Hello everyone. I been waiting for the NOID letter from USICS anyone got any idea how long it take for them to send it out.it been over a month since they said the case returned back to the US. will it included instruction on what i have to do next ?. aslo what step should I take to make the case send back to HCM for process again? or I have to start all over again?. my wife did talk to one of the lawyer in VN. she had to paid $100 just to met him. He ask all kind of question and say if we want we can hire him for $3000. He will takecare of our case. I really don't know what to do now any advice really appreciated.
also one more thing. My sister would like to come here on touris visa. anyone know what is the minimum income required for this. I see some website said 17000 for 3 person. and someother say 21000. thanks alot.

Let me tell you about my friend’s story (he’s now in Vietnam).
His fiancée had an interview on March 2007 and it was denied. She did not get a white slip, but a green slip (it said, the case will return to USCIS). He was there while fiancée had an interview. However, He hasn’t received anything since US consulate notified on the green slip. Thus, He made another trip to Vietnam last month to get marry. He will come back on Jan 2008, and will petition I-130 with a waiver.
I’m not sure if it comes back. Because the NOA2 has already expired (I guess), and USCIS will not work on your case base on NOA2 expire. In my opinion, you have to petition again (I-129F or I-130) or you can ask ppl around here.
For a person visit US. It’s easy for them if age is over 50 years old. Otherwise, they have to prove assets, etc… that they will return to Vietnam.

I am supposed to get a NOID for our CR-1. Tuyen's interview was in Aug 2007. According to my Senator, from the time the USCIS gets the paperwork from the NVC it could be 9-18 months before they process it and get the NOID sent.
Here's what I am doing.
I hired an Immigration attorney
I gathered up additional bonafides
Once I get the NOID, I will respond to it immediatly with the additional bonafides.
If approved they send it back for another interview.
If I have to refile with a waiver then I will.

Our case was sent back in December. I never received any NOID. In May, an email sent to my congressman from CSC stated my petition had expired and they won't look at it and I may file a new one. You should prepare all your evidence like Kevin did, in case you get a chance to appeal. You should also get your senator or congressman involved because they are a good source for getting info about your case status.
