I have a Question: Can a B1/B2 holder vist the US, while the Green card is in process? I had heard that there could be a resistance in POE and could also be deported which is likely to impair the GC process too!

Can the anyone/ columbian embassy answer this question? Thanks in advance.

Excellent question! I wonder if Colombian embassy gives as vague of an answer as I got from Paris blush.gif blush.gif
My impression is that many of people do go for a visit at various stages of the process and they get through OK. Although be prepared to show a bunch of evidence that you will return back to India. Do not volunteer information either...
BUT, I have seen two cases on VJ where people tried to enter the US (one time even BEFORE filing anything, just due to frequent visits), and got turned around (voluntary departure) and had huge problems, because their visas were stamped with denial of entry and misrepresentation. So, to fight misrepresentation one needs a waiver and otherwise it is a ban (5 years, I think).
Be careful...

Thanks Ricka!! It looks like there is a 50:50 chances to allowed inside!!

Anybody as any similar experience, kindly share!

Thanks.

You are flirting with disaster, do not travel in and out of USA unless you have the AP, the tourist visa is technically supposed to be null and void while you are doing this, anyway that is what I was told by US embassy officer when I was checking out all my options last year. whistling.gif

hi! i did use my b1/b2 visa last christmas and experienced no problems. i just told the cbp officer our papers are still pending she just asked how long i'd be staying and to see my return ticket. after which, i was let through without incident.

was going to use it again this christmas, however since we already got our interview date we opted to save on the fare and just wait for when i finally fly with the hubby for good.

my two cents, as long as there is no intent to defraud or misrepresent ones purpose of entry using the b1/b2 visa, there wont be any hassle entering the US even while your case is pending.
