Full Version: I130 and I129f HELP PLEASE

We are WORRY unsure.gif , Our Lawyer sent me an email yesterday,,,, how true is this ?, please help me..it said,,,

Your case has no been decided yet and it will be delayed. Immigration has publicly informed that they have a backlog due to a large number of cases filed after they announced their price increase this summer.

Their announcement says cases will take 12 to 16 months longer.
I had advised you to file the I-129F K-3 non-immigrant visa after the family based petition I-130 as a strategy to shorten the wait for your wife to enter the U.S.

I think the National Visa Center may issue paperwork to begin the immigrant visa process and we may want to look at the strategy again.

I will keep you posted.

There was a recent announcement by USCIS that stated that Naturalization cases file after June 1 will take as long as 18 months. Maybe your lawyer is confusing this with Spouse/Fiance cases. All cases will likely take longer than usual, but the 16-18 month estimate is specifically for Naturalization (citizenship) cases.



As a result, average processing times for certain application types may become longer. In particular, naturalization applications filed after June 1, 2007 may take approximately 16 - 18 months to process.

I hope unsure.gif this is very frustrating .. I see to other cases approved already, with petitions file later that ours and we are yet in waiting

"12 to 16 months longer" is not correct. Longer, yes, but not that much longer. It's a public announcement you can read for yourself.

That does not seem correct. The trend right now is for the I130 being approved before the K3. Please read my post in myprofile. I just got of the phone with my lawyer. My I130 was approved 2 months ago. Now i am afraid they will cancle my K3.

Well from what i understood they are planning on hiring more people to work on the cases too. Am i wrong?

1600 more employees i believe was the number. I might look them up for a job.... jk

The policy since November 06 has been to approve both the I-130 and I-129F petitions together and then hold the I-130. Your timeline doesn't indicate you ever filed an I-129F. You don't pay I-864 bills if you want a K3 visa.

In another post some one state that since I had paid my nvc bill for affidavit of support, I am on the CR1 Route. My 129f was recieved sept 26th.

I wouldn't think it would take THAT long to process. I'm pretty sure they are talking about something else. Don't get too stressed smile.gif

my husband is angered mad.gif by this situation, we will wait 6 months, this is next Thursday 13 and these day He will call to USCIS and ask for an explanation. unsure.gif

Yes, well when you file the two petitions so far apart in time, they don't end up together. I think filing the I-129F in your case was a waste but at least only a waste of time. I suppose it's some sort of free insurance you'll never need.

Up until this evening I been running around VJ thinking I was a July Filer. My I130 was approved in September. I was thinking my I129F/K3 should be approved by now or within the next couple of days. Well then I compared the receipt date of my I129F to other peoples receipt date. I have come to the conclusion the my lawyer did not file my I129F petition until Middle of September. I129F receipt date is September 26th. My lawyer has a new assistant now. How can I be sure that the rest of my process will be on time.

The only way you can be sure of anything, is to do it yourself good.gif

Your lawyer will work at the speed he works at, as will his assistant. Your priority is your petition, your lawyers priority is every case on his/her books. Most people on here, myself included, don't believe a lawyer is necessary for a straightforward case, some choose to let lawyers do the work for them. Neither way is right, and mistakes can happen either way.

WE paid extra for the K3 service and the work permit and AOS, because you file the K3. As pushbrk mentions filling the K3 that late is a waste of time. If I do the math It might save us a Mont of waiting at this point. So it seems smarter to finish through with the CR1.

He talks about expiated service all over his site. He has neglected his claim.

I checked out the USCIS processing times for the CSC https://egov.uscis.gov/cris/jsps/Processtim...eviceCenter=CSC

They still show a processing time of 6 months on I-130 apps, and processing I-129F apps from April 29th 2007, thats going on 8 months. I'm guessing your I-130 will be approved long before your i-129f.

I don't see much reason to worry.

Hey the reason they were to different places was because my Lawyer gave me the wrong receipt number. He still doesn’t know my NVC number either, because he can't access my information with the incorrect receipt number.
I had an apt at the USCIS today. I made it less than 24 hours. They gave me the correct I130 number. My lawyer filled my K3 3 days after the approval of our I130, which was approved in 67 days. Oh we paid extra for that service too.

Nvc mailed my lawyer bill Oct 16th, my lawyer did not inform us until Nov. 15th. We overnighted check. The NVC does not have the payment yet? My lawyer will not return my calls or email requesting what happened to the check and what is the tracking number.

It seems like we rarely hear anything good about immigration attorneys. I'm glad we went without one.

Wow, that's too bad about your lawyer. I got the basics from a family friend (who is an immigration lawyer) and filed it myself based on her recommendation, saved me a bundle!
