Hi, I brought my new wife here from Brazil on a K-1 Visa at the end of January, 2006 and we were married in the middle of February. Very happy too, by the way!!!

Our application is in for her adjustment of status, EAD and Advanced Parole. She had her Biometrics appointment recently......ok, things are good!

She has a 22 year old son in Brazil and we would like to figure out the process for bringing him here permanently.

We are newbies at this so any thoughts or places we can go to get further information woud be helpful. I have not adopted him, so his relationship to me is one of the son of my wife. I do not know if that qualifies me to bring him here as my son or not.

Any advice would be very much appreciated.

Not sure that you can adopt a 22 year old!

Not that it matters.

Once she has ber GC she can file for him, on current timelines, and who knows what will happen to them, then it is about 10 years.

This assumes he is not married, otherwise she will need to wait for Citizenship before filing.

Since you are a citizen of the US (I assume) it's not necessary for you to wait to immigrate you step son. You can bring him in as like the k-1 visa. What I mean is you have several different ways of doing so. Look and research on INS web site. I believe you can petition for him starting with an I130. IT will take a bit of time but I think the sooner you submit I130 the sooner it can be approved. The next steps affidavidt of supports etc...I485, on and on...research a bit and you will see.

This is totally incorrect. You cannot petition for your step-son at all, since the step-parent relationship was not created between you before the child reached 18. As he is over 21 a K-2 is not possible.

Your wife can petition for him, once she has received her Green Card. She would have to file an I-130 for him and at present the waiting period is somewhere in the region of 10 years. There is no easy way for her to bring him here.

He may want to look at a work visa or a student visa.

I'm sorry that I can't be more positive. You can look at the USCIS website and scan through their FAQ's to see if there is any other options for him.
