    Hello everyone and salam
    as some of you may know, I am married to an American citizen, applied in Feb. 2016 and it was smooth until I got my interview scheduled in Jan. 2017 then I have been on AP since then
    I got a call from the embassy about a month and a half ago asking me to send them new medical exam, new police certificate, my passport and resubmit the ds-260 online after they reopened it for me
    i did that then once they received it they sent an email asking me to schedule an email, it was confusing because it was one of their molded emails like the thing u wud get from NVC so I emailed them and they said it is for retaking the oath (I guess it is since I resubmitted the ds-260) I scheduled it and attended last Sunday and the African American small cheerful man told me congratulations and that I will have my passport via aramex in two weeks after making me swear that the data is correct
    got one update that day and another yesterday but nothing serious  
    i hope this gives you some hope  prayers for everyone including myself

    A lawsuit is built up in 3 different stages:
    Complaint.
    Court.
    Further litigation needed (or end result).
     
    Essentially, you may only need to file a complaint without having to go to court (read my previous posts about this). So, you can arrange it with your attorney to pay a certain amount for every stage: the higher the stage, the more money you'll have to pay - this will greatly decrease the financial burden on you. So, say 5000$ for complaint, and 10,000$, IF it goes to court.
    (Showing that you understand the process with the attorney will greatly help you, because lawyers want all the money they can get from their clients, win or lose that is. So, paying the entire amount, even in payments, is ridiculous, especially if it doesn't go to court at all).
    Also, each payment can be split and made in smaller payments, say you can arrange to pay 5000$ in 6 months (works for most people, and attorneys).
     
    Complaint and court work are sooooo different, speaking in terms of work load of course.
    A complaint can be prepared within 3~5 days, but court may require a lot more than that for sure.
    Don't forget to discuss hidden fees: some attorneys will bill you for mailing or printing fees, that are sometimes ridiculously overpriced.

    That's not true.
    First, the result being good is a subjective view. I see that either result is good, and this is the objective view.
    Second, it doesn't necessarily have to be 60 days, it can be any time frame you would like to give. I say 45 days are as good as any other time frame in certain case where background checks are most likely over or should be over (such as after 1 or 2 years of AP).
    Third, just because background checks are not done it doesn't mean they will issue a final decision. A lawsuit usually ends being settled, that means without having to go to court (in which case a final decision MUST be made), but rather they will contact your attorney and ask to drop the case against them, and in turn they will give your case a priority within a time frame that they usually specify. So, an initial final decision, that's a denial, is almost unlikely. Again, unless it goes to court, only then MAYBE it will get approved or denied. And, only then you can actually know if your case is being held up because of background checks or not, to begin with.
    Forth, it's highly important to include any federal agency, as the defendant on the case, that is responsible for performing background checks. This will usually cause the checks to be expedited and will save you from being denied based on security checks, because the agencies will quickly work together to finish your case.
    Finally, generally speaking, the lawsuit forces the responsible federal agency for the delay to "expedite" its conclusion on a case.

    Our interview was on March 15th.
    I'm hoping for AP that's 3-4 months. Of course there's no guarantee.
    At the interview they said it shouldn't take too long. So that gives me hope.

    I sorry to hear that about your friend. I guess that's would be a good sign for his case to get approved. The second interview usually comes whenever the CO want to determine something in order to complete the case.
    But being in AP whole entire year that strange. Would you please check with your friend if his case was updated during the period of the AP or the last update date still back to 01/27/2015 ?.

    hello, we sent an expedite request on Nov 12, got an email reply saying under review on Nov 17. Haven't heard anything afterwards.....wait wait and wait
