Full Version: Questions about a K3 visa living in Beijing with a pregnant wife

Okay, I'm just in the beginning of this process and I've begun looking at the information here and other places but still have some questions.

I'm very soon to be married to a woman who's a resident of Tianjin (her "hukou" is in Tianjin) but who is living with me in Beijing. She's pregnant and our child will be born sometime near August of 2008 (yes, right around the Olympics). We were originally planning to wait a bit and do a K1, but with the unexpected appearance of the pregnancy we've decided to get married.

My first question is, is there any way for me to file a K3 while still living in Beijing or do I have to return to the states. It doesn't look like Direct Consular Filing is an option in Beijing.

My second question is, with the child coming, but not having yet arrived, is it okay to begin the application process now or would it be easier to wait until after the child has been born.

We're hoping of a date about a year from now for leaving China. Is this realistic if we start the ball rolling?

Any help is greatly appreciated.

start your process for your wife now, if your child is born he/she will become US Citizen if you from the state. from what i know if your child born in china all you need is the birth certificate go to embassy make the passport for the child. there is no need to let him become chinese citizen and do all paper work.

i hope it help, just do your wife paper work, i-130 is faster than k3 i think

If your resident status qualifies, you can definitely file DCF through Beijing but all interviews are in Guangashou. Otherwise, you can certainly file any petition by mailing them to the appropriate service center from anywhere. Be aware FedEx etc. don't deliver to PO Boxes.

Thank you everyone for the replies. So I misunderstood what the Beijing embassy said as meaning that you could only file a DCF through Guangzhou. If you're right, pushbrk, I'll start the process as soon as I can (though I'm going to have to get a new visa soon, so I'm going to wait for that to come through). I'm assuming the resident status spoken of here means a "Z" (resident) visa?

So do I file for the DCF, K3 or I130? Also, with the K3 and i130 do I have to be in the states? I live in China.

Regardless, you will have to show domicile in the US. A bank account, intended address (even if with family etc.) and a valid drivers license will do.

DCF is immigrant visa only with I-130 petition. If you have a resident visa, I highly recommend DCF.
