Full Version: Husband is filing divorce

Hi all,

My lifting condition is still pending (filed joint on July, 2007) and my husband is filing for a divorce tomorrow. Do I need to resubmitting I-751 form or just pray and hope to hear a good news? I haven't had my biometrics yet.

Also, we filed at NSC last July, but I haven't received NOA letter yet. What should I do at this point?

I am very surprised that you haven't received your NOA1 yet. Do you know that Nebraska actually received your I-751?

Sorry I am not much help on the divorce aspect.

While it is strange that you haven't received a NOA yet, if the INS processes your application soon, you will have filed a joint application and that will be in a way fraudulent because of the pending divorce.
IMO, the best thing for you to do right now is talk to a good immigration attorney. My guess would be that you have to file a new application once the divorce is final and explaining why the application is late.

This is not true. There is nothing fraudulent in the US citizen spouse, jointly petitioning to remove conditions even if the marriage is headed towards divorce and in a terminal state. HOWEVER, if the couple's marriage is legally terminated (i.e. the court declare it is terminated) then the alien MUST withdraw the joint petition and replace it with a waiver. In the event that the parties are NOT residing together, they should make that clear on the forms and file the appropriate change of address forms with USCIS, so that they have not misrepresented the status of the marriage.

Are you sure that your husband didn't pinch the papers? It's
suspiciously long, at least you'd have got NOA by now, and
extension... They very often do, as a revenge.
