like to ship it to Germany. Is there a way to avoid having to pay custom taxes in Germany for importing those pieces of furniture? We know there is a 12 month limit for shipping household items as part of a move...   6. After receiving IR-1: When does the IMMIGRATING SPOUSE no longer have provincial health coverage? (Aug 22 or Aug 23?) When does the US CITIZEN SPOUSE no longer have provincial health coverage? (same as immigrating spouse or date of physical relocation?) When do the CHILDREN no longer have provincial health coverage? --Using the following dates-- Currently resident in Canada Aug. 22, 2022 - Endorse IR-1 (I-551) Nov. 10, 2022 - Physically move to US as a family It's insane trying to communicate with RAMQ (Quebec). The waiting list is currently 20 days to ask a simple question.
  7. Hey, all! Here's the short version. My fiancee (Canadian) is just about ready to move! She's coming to the USA on a K-1 visa. It's (long) driving distance. I know that she can only cross the border one time with the K-1 visa. But, can I move her stuff over two trips? Last time I tried to take some of her belongings over the border during a trip home (a few weeks before the K-1 visa was approved), I got held up and eventually turned away, as she was not accompanying her stuff. The border people pulled me into secondary and verified all our info, and one of the last questions they asked me was "so is her visa approved yet?" which suggested to me that that might be a deciding factor in this issue. My answer was no. Ultimately I was told I am not permitted to bring someone's belongings with me over the border unless they are present. If she is present with me for the first van full of things, we presumably will get through fine. But what about a second trip with just me? Will I be able to cross into the US with a car full of her stuff if she's now legally in the US on her visa? (To head off the most obvious response questions: I cannot get a larger vehicle than this 9ft moving van in time. We also (I believe) don't have time to arrange a stuff-shipping service such as U-Pack or U-Boxes. If anyone has creative ideas I haven't thought of, they are more than welcome and we are desperate for them! Moving distance example would be Toronto to Boston, about 500mi/800km.)
