Full Version: wife divorcing me due to illness

my wife (us citizen) is divorcing me due to me having a illness...she says she cannot cope with the illness, so therefore she is going to divorce me.. we filed jointly in may for the conditions to be lifted on my resident card, but have not yet recieved the new card or a interview....

what steps do i need to take in order to make sure that i still get my 10yr resident card?

the marriage was legit (i did not mary her to evade immigration laws), so the marriage is ending due to my illness..do i still have a chance with my residency?

she even stated to my brother that she is filing coz of my illness.

Has something changed since yesterday? You said you were in the UK for treatment and that once you were stable, you were going to return to the US and reconcile. Are you still in the UK?

You can file to remove conditions on your own as long as you can prove that the marriage was bona fide... check here for some additional info. This forum is full of people (unfortunately) who are doing exactly that. Your medical condition is not a deterrent to residency.

Yes, your residency can be secured. If the divorce is finalised prior to the joint I-751 adjudication, you will need to withdraw it and replace it with a waiver. Best of luck to you, with the immgration process and your health.
