Full Version: Anyone get RFEd for missing W-2s in I-751 filing?

Has anyone gotten an RFE on an I-751 because they didn't submit W-2s with their tax returns?

I know this happens sometimes with AOS cases since the W-2s and returns are used to determine the sufficiency of the Affidavit of Support, but I'm curious if this matters quite as much for the I-751 where the goal is to prove the marriage is bona fide.

We submitted the paper copies of our federal returns (without W-2s) from our tax preparer. The copies are not signed and dated because we e-filed. However, we also submitted printouts from the Virginia tax website confirming that we e-filed our state taxes.

I'd be surprised if we got an RFE given how much other evidence we submitted, but I'm just curious what the chances might be.

Personally I have no knowledge of this, but I would guess you wouldn't be very likely to receive RFE for this. Tax returns are not a required documentation and even if you do choose to send them in I don't think they would require the W-2s themselves.

i did the same as you... I just sent in the forms we got form the accountant and no W-2's and we were approved.. we did have a boatload of other evidence too though...
