Hi everyone. My wife, little son and my self are US residence, and next year are applying for became USC. We have over 21 son in Bulgaria. He was married, but divorced after that. He has one child of this marriage. How should we proceed in this case with our child and is there any matter that he's divorced ones, if he's not married at the moment of applying for visa. Timeline? Regards.

You would need to file a I-130 for him as a over 21 year old unmarried.... they wait time for a visa is about 8 years....

ohh, that's wonderfull... sad.gif There should be some way to run faster... When we were interviewed at consular, they told us he can join us in us after 5 years when we became USC if he's not married... So I think there should be some way, otherwise why did they told this?

FAMILY-SPONSORED PREFERENCES

First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.

Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent
Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:

A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;

B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.

Third: Married Sons and Daughters of Citizens: 23,400, plus any numbers not required by first and second preferences.

Fourth: Brothers and Sisters of Adult Citizens: 65,000, plus any numbers not required by first three preferences.

If you had an approved I-130 on or before the date shown then a visa application is now available to you...
