Full Version: Affidavit of Support for K3 - do I need I-134 or I864?

Hi friends-

I have applied for a K3 visa for my wife and her interview is scheduled on Dec 20th and she needs to submit her papers to VFS in the next few days. I have a bit of confusion -
My wife had picked up packet4 from Mumbai Consulate and the documents required list I-134 as affidavit of support. However, when packet4 came in the mail it said to submit form I-864 as affidavit of support to VFS.

Which one is correct??? Please help!

Typically the I-134 is for K-1/K-3 and the I-864 is IR/CR-1

Also, does the I-864 have to be notorized?

However, from my prior VJ readings, Mumbai (and I think some other embassies around the world too) seems to be requesting I-134/I-864 at their own will and/or discretion(sp??) per say .. especially for K3 visas compared to any other visas... That seems to be a bit of a gray area for K3... Just like some emabssies treat K3 as an Immigrant Visas and some as Non-immigrant... though we all know, techincally, K3 is an Non-Immigrant visa on paper...I believe this totally depends on the CO at the post/embassy as far as what they will and can request.. I believe there have been some threads in regards with I-134 and I-864 in conjunctiuon with K3 visas...

IMHO, since you still have some time before your wife's interview... and since it doesn't take much to fill out an I-864 and since it DOESN'T need to be notorized .. I would say go ahead and mail one to your wife.. Just to be on the safe side.. It wont hurt... Thats what I did.. I filled one and sent it to my wife along WITH I-134... so if they request it from her at any time then she is ready with it...

I have the same exact question.
But on the packet 3 PDF it says:
If form I-864 and its supporting documents have already been submitted to the National Visa Center (NVC), the documents will be forwarded to our office by the NVC and will be reviewed by the consular officer during the visa interview.

So why does the VFS need it again?

Also just to clarify, what is the Packet 3 exactly composed of?
1) The Packet 3 PDF Checklist/ Applicant's Statement Sign-off (From mumbai consulate site pdf)
2) DS-230 Part 1 + Photographs (2)
3) Passport Copies (Biographic Data/Parent Names) First/Last Pages

Is this all? Hope someone can confirm. Thanks a bunch.

I guess they need it for their own records , or may be the supporting Docs NVC has stopped sending or they r getting late . and for K3 I think we have to submit I134 and for IR/CR case we have to submit I864

Please check consulate website again or email them again

It seems to me that Mumbai Consulate is requesting I-864 even for K3 cases now. My wife has her K3 interview on Dec 20th and she asked at the Inquiry counter about Affidavit of Support and which form to submit for the same and she was told to submit I-864. I just mailed her the signed form just to be on the safe side. The other supporting documents required for I-864 are pretty much the same i.e. Tax Transcripts, Empl. Letter, Bank stmts, etc.

I guesss Mumbai Consulate has got too demanding... seeems lots of ppl immigrating from Mumbai Thats why more and more paper evidence is required
