well interesting .....I just got an email from my Senator and she told me that VSC told her........ "this case is in the processing area as of 1/10/08 (today)—the petitioner should be hearing within approximately 30 days".......she keeps following up for me even without my request.....at least I have been impressed with her continued interest....she also told me they are actively working on some kind of hearing.......which of course I would be interested in testifying on behalf of all of us......the clients......rrrrrrrrrrrrrr.......I hope and pray this can be fixed.....too late for me, Virgil, Ric, Charlene and Mirla but maybe for the future.......Lora

As a side note, I tried to call using the RFE trick today because I thought I might be getting close with all the Sept filers approved lately, I couldnt get a RFE person and it kept kicking me to cust. service so I tried back about 10 times and still couldnt get a hold of one so I just let it take me to the cust service people. This is at 430pm CST. The cust serv rep told me that my case is still pending and I was still in the 6 month timeframe. She added they are currently working June 19th petitions. I check the CRIS website at 730pm CST and it shows approved. Shows what they know.

If I understand your question right, it would mean that say your 6-month mark is was December 30, then 30 days out of that would be January 30 or later.

so.. is it not six months anymore at all? Is it June 18th plus six months plus one month? my brain baffles.

Thank you all again for taking the time to answer a newbie's questions during a very difficult time. Since then I have come back every day to check on the progress of your petitions as I educate myself on the process. For some reason I felt drawn to your previous VSC thread and have followed this one since it's start.
As it stands now, Russell has been back in New Zealand for 4 months. I finally (after more than 2 years) had my court date for my divorce in December and we will be able to file for our K1 in April when it's final. Yes, I will be overnighting to VSC the very day I receive my decree!
Things are moving along for us but it will be some time before Russell can come back home. Happily, I am travelling to NZ a week from Monday to spend 3 weeks with my love. My mother (whom the tickets were a gift from) will be joining me so that she can meet his family and see the BEAUTIFUL country he is from. I cant wait!
I am utterly disgusted by this entire process and my heart goes out to each and every one of you still waiting to be with the one you love. I'm sure you feel for anyone that has to endure this but it certainly can not be easy to watch as others who filed so much later be approved.
The real reason I posted.... selfishly, I want to thank you for being such a strong voice in this process and working so hard to make the changes because I am one of those people who will be filing in the months to come and I am hoping beyond hope that the VSC straightens up before then! If there is anything us lurkers can do for any one of you waiting please feel free to ask.
My best to each of you. I'll be watching.

I was told by a customer service rep. that you had to be 60 days past receiving any correspondence from VSC and 30 days past the 6 month period....

I dont know if I will get in trouble for saying this, but with the way that VSC is processing petitions right now, I would consider filing RIGHT NOW!!!! Leave your divorce decree out and you will get an RFE. If you send your petition now, it will probably be mid May before they look at it, you would have the RFE by the end of May and probably be approved by the end of June. If you wait until April, it will be probably mid August before your approval. You will save 2 months on the process from now, even with the RFE.

According to the post, her divorce will be FINAL in April. You cannot file an I-129F unless you are free to marry at the time of filing. It's a horrible requirement, but basically it means that she would receive the RFE, she'd send in her decree, and then they'd see that she was not free to marry at the time of filing and reject her petition. $455 out the window. Unfortunately she's going to have to wait until April. Unless I read it wrong.

Does anyone know how long after NVC sends the paperwork to the consulate how long before I get the packet????? Not sure how long England takes or how to find out!

we got noa2 on 12-18-2007. we filed on 08-21-2007. thanks all the support from people here.it really helps in the long journey. my fiancee already finished the medical and i am in the process of sending her financial documents. then she will go for the interview.

thanks Charlene....I know your ordeal is worse then mine.........It has been since June since I have seen Oscar and I was suppose to go to Peru Jan 3 but I could not get medical clearance for the pacer I have until January 23rd so I am leaving that day andcoming home on the 28th because my daughters birthday is the 29th....short but I am dying to see him face to face.......I hope to go for the interview by late february or march but we will see Lima is a fairly quick embassy....I have been told.......I hope.......thanks again you guys

Hey guys. I jsut worked ten hours straight and my brain isnt' working when I try and figure this out. How do you figure 30 days out of processing .. for a date?
Sorry to give you some bad news on this, but the beauty (from vsc perspective) of having a set processing date like june 18 and adding 30 days is that TIME NEVER MOVES. Unless your received date is within 30 days of june 18, i.e., may 18/19, you can NEVER get to that magic 30 day mark!!!
So we won't be able to ask for service until they admit they are processing july 6 (received june 6), in my case for example. Who knows when that will be, and meanwhile they are processing october petitions. So we are stuck with waiting for them to post updates and hope the dates don't go backwards like they told Lora once!
But anyway, it doesn't seem they give a $%^# about service anyway so what good is a service inquiry?
I really hope Lora's Senator is able to get hearings on this so there will be some consequence for their fouling up this process.
